I really felt for her especially when she was almost crying but I'm happy Judge Funmi didn't fall for her emotion. I find it very hard to believe there is no back up somewhere. In this era where storage devices have become "pure water". Her raw movie files can even be saved in most cell phones we carry around. She didn't have a back up before handing off the flash drive to the editor. That's stupid. The editor too was carrying somebody's movie around without first backing it up to a storage device that sits at home. That's stupid. Also, she couldn't recover the files from her Cameraman. That's stupid. Smart Cameramen don't delete files until after several months. Our people take things casually and they don't anticipate evil.
That's the problem some Africans do have when they think they no the job, if you work smart your hard job pays, but if you focus on working hard you miss the smartest spots.
Hi, good evening.. I’d like to correct somethings, I’m an editor.. Firstly, as an editor we can’t back up a clients project on our system or drive Bcus this dailies are raw footages and sometimes even consume more than 1terabyte.. The fault is from the director, also a cameraman can’t keep your footages in their camera for months Bcus you’re not their only clients, if they do that everyone how do they have space to shoot.. as a director, you should have a backup drive to store ur footages before giving ur editor one of the drives

I'm very sure Esther wanted to do her things and take money from Alex. How to spend an amount of 420,000 N on a digital project and won't have a backup for it. In as much as Alex acted foolishly in the court room the Judge shown a sense of maturity and a high level of understanding. This episode made my day.
Lack of evidence of payment does not mean lack of payment. The court could ask Esther to furnish the court with the evidence at another sitting (even without her taking the initiative to do so) before making the judgment. The procedures of a TV court should be more lenient than the conventional courts since the parties are representing themselves and are therefore not conversant with legal procedures.
Lack of evidence in this situation is debatable because it's not as if the guy took the money from her, she's the one that should have gone back to the producer and get a receipt. In otherecases you will see Judge Funmi trying to confirm from the defendant if the claimed amount is correct.
Anytime you make payment through transfer state clearly in the REMARK/DESCRIPTION part why you're making such transfer, the account statement can save you stress tomorrow.
Education is really key..the yound lady had an opportunity to express the procedures and process of creating a short movie and even potentially get back more money from the lawsuit..but her lack of clarity was evident.

I'm an editor too. This is total stupidity on the part of plaintiff and defendant because there should be back ups for God sake. Then it is also advisable not to pay with cash but through the means one can have evidence of payment.
This is not justice! Even if the court doesnt have proof, they can estimate based on her project. Not awarding her anything to cover the cost of her movie is injustice. She now probably wishes she had collected installments from the guy who was prepared to give her 400k before she brought him to court. Now, he will only pay 65k. Too bad.
It is reasonable judgment because its neither the guy's fault. It wasn't a situation of theft. The girl is supposed to have her own copy. Phones, gmails, WhatsApp, these are all places to save your files at any point. When the lady gave the film out, did she not think she might want to watch it again and have it with her?
Learn to watch videos till the end before commenting. After that judgement, it is stated that the lady went back to the court with evidence of payment and bother parties agreed on intalmental payment. But the guy paid her the N450k in full.
Judge Asaolu I observed people dressed casually into your court room and also you are not quick at reprimanding people's speech in your court even how they say my honor instead of your honor.
That is not how it works, when you hand over the original copy of the movie to the owner for editing and further production, you'll delete it from your system so as to do other peoples sessions. It is her duty to duplicate the original copy. You can only keep possession of her sessions when she has not paid you completely.
Everyone blaming this Judge don't really understand the law and especially business law. I hope Nigerians can learn through this course how to contract business and relationship with their fellow Nigerians. We have a lot of ignorance in our society and the law doesn't recognize ignorance or emotions. Esther has no proof,no receipts and no coherence in her statements. The guy acted foolishly and might be dubious but not evidence or proof on the amount Ester is claiming.

