The Probate Process in Illinois | Learn About Law

We discuss the probate process. Probate is a court case wherein the probate court oversees the administration of an estate in order to ensure proper payment to heirs and creditors. If probate is necessary, your attorney will follow these steps to administer the estate through the probate court. The probate process is slightly different depending on whether the decedent had a will in place at the time of death. If there is a will in place, the estate is called a Testate Estate. If the decedent died without a will, the estate is called an Intestate Estate. This article will deal with probate administration of a Testate Estate. In a future article, I will address the differences between administering a Testate Estate and an Intestate Estate, so please stay tuned.

I am a client of you and and very disappointed on my case I haven’t received any help on my case you have very bad lawyer working in your office. I can’t believed that for your lock of experience I lost all my dads belongings. You have charged me all this money with out giving me a solution on my case. When I spoke to you Kevin you said you where doing to help with my case the lawyer that I was assigned doesn’t even have the courtesy of explaining my case in details. I have a question. I'm in Chicago. My mother just died. Her car is paid off and she had the title. She did not own property. Her life insurance, bank account (POD), and 401k has a beneficiary. She had no will and no estate plan. Other than her credit cards, car insurance, and I believe one student loan all with no cosigner, do I need to open an estate for her to settle her debts?

Sorry for the delayed response, TerrelLism. I'm sorry for your loss. You probably do not need to open up an estate. You can probably handle your mother's estate through a Small Estate Affidavit.
