@@markh-vy1slcalifornia, Oregon and Hawaii. The Lipsitz & Starr study showed the ban in Oregon gave employees 2-3% raises which also implies those signing non-competes may have seen 14-21% raises. The ftc assumes the 3% will apply to the whole economy, it’s a linear extrapolation.

I've seen people get their MBA (company sponsored years of college) and quickly jump ship for much better pay because the company policies restrict to the 1-3% yearly pool. I've also seen internal job jumps go from $68k to $125k because they get the new employee rate that way. Poor HR and "poor" CEO/board. Guess I don't have a point, just business costs suck sometimes and employees get stuck in old positions cost them money/lives too.

Companies also look at severance packages as a way to avoid any possible legal action taken by the dismissed executive in the future. Regular employees generally won’t take or can’t afford such action

The entire idea is to benefit the employer as much as humanly possible. That's it. It doesn't make any more sense to have a NDA at a vet's office than it does a fast food restaurant, yet they clearly existed in both for years

Non-compete agreements are like trade agreements between countries. They are necessary for market economies to function. America's economy would be cut in half (if not worse) were it not for intellectual property protections, for all of that knowledge would transfer to developing countries like China.

@@UhYeahWhateverDude No, I am not. I am simply explaining the purpose behind noncompete agreements and an alternative method of accomplishing the same thing. The primary purpose of a noncompete is to prevent an employee from taking the intellectual property of an employer (which may be licensed from a third party that will sue the employer if it is disclosed) and using it for personal financial gain. A well-structured nondisclosure agreement can accomplish the same purpose. Where a typical NDA is one to two pages, my NDA is a comprehensive 7-page document (plus a signature page) that defines and identifies in clear and certain terms what material can and cannot be disclosed by an employee to any other party, and what parts of the agreement will survive any clause being determined to be invalid by a court of competent jurisdiction. I also establish the laws under which the agreement will be bound, and which courts have jurisdiction. I don't leave anything to chance and I'm very good at writing ironclad agreements.

@@gaiustacitus4242A non-compete isn’t meant to prevent intellectual property, that’s the job of non-disclosure agreements. It’s in the name, it forbids the disclosure of intellectual property. A non-compete is meant to stop workers from just jumping ship to a competitor and working against the original companies interest. If you sink a few thousand into an employees training and they become vital to production then it’ll be bad if they join up with the competitor across the street. Now, a non-compete can include details like a list of important clients that you can’t tell to competitors but intellectual property falls more closely to non-disclosure agreements.

I just got a non compete thrown in my face demanding I quit my new job. Fuck those guys. I worked 3 years and finished my 2 weeks notice. Non-compete clauses only serve to shackle workers with lower wages. Today the workers won.

The former employer will next send notice to your new employer. You will either be fired, or the former employer will not only sue you but also your new employer. Your termination is the most likely outcome. I've seen it happen several times over the past 40+ years.

@@NeoCreo1120 days plus it will be challenged in the courts …which means a stay until the trial concludes so a year or two longer and then what the courts rules plus appeals….so i wont get excited because the stay will be put in place because you can’t go back in time and enforce prior ones non compete if the ftc is found not to have the power to do what they wanted.

Will be interesting to see what happens. My guess is that we’ll see a lot of new businesses form as people leave their company to start a competing business. I assume many have wanted to start their own company but couldn’t because of non-competes. Hair stylists, vets, personal trainers, plumbers, even guys that take care of your yard can now start their own businesses. The irony is that generally, small business owners become republicans over time. Will be interesting to see what happens.

