Im currently going through this . Its been almost 2 years . I could use help . Ive contacted the state department. I sent my daughter whome ive had full custody of for 10+ years. I sent my daughter to Canada to visit MY stepmother. Then covid hit hard and she was stuck in Canada. Me and my daughter are United states citizens. My father passed away and my stepmother is newly married to a Canadian.
PLEASE HELPPP….. 🙏🏼🙏🏼🙏🏼🙏🏼🙏🏼 children were both born in California and always intended to live and grow up in California. Moved to Europe (bc of father medical issues). Moved back to California. Moved to Europe (father medical issues). Moved back to California. Moved back to Europe for 2 years (due to father immigration issues & deportation fear). Mother moved back to California with both children and was granted restraining order and children full custody in California due to DV (escaped due to DV/living in shelter/father tried keeping children away from mother while in Europe). Father filled Hague against mother 5 months later. Mother was informed 7 months since her arrival but but not properly served. Current situation: mother still hasn’t been properly served and doesn’t have a court date but has a case number, father hasn’t submitted any information other than the original application, it’s now 11.5 months since mother’s and children’s arrival. DA has informed mother the 6 weeks process starts since she gets served properly but still hasn’t. Question: does this mother have a chance at winning this case if she is to be served properly before the 12 months and/or after the 12 months? Does the 366 day defence apply or intended to grow up in California or grave risk? Mother does not have a lawyer or financial aide. Mother is absolutely terrified to be send back with children, she doesn’t have a home in Europe, friends or family, nothing. Thank youuuuu! Any advise, thoughts will be hugely appreciated.
