You mentioned sending people with judicial expertise to instruct congress. Isn't part of the problem the Supreme Court lacks members with legislative expertise? Sandra Day O'Connor is the last Supreme Court justice with legislative experience. There were 14 senators who joined the Supreme Court. Chief Justice Marshall was a member of the Virginia legislature and was the first Supreme Court justice with no judicial experience (there have been 40 so far).

I forgot where I read it but I read something somewhere that talked about how the US government is the synthesis of Aristotle's three forms of government: monarchy with the president, democracy with congress and oligarchy with the courts. The constitution has mechanisms that can turn the US in a monarchy (see the FDR years), a democracy (see the pre civil war years) or an oligarchy (see current politics where it seems like only the court can actually make meaningful change)