Note that, in an economy where employers will refuse to give raises and promotions to workers 9/10 times, but will hire new workers at higher rates, the ONLY way for many folk to get a raise and stay in their field is to take a new job elsewhere. the Reward for Loyalty to a Corpo is ALWAYS more work for less pay

I’m a mechanical engineer, and I have NEVER seen an internal promotion to level 2/3/senior engineer from the previous level. I’ve seen senior engineers become managers when the previous manager got a better job, and I’ve seen interdepartmental transfers get promotions. However, I’ve never seen an engineer doing the same job at a satisfactory or excellent level day in day out, receive a promotion to the level that reflects his experience. I’ve had to change jobs every two years to get this advancement, each time picking up 20% pay increases, and it is exhausting. Luckily the next transfer will put me at a senior engineer level, and I’ll be done until I’m ready to move into management.

This has a deep place in my heart. I worked as an unarmed security guard/dispatcher making horrible wages ($8/hr) and I had to sign a non-compete. After getting a better paying job not even in the area of security, I was sent a legal letter threatening a lawsuit that I had violated the NC. For $8/hr people. *8 bucks an hour PART TIME* I kindly responded to that legal letter by telling them to eat s**t. I was told by the owner of the company that I was one of their best workers by the way.

@@Lolatyou332 That is the whole idea of non-competes. You are under the threat of a lawsuit if you quit then work for a competitor. It wouldn't be economical for the company in his case, which is why the threat is often just a bluff, but sometimes they will take the loss just to screw you over.

This is huge. My friend’s dad is a heart physician in a smaller area of Michigan. They’ve had budget cuts and put him on leave (there was no issues) he’s been lawyered up and he’s one amazing physician - but they won’t let him go to another hospital. They’ve even withheld his pay!

Companies do non compete clauses because they don't want to compete for higher salaries. That why most people leave is another company willing to pay more. They want people to stay off the market for 2 years so their skills become obsolete and destroy their careers. Thanks FTC. You freed lot of people.

This is exactly what non compete clauses do. Non compete is all about preventing competition for higher wages. Trade secrets and company info that is what NDA for. Maybe businesses should actually read on NDA and implement to their business. Non compete clause overstep boundaries and its blocking freedom. You cannot call America a free country when you cannot move freely to another company without financial destruction. Crazy!

@@ThePiemasteification Companies take a risk. If you train and they get experience and they leave that is the free market. If you want them to stay offer more pay or they will go elsewhere. Non compete is all about control because you don't want to compete. That capitalism and we always here the BS free market but when the free market does not benefit them then they want take it away to control the market in their favor. What you don't know is non compete has caused financial hardship for many. People got laid off then they cannot apply for another job do similar work. And you support that? Get out of here with that!! You don't want people sharing any company info then do a NDA. Businesses can do NDA. Least NDA does not block people from moving to another company.

I work in the tech sector, and there are restrictions upon what I can do with proprietary information, but if our competitor comes at me with a better offer I can take it and start working right away. There is no reason for a fast food worker or security guard to have a non-compete. What are you gonna to...give Taco Bell the McDonald's secret sauce recipe?

IP laws are different than non-compete laws in my opinion. No profession should have a non-compete period. If the business really needs your brain, they would pay you to stay

I have a 24 month worldwide non-compete 😢. My employer emailed everyone to say they’ll enforce it despite the FTC ruling because they and their peers will fight the FTC ruling in court.

This is fantastic. When I was 18 years old I was locked into a non compete with a dog training company. When they terminated me, I went without work for over a year because of the non compete.

Usually, when a company fires you, the non-compete agreement is voided. As it is part of the hiring contract, when they fire you they break the contract, so is the non-competition agreement.

This was just codified in California and went into effect January. Corporations abuse contracts and EULAs, because they have lawyers and we don't. And the more "pro-business" (read: Republican) a regulatory body is, the less they'll do about it even as workers are locked into increasingly unfavorable positions. So kudos to the FTC for doing this, because non-competes effectively lock employees into a situation where they have to stay with the company or pursue a different career altogether. And that's not right.

