I have a lady criminal lawyer friend of 50 years since our college days. She's progressive and I'm an elected conservative public servant. The Scalia Ginsburg friendship is what my "best friend forever" and I have been enjoying the past five decades! We agree to disagree most times. I appreciate this video so much! ❤

RIP to these intellectual giants. I definitely align with Scalia's view of the constitution much more than Ginsburg, but I have enormous respect for them both. Conversations like this taught me so much about the law and my country. I am grateful that these two served our country for so long.

I could listen to them for hours - two brilliant mental powers of reasoning and understanding each other objectively. Intellect we are missing in today's politicians, with name calling, scandal hunting and throwing untrue mantras until they are repeated so often the gullible can't see that which is unsupported by evidence.

They are all lawyers, attempting to deal with philosophy and religion - both and each of which are over their heads. That is excellent reason for them to limit themselves to adherence to the U.S. Constitution, which they represent. I'm not sure it would be appropriate for me to tell Justice Ginsburg what she meant when she wrote an opinion, and I'm not sure I could cite precedents as well as she; yet she, not being a scholar in philosophy and religion, presumes to tell us what scriptures meant, and seems ignorant of pertinent facts and precedents thereto. Supreme Court Justices are lawyers. Their business is with the temporal world, specifically with the U.S. Constitution.

I already had respect for Scalia, but I hadn't spent much time listening to Ginsburg, and I'm happy I did. She seems to have much more reverence for our constitutional past than she has been caricatured. The disagreements are real, but her arguments and thoughts seem to be based on open minded reads of the documents.

Our Constitution was written to protect the Laws of Nature and the Laws of Nature's God (Bible) and the 2nd sentence of our first law EQUALITY AT CREATION WITH UNALIENABLE RIGHTS. If so, why do we need an equal rights amendment? Seems a step over the precipice to socialism.

I would agree such an amendment may not be necessary-in Aus, we are freer -than the US & we don’t have such an amendment but under no circumstances does the existence of such an amendment presuppose socialism. That is dross nonsense & fear mongering. In actual fact, if the majority want socialist principles then you would have no cause to prevent such a government. The absolute opposite is also true. 😂 Also, please recognise that “unalienable” doesn’t exist. Anywhere. 😂

A lot of ppl IMO don’t want to educate themselves on important rights nowadays. I am not college educated but I love listening to legal speak and understanding. I disagree with justice Ginsberg on a lot and love Scalia. But she is extremely intelligent and I truly believe she loved America. 460k now.

Debates healthy, stupidity unhealthy. I am not a lawyer, but I love political discussions. I love these two and their civility. Discussing their positions without demeaning or name calling--wow I am positive they could teach both parties a thing or two about civility. Scalia and RBG gives a great history lesson.

Scalia is an absolute titan of law his majority opinions are unyielding and his dissents are epic: check out Maryland v. King dissent-a rare actual reading of his dissent before the court

Beautiful session, RIP Nino...watching it second time after I watched it yesterday on CSPAN. Nino prevented me from pressing +/- on the channel remote. Excellent, concise and clear, even where there is disagreement, there is logic which is absolutely clear. I'm not a lawyer, but I loved the whole video. Kelb's question are also very articulate.

i love them both. Great minds with their own approach according to their unique understanding. The only thing that truly vexes me is how they keep referring to our country as a "democracy" instead of our Republic of law. That is a burning question i would love being answered by them. i celebrate you Justice Scalia! Would have loved to have spent time chatting with you. The US is a democratic republic. It has its imperfections but true democracy only works when you limit those who can participate, otherwise it's mob rule. The electoral college - I'm not a fan, but I understand its place - exists to prevent the worst excesses of human nature from taking charge.

sonia calles mesa and to prevent the more populated coasts from determining the outcome of all future elections. Think about how different a campaign would be if you just needed to win the popular vote? They’d never get out of CA, NY, FL and Texas and evening there in just a handful of cities. Smaller states knew this and were wise to keep their voice in national elections

