Thank you brothers for the explanation. I would also argue having someone else to help me in my testimony is an advantage. Just imagine you go to court to testify before a jury, and you have the right to bring along with you someone else setting beside you that you can privately consult with during the testimony. Who wants to reject that? As a man, I wouldn't mind if it was the opposite.

Actually, another aspect of the issue is that witnessing on a court is a burden. You have to devout your time and take a serious risk of making enemies. Because if there is a court, there are two opposing parties. So if it takes two women, more likely people find two men instead of one man and two women or four women. So Islam is diminishing the responsibility of women, not taking from them a right or privilege.

Another accusation a brother below posted : Women would be majority in hell bcz of their backbiting, they curse frequently and are ungrateful to your husbands. Refutation : So? Majority of people in heaven are also women. Idk how majority in heaven being women or majority in hell would be women challenges Islam from any objective stance. Abu Hurayrah (radhiAllahu 'anhu) that women would in fact outnumber men in Jannah, as per this hadeeth*(Below) - which according to narrations included the that of the two wives mentioned, both would be from among the *human believing women (and not the Hoor al-'Ayn). Abu Huraira reported that RasulAllah said: The (members) of the first group to get into Paradise would have their faces as bright as full moon during the night, and the next to this group would have their faces as bright as the shining stars in the sky, and *every person would have two wives and the marrow of their shanks would glimmer beneath the flesh and there would be none without a wife in Paradise. (Sahih Muslim, Book #040, Hadith #6793)" This hadeeth describe women would outnumber men in the end times. Prophet Muhammad ﷺ said, "Women will increase in number and men will decrease in number so much so that fifty women will be looked after by one man." -Sahih Al-Bhukhari 81 So, Majority in Heaven=women Majority in Hell=Women Women would be in majority during end times such that it would be 50 women and 1 men. For Heaven women would be double than men. Argument Finished... Other points : The Prophet ﷺ said: “I was shown paradise, I saw that most of its inhabitants were the poor… and I was shown hell, I saw most of its inhabitants were women.”[13] If this was a comparison between men and women, the Prophet ﷺ would instead say the majority of the inhabitants of paradise were men, however, he said the poor which also includes women. This shows that the majority are women who have specific qualities that will lead them to the fire. Ibn Taymiyyah commented: “This is because there are more women than men; it is authenticated that they will be the majority of the population of Hellfire, and it is also authenticated that every man from the people of Paradise will have two wives from the human women, excluding the Hoor al’Ayn. That is because from those who are in Jannah, the women will be more; and similarly, in Hellfire, because more of them [women] were created.” “If any do deeds of righteousness,- be they male or female - and have faith, they will enter Heaven, and not the least injustice will be done to them.” (an-Nisa, 4/124) [Clearly gender isn't the deciding factor ] Therefore, it cannot be said based on those narrations that the reason why some women are punished in Hell is “their gender”. The reason why some women are people of Hell is the deeds mentioned in those narrations.

Islamic law differentiate between testimonies based on multiple factors relating to the case it self & that includes gender some times. There are a lot of cases where a man testimonies is discarded & overlooked compared to the woman, like the birth dates, family relations status, pregnancy, breast feeding (breast fed people from the same woman considered sibling & therefore prohibited from marriage) and many other topics where women testimonies are taken in to account while men testimonies are overlooked or thrown out the window completely. Similarly, there are other cases were men testimonies are taken over women testimonies like the example you given. Like In the "Verse of Loan" in travels, when a trade happens or a loan was given (we there was no way to officially register it, sign it or write it down) both parties bring 2 men to testify, or one man & two women. The verse then gives the reason why two men or one men + two women "so if one of the women forgets the other may remind her". Please keep in mind that women did not normally participate in business transactions or travel with trading caravans, therefore, not every woman had the expertise to witness a debt contract. Even if two women were available at the time of signing the contract, perhaps the primary witness might not be able to recall the details of the contract or appear before a judge because of compelling circumstances such as pregnancy or delivery. In any of these cases, the second woman will be a back-up. Not to mention that male & female biological & physiological differences. A recent study by two Australian researchers has found that pregnant women do experience a slight loss of memory -- and in many cases, the forgetfulness continues for two years after birth. Researchers suspect that pregnant women's forgetfulness stems from hormone shifts and lifestyle changes. As for giving testimony, a ruling can be made based on available testimony, regardless of the number or gender of the witnesses. For example, the beginning of Ramadan is usually confirmed by the sighting of the new moon, regardless of the gender of the person who sights the moon. Also the highest form of witness in Islam is for someone to testify they heard a narration (or hadith) from the Prophet (PBUH). An authentic hadith is accepted by all Muslims regardless of the gender of the narrator. Moreover, if a spouse accuses their spouse of adultery and they have no witnesses, each spouse must testify five times that they are telling the truth and the other side is lying. In which, both testimonies are treated as equal then the judge separate them.

The verse in question is only about financial matters anyway. Ibn Taymiyyah, Ibn Kathir, and contemporary scholars such as Saadi (well if you can consider him contemporary its up to you), did not hold the view to be general, but of course, other scholars said otherwise, there is a difference of opinion.

Brother, your interpretation (if the woman doesn't forget her testimony is valid) is not what what the Quran says. Simply, Allah legislated that and we obey. We can study the wisdom behind it, but we do not interpret the text in line with current society norms without evidence.