That's probably the most fatal flaw with our government. The courts are not a level playing field and justice is not accessible to everyone. It's a fairly common practice to write illegal contracts knowing that just the threat of a lawsuit essentially serves as enforcement. There should be steep punitive damages for those practices but "tort reform" has made sure that's not possible. We need to reform the civil justice system to work for people more than it works for the wealthy and big business.

you do realize that democrats being anti-business isn't any better, i.e. increasing retail theft (and democrat run cities doing nothing about it) causing businesses to close down. Not to mention the housing crisis in California and other places is a direct result of city planning (can't build apartment blocks in certain areas). Both parties suck, and cause different problems.

Unfortunately, they can still fire you for that reason as most states are still at-will. They just can't sue you for losses if you were to take additional clients or work for a competitor.

It is actually somewhat pro-capitalist because it locks in labor as a guaranteed resource for the business and prevents competition. Preventing competition and generating a monopoly is the penultimate goal of any corporation because that is when you generate the most profit. After all, where do you buy clothes if there's only one clothing store? Why do you think mergers and acquisitions happen all the time?

It can be regulated with consumer protections, minimum wages, anti trust laws, ect. It can even be supplemented with socialist solutions, like for utilities and infrastructure that increase market efficiency or public goods that wouldn't be profitable otherwise. To say monopolies are intrinsic to capitalism is to believe either capitalism shouldn't or can't be regulated and that is a very defeatist perspective.

I know a recruiter. A client just laid off an entire department. One of the people she placed in that department said the company was trying to hold the severance over their head by making them sign a noncompete. It’s like WTF you just fired me. This is how abusive some businesses have become. Most people have all their experience in an industry and that’s where they can get the best comp. If you can’t go to a competitor, what’s left?

Not just the high end. People who can take your technology and recreate it at home and take your customers; like computer programmers. People like salesmen who quit and start their own company and then call up all your customers and solicit them. That's what it's *supposed* to be. Of course, if you can get away with it, it's great to be able to tell the burger flipper that they can't go work for the competition even if they're treated like shit.

I technically signed a non-compete, but if they wanted to sue me I'd counter sue for not paying me proper overtime. Non-compete agreements are a very dirty business practice that needs to be changed.

You can't treat am employee very well. But when it comes to pay that to some goes out the window. And if they request more money after getting an offer from another company. And you as the owner can't afford them, then what. Not saying a non compete should be used for every type of employment. But their is a thing called employee turn around which cost money. Especially for a very small business. In my opinion.

When I was young I worked for a carpet cleaning company, and by that I mean I was the company. There was the boss, who was the franchise owner and a girl that answered the phone. Apparently I signed one when I hired on. After the third time he couldn't pay me, I was in the office late, putting everything up and harvesting the names of some of my best customers when I came across the agreement. I unilaterally cancelled the agreement via paper shredder before I left.

My doc had a non-compete and left the practice and was told they can’t practice within a 20mile radius of the corporate locations. This meant all her patients would have to travel considerably farther to keep seeing her. She was hoping this rule would pass in her favor. 🎉 Healthcare industry is no longer about patients and their health but rather the mighty $$$. Thank you @linakhanftc ❤

What’s actually crazy is that a huge amount of noncompetes are already not enforceable as written because they are overbroad, but most people stuck under these overbroad noncompetes can’t afford to hire a lawyer to fight them. So, they either comply with overly restrictive terms that a court would cut way down or they violate the non-compete and have to pay for a lawyer when they get sued. Even if they don’t get sued, they have to deal with the incredible stress of receiving demand letters and losing sleep over BS claims and letters to their new employer from their old employer’s lawyer saying that this new worker is violating a non-compete. It’s a huge mess, and I honestly wish they would go away for the vast majority of employees. Only a small category of employees actually have the power to do the kind of harm that noncompetes were designed for.