@@ddylla85 I think Kagan told a Senator, if she were put on the court, she would ask Scalia to take her hunting. All the Senators were asking if she had any life experience with guns, and she didn't being from NYC. Initially, she asked the Senator to take her, but she saw that she had overstepped and said she'd ask Scalia 🙂 Also, apparently, Scalia told the Obama administration to send someone at least smart if not of his philosophy. He then added, "Let me put a finer point on it: send Elana Kagan." They sent Sotomayor first, but they did what he said second. 🙂

I like how there civil with each other and were good friends I hate both political parties because it leads to division and partisanship like we have now. I just hope we can reach a day where we can be like these two disagree obviously but do it civilly and still be good friends with our ideological opponents.

This is what intelligent, civil discourse sounds like. "Papers" refers to private communication, and in the modern era, phone calls are private communication. In the case of the T.S.A., they definitely violate our Fourth Amendment rights.

The Constitution Judge Ginsberg has in her hand was given out at libraries in 1987. In addition a book "The Power to Lead" by James MacGregor Burns with the following quote: “Let us face reality: The framers [of the Constitution] have simply been too shrewd for us. They have outwitted us. They designed separate institutions that cannot be unified by mechanical linkages, frail bridges, tinkering. If we are to turn the founders upside down --- to put together what they put asunder --- we must confront the constitutional structure they erected. - James MacGregor Burns, pg 160 of "Reforming American Government" Edited by Donald L. Robinson. Who are the ‘US’ and who are the ‘WE’ in the above quote? That is the question!

I could listen to old interviews with Justices Ginsburg and Scalia all day. They are both brilliant legal minds with different thought processes and teach us all, in very respectful way, how to engage in thoughtful discussions.

Both are such inspirational figures. I truly enjoy their conversation and wish that the US will once again have such intelligent and thoughtful justices serving. The independence of the supreme court is crucial to democracy, unfortunately the last 5 years have threathen this independence.

I love how Justice Ginsberg started to, and throughout the rest of the interview, refer to Justice Scalia as "Nino" like he was her little brother when asked to describe their first meeting.

Wow, I had absolutely no interest in law and don’t even live in United States.. Watched some senate confirmation of judge ACB and look where I ended up. Two beautiful human beings, both sharp as a whistle . Great chemistry between each other... thought me a thing or two about how to disagree with colleagues, without losing my mind. @@JoefromNJ1 What he is saying is.... this is not for the court to resolve, it is for the local government, and their procedings. He does not want to go meddle in things that are not the responsibility of the court.

Since he was an originalist, many of Scalia's interpretations can be tracked using a series of dictionaries. No dictionary will provide the same exact definitions for one word. Therefore, if you look up "Freedom" in Merriam-Webster you receive one definition, then another from American Heritage, then another from Oxford English Dictionary, then the next goal is to trace what you find to be the earliest definition of Freedom, in accordance to the year that should be in parentheses next to the definition. This is but one way to see how an originalist-constitutionalist sees words that are within historically notable documents.

I hope that this interview can serve as an example of how it is possible to have an intelligent, constructive conversation between bright minds of opposing political viewpoints. I am a Democrat, but it does not prevent me from believing that it is only through this kind of narrative that the United States can coalesce once again and become the great Nation it once was. My condolences to Judge Scalia's family. A Clinton hopeful.

This was great. I learned a lot. I've studied some of Justice Scalia's views on originalism and I agree with most of that perspective. I think the States and Congress need to upgrade or rather update the language of the Constitution to fit the current times. His perspective on the 4th amendment and wiretapping I didn't want to agree with but when it comes to the law, the amendment does not include phone conversations and other electronic devices that belong to people. I believe reviews of certain amendments may be needed to protect the rights of Americans from government and business institutions in the ever-evolving world Americans live in. Thank you two for your perspectives and service to our country and rest in heaven.

I don't know why Scalia while recognising that freedom of the press is not about the media but rather about the printed word wouldn't also recognise that flag burning is not speech because if speech meant any expressive action then the line about the freedom of the press would be redundant
