Well, during mediation with TWC (The Texas Workforce Department of Civil Rights) the company's attorney boasted of the arbitration agreement as if saying 'oh you can't do anything to us'. The employer offered one months salary and walked away from negotiations when we refused. So now the case is headed for investigation and eventually arbitration. I'm the employee. I don't know if the arbitration will use EEOC guidance when deciding my case. I have a super strong case if you follow EEOC guidance.