I'm NOT okay finding the middle ground between big corporate and workers. Or I'm okay finding middle ground between police reformers and police abolitionists. But I'm not okay finding a middle ground between fascists and abolitionists. What I'm trying to get at is: just because something is in the middle doesn't mean it's reasonable. It's very common for far right authoritarian legislation to be proposed. Which pushes the "middle" much farther to the right. From the mid-1970s through the mid-1980, I worked as a computer programmer in the Washington area for companies that had Federal Government contracts. It was not uncommon for employees of these companies to use these contract positions as a springboard for Federal employment. In 1986, I moved to another large city. I took a computer programming job with a company that did contract work for private sector companies. I thought this would be a great way to learn about potential future employers and maybe get hired by one of them. But after I was already on board, I saw in the employee manual that I would not be allowed to work for any of my employer's clients for 6 months after leaving the company. Later, this was changed to 1 year, but I was covered by the old wording. I asked a supervisor I was friendly with if this applied even to employees who were laid off, and she was pretty sure that it did. I moved on and never got trapped by such a provision again. In fact, a few years later, another contracting company encouraged me to take a position with the client I was serving.

I’m liberal and am pro-NCA. They are essential for many types of businesses to grow. It isn’t blocking an employee, rather it is handing the keys to one’s bank and saying this key is only to be used for organizational purposes-not for your personal gain. If someone doesn’t like that, they have the freedom to not sign it. This is just the government interfering in my business, my life. When I’m told how to run my affairs, I’ll move my activities to a jurisdiction that doesn’t interfere with my business strategy.

This is good. I ignored the last non-compete agreement that was in place at a company that removed me from my position despite excellent performance. When they cited my non-compete when I returned to running my own small business, I told them they could try to sue me. I cited the legal precedent that would very likely result in me prevailing. They dropped the issue.

In most cases, it is a civil matter. If they paid for tuition you should pay it back if you break one or if they gave you a severance package over what is minimally required by law. Outside of that scope, they don't have any legal recourse unless it is the redistribution of intellectual property you don't own, and even then, they have to prove you disclosed them.

Non-compete's are needed for only key employee roles, to prevent key employees from stealing customers, product secrets, employees, etc as part of their new compensation package with new firm. A business invests in products, services, training employees and should benefit from the investments, share with employees, etc.. Non-competes are abused by some employers to be used to keep wages down, which should not be allowed. These would be the non-key employees.

Right! An agency charges the patient 3 times as much. Patients unable to afford care not covered by insurance also cannot hire a person that is employed in an agency. Agency costs restrict care. Agencies often hire part timers to reduce costs, exposing long term disabled to multiple caregivers that may be ufamiliar with multiple variable unique needs. Destrying continuity of care , reducing quality of outcome and self determination for vulnerable patients who should be the ones most empowered for decision making. There are benefits to agencies. Liability . Insurance, vacation, but many dont even offer these.

I've turned down jobs that had these non-competes. Because all they do is to keep the billionaires feet on our necks. These companies can provide insufficient medical insurance and zero pay raises to employees. The executives can work anywhere they want. It's just the rest of us that has to stay in our place. Or we'll get fired. The non-competes don't stop working if we are laid off or fired or downsized or outsourced. They are so intrusive. Enough so, we will be afraid to leave their employ. Anyone in congress who wants these agreements should be voted out of office.

Yeah, I signed on to one of these and wasn’t even aware. It was buried on a supplemental page of my contract. The impact is real. I was surprised when my employer didn’t mention anything about raises in a year that we had 8% inflation. I was prepared to move to a competitor who was going to substantially raise my income but then I was confronted with this…after some research I discovered Washington State already didn’t honor this in my case and when I fired back, my employer immediately gave me a raise. Yeah, there’s money on the table

That's interesting, because years ago an attorney friend told me that when it comes to court cases, a non-compete agreement isn't worth the paper it's printed on. Judges never side with the company to prevent a person from working in their profession. After I was told that I completely ignored those agreements and it never came back on me. Oh man, this is amazing. My wife worked for a salon then quit after a year, because the owner was an absolute piece of garbage, and we received so many papers in the mail from his lawyer threatening us with a lawsuit if she ever worked at another similar job with 15 miles radius or opened her own business. It was disgusting. She didn't want anything to do with that profession at all, but the dude was freaking out. I hate capitalism

The only non-competes I've ever seen were of the form "you can't solicit the customers the company is already serving." Saying "you can't do your job at all" was illegal in everywhere I've ever worked.