Beautiful 😇 The law is the law! When you are claiming special damages you have to plead, particularize and proved it! The 65k could only be granted because it is not in dispute! However, the lady could still appeal if she is not satisfied.
I appreciate that there are discrepancies in the lady's testimony regarding the exact amount paid, but the defendant did not deny that some money in the region of 450K was paid to him. He started his testimony by saying that everything the lady said was the truth. I don't agree with the judge on this one, the plaintiff should have gotten the full amount back, at least based on the testimony of the defendant.
He agreed to pay her the total money for the production and the money for the editing I'm sure that he is aware of the cost of the production. I totally agreed with her she must have spent that much for the movie. She have prove of payment, the judge was in a hurry to conclude without looking at the video she made before paying the director. The judge should have asked she to bring the director to come to court as witness , this girl came back from Ghana change money into naira pay someone for which she documented in her phone, girls be careful how you date Esther's boyfriend is not a real man how could he tell her to forget her hard earn money he should have prepared her before she goes to court. Have seen a plaintiff phone rang in judge Lauren Lake paternity court show, also saw an episode where a witness wore sunglasses and was asked to take them off, also saw another episode were a defendant wore hat and was told to take it off by Jerome Halmiton.nothing different from the typical American court show.
That dude crazy you should still pay her to save your face business name she can still come back with the receipts. Of what she paid and sue you again.
He accepted that he collected the flash but she has to further proof the worth of the contents of the flash. If she had a transfer alert she made to the movie director to show, she would have been awarded the money. The court deals with facts that can be substantiated.
Ignorance is a disease! How come in 2020 people still transfer soft content by USB flash. Today you don’t need that. You just need to attach you content in an appropriate and secure software , save a copy in your cloud and sent one to the person you want to send to with a password to open it. Simple ! Even if he loses his laptop you will still have your video in you cloud.
What rubbish is that judgement...That was just cruel, he admitted and agreed that he was given the 400,000 plus yet the judge excused him of his responsibility to return the amount he admitted was paid to him....He had his laptop stolen, NOT HIS MONEY..Therefore there is no excuse for not returning her the money he collected...It makes no sense that the judge need to see evidence that she actually spent the amount she claimed she paid him, he did not denied that he received the amount she mentioned....The Judge was clearly confused, she handled the case as if there was a dispute between what she claimed and what actually happened....The judge was cold, unfair and cruel in the judgement of this case....
What I see here is the lady does not have basic knowledge of film production. She should demand the duplicate copy from the videographer or his manager, the copy should be on the hard drive.
You need to learn that copies of your files whatsoever it may be should be saved in every way possible. Gmails, WhatsApp, your phone gallery, and several other simple storage are available. Remember, she could have lost the flash herself, and if that was the only copy then that's foolishness
Well for me, am not very satisfied with this judgment cuz the alex guy is very stupid with words now and not saying esther is 100% telling the truth about having an xtral copy of her short film somewhere but it would have served Alex well if she had have an evidence to proof she made that payment on that ground the court would have moved for another court Sutton of this matter ..
Some people use English words without knowing the meaning, and that may be dangerous, especially in a court setting. This film editor is lucky that the judge is very kind.
First of all, when was his he robbed? The same day he was handed over the flash?..why didn't the guy report to her immediately? Why did he hv to mention abt the predicament when she called him? Is the audacity for me atleast. Mr. Loss sharer🙄
Esther, not buisness like, she was not ready for court ,no receipt , no plan, unorganised business, no contracts. Esther you will lose again if you don't manage your buisness differently. That guy spend her money quickly in 5 days, you never pay up front for a job that has not been done, what if the end product was a mess. You may learn by error. Even a college essay should have 3 backups incase you lose the information. That man has expensive items in a bag, you leave it unattended on a bus, in Nigeria. How dumb. Esther this world is a cruel place, be mindful who you trust, get receipt, signed written agreements, you would have gotten every penny from the Judge. Nothing documented, if nothing is written it was not done, remember that
This lady should have at least had the director as a witness that the said N420K was paid to him... The editor flopped big time. I hope he learnt his lesson and will do a backup next time. Imagine if the lady could prove her expenses in making the movie.
I like the judge but this case is not just ...all we need is to get the director to prove that she paid 420k cash or not to know if ...then not base of no evidence ther is always time to provide evidence before judgement ...

Sorry about what happen to this young lady, i bet the guy knew this whole thing was informal and he decide to take advantage of the situation. I wish the young lady all the best, however, she needs further training and some form of educated members in her team.