He replied, You curse frequently and are ungrateful to your husbands. I have not seen anyone more deficient in intelligence and religion than you. A cautious sensible man could be led astray by some of you. The women asked, O Allah's Apostle! What is deficient in our intelligence and religion? He said, Is not the evidence of two women equal to the witness of one man? They replied in the affirmative. He said, This is the deficiency in her intelligence. Isn't it true that a woman can neither pray nor fast during her menses? The women replied in the affirmative. He said, This is the deficiency in her religion. Explain needed.

It does not depend on if the women forgets. The rule is still that the testimony of one man is equal to 2 women. This is a matter of fiqh and should be asked from a qualified mufti. I dont think you are knowleged in fiqh as much as you are in Dawah. Again with all due respect. A brother has written a hadith in the comments section regarding this as well. May allah guide us all.

The important 'element' here is: 'two men'. Quran: 2:282 ...Call upon two of your men to witness. This verse is the 'standard' no buts!! It is ONLY, IF, two men cannot be found that women are called upon: Quran: 2:282 ...If two men cannot be found, then one man and two women of your choice will witness-so if one of the women forgets the other may remind her. Women are used here in the case one forgets. Why would one women simply 'forget'? Would a man 'forget'? - So it seem, in Islam, women have 'bad memories' enough to obtain twice as many 'just in case'. Aisha did not 'elevate women' in general. Aisha is used in the Quran as 'the source' for Muhammad's insecurities. Regarding 'wife selling' - how do you correlate that to religion through 'western society'? Why is this false narrative bought into the conversation? Can you show us the verse in Quran that states a 'woman's' testimony is above all men? Why is the focus on women in Quran: 24:6? The point here cannot be women in general as IF you read earlier within Quran the precedence had already been set. Testimony , applies to ALL (men & women). Quran 24:2 (This shown that testimony IS for ALL not just women) - so what is your point here?

If it be a matter of buying and selling on the spot, it is not blameworthy if you do not write it down;329 but do take witnesses when you settle commercial transactions with one another. And the scribe or the witness may be done no harm.330 It will be sinful if you do so. Beware of the wrath of Allah. He teaches you the Right Way and has full knowledge of everything."" 325. This is the basis of the rule that the time for the repayment of a loan should be fixed at the time when the loan is transacted. 326. When friends and relatives borrow from one another it is generally considered unseemly either to commit these loans to writing, or to have them attested by witnesses. Such an act is considered a sign of distrust. But God enjoins that whenever loans or business transactions take place, their conditions should be recorded in black and white and should be attested by witnesses so that there remains no ground for misunderstanding or dispute. It is mentioned in the Hadith that three kinds of people who air their grievances to God go unheeded. The first is the man who does not divorce his wife despite her being of bad character. The second is the guardian of the orphan who hands over the latter's property to him before his having attained the age of majority. The third is he who loans out his money to a person without making anyone a witness to that transaction. (Cited by Jassas. Ahkam al-Qur'an, vol. 1, p. 481; also Ibn Kathir, in commentary on 4: 5, citing this as a Tradition from Abu Musa al-Ash'ari mentioned bv Ibn Jarir al-Tabari - Ed.) 327. That is, from among Muslim males. This shows that wherever one has a choice, one should appoint only Muslims as one's witnesses. In the case of non-Muslim subjects of the Islamic State (ahl al-Dhimmah), however, they may appoint witnesses from among themselves. 328. What is implied is that every Tom, Dick or Harry is not worthy of acting as a witness. Rather, persons of high integrity enjoying public credibility should be appointed as witnesses. 329. The purpose of this directive is to stress that it is better for even day-to-day sales to be written down, as has become customary nowadays (viz. the issuance of invoices). Such a procedure, however, has not been made obligatory. Likewise, it is not objectionable if neighbouring shopkeepers do not record the frequent transactions that take place between them. 330. This means that no person should be compelled to write the document or be its witness. It also means that no party of a dispute should persecute either a scribe or witness for witnessing against the interests of that party. 2:283) And if you are on a journey and do not find a scribe to write the document then resort to taking pledges in hand.331 But if any of you trusts another, let him who is trusted, fulfil the trust and fear Allah, his Lord. And do not conceal what you have witnessed,332 for whoever conceals it, his heart is sinful. Allah has full knowledge of all that you do. 331. This does not mean that pledge transactions are confined to journeys alone. These transactions have been specially mentioned in the context of journeys because during journeys people often have to resort to pledge transactions. Moreover, it has not been laid down that pledge transactions may be entered into only when a scribe is not available to write down the transaction. It is also permissible, if the lender is not satisfied merely with the written promise of the repayment of the loan, for the borrower to seek a loan by pledging some property to the lender. But since the Qur'an urges its followers to be generous in their dealings, and since it is inconsistent with high standards of moral excellence not to make loans to needy persons without keeping some property in custody, the Qur'an has abstained from mentioning this form of dealing even though it is permissible. It should also be noted that the purpose of taking a pledge is merely to assure the lender the return of his loan. He has no right at all to benefit from the pledged property. If a person lives, say, either in the building which has been pledged, or pockets its rent, he is guilty of taking interest. There is no essential difference between charging interest directly and using the pledged property. If, however, either cattle or beasts of burden have been pledged, they can be milked and used for transport in lieu of the fodder that one provides them during the period of custody. 332. Concealing true evidence applies both to a person not appearing to give evidence and to his avoidance of stating facts.