I just ran through the house and burst into my husband’s room, excited to share this development with him. He just sold his business and the contract has a 5 year non compete clause, I’ve been saying over and over and over “if only you didn’t have that damn non compete, we could open another business bc we did so well and made a great living while working together!” This is great news for the working person everywhere

I am retired now but throughout my work history non-compete agreements were not an issue except for very specialized fields that needed secrecy for there product and when you signed the non-compete along with it came a huge severance package at the end . This is a good thing , stopping companies from getting away with these types of policies that hold people back from a living .

Can you even legally define an MLM in a way that actually prevents them from making very superficial changes and just coming back again in short order? That's a genuine question. Most of us know a MLM when we see one and know it for the constant fraud it is. But you have to use very precise wording in making laws or nothing ever really changes, it just kinda sorta looks like it might have. If you squint real hard. But the next thing you know, those barely different MLMs are plaguing everyone again. I would love to see it happen, I just don't know how feasible it really is.

Now define that structure in a legally specific enough way that it holds up to the guaranteed multiple lawsuits or doesn't have any absurd loopholes from the massive amount of "lobbying". Best case they could just rebrand any given company around two corporate leaders instead of one, or even a "council", and leave all the worst parts of it in place. I would love to see this happen. I just don't think it's really possible. MLMs always make money at the top because the entire structure is built around playing off greed and the myth of easy money. Those desires certainly aren't going anywhere, and you can make superficial changes to the structure and keep the same sideshow going.

A great way I've come to think of changes such as this one is to consider the inverse or counterfactual. Imagine non-competes DON'T exist at all, anywhere. Then one day, a veterinarian employer requires their workers sign a contract that prohibits them from joining a competing vet clinic anywhere else in the state. Meaning if they want to change jobs, they have to leave the state entirely. This would seem absurd! And that's exactly what the non-compete status quo was prior to the ban. Of course not all non-compete provisions are the same, but this is just one example.

The FTC lacks the lawful authority to ban non-compete agreements. Furthermore, any such ban will not have the positive effects anticipated by the FTC but will actually cause a decline in hiring and promotion of workers, resulting in a net decrease in GDP and income tax revenue. An inability to enforce non-compete agreements will result in companies refusing to hire workers who need to be trained, especially when it comes to training on proprietary techniques which provide a competitive advantage. Granted, most non-compete and non-disclosure agreements are unenforceable. This is true when a worker is only using practices which are commonly taught in schools or are widely known through the public domain. However, non-compete agreements are usually enforceable when a worker is granted access to an employer's proprietary information (trade secrets, proprietary techniques or methods, customer lists, pricing data, etc.) and then attempts to exploit the information for personal gain - even if it is just supplying the information to another employer in exchange for a job. For non-disclosure agreements to be enforceable, the employer must provide some additional benefit to the employee beyond the standard prevailing industry wages for the job.

You are required to sign one when you leave the military, but that is to prevent fraud using government contracts. Congress still does it all the time though for personal gain.

Yeah a lot of the system is set up to screw the employee that's for certain. Until someone gets in a bad situation with an employer they have no idea how valuable unions are or how valuable laws that protect workers can be.

Love this! When I worked for a bank, they didn't want to invest in getting my licensing to be a certified advisor so I was looking at Financial Advisoring firms who would but because my bank had financial advising I couldn't pursue it. Non-Compete is anti-competition and ironically, anti-capitalist if Capitalism means nurturing competition. I still believe US is a Corporate/Aristocratic Socialist Regime
