*** UPDATE to my previous comments; I just phoned Brisbane City Council; they said NO permission nor permits required to film at Mt.Coot-Tha or other public places (in the capacity that Rob outlines); not even for weddings or TV News usage.

That's interesting because in the "when you need consent section" here... www.brisbane.qld.gov.au/laws-and-permits/laws-and-permits-for-businesses/events-venues-and-filming/filming-in-brisbane/filming-and-still-photography-consent#permit it specifically says "parks". Seems like they don't even kn ow their own policy.

@@whatilearnttoday5295 TV is definitely a commercial enterprise. But regardless; no permits required. Wedding photography and videography, is very often by businesses (commercial), but likewise as I said; no permit required, and that's straight from the horses mouth yesterday.

@@SteveMackTV News may be commercial today in nature but law doesn't see it that way, thinks of it more like a newspaper of old. Journalism. Similarly a wedding is a wedding, regardless of if they photographers are paid or not. The activity is a wedding not wedding photography.

I once watched an interview with one of the Kennedy/Millers, and they stated that the original Mad Max couldn’t be filmed today, they went to location, filmed, cleaned up, then pissed off before anyone knew what was happening. Insurance today makes this impossible. Sandy Harbutt ( Stone, 1974) told us the story of how he was told about the cemetery in Nth Sydney where wildflowers were in bloom, just went there, told them he wanted to dig a hole, spit fake blood on tombstones, shoot blanks from prop guns….and paid the Sextant and staff a cold slab. Bureaucracy will always stymie creativity. That is what bureaucracy is designed to do. Keep the vids coming. They are excellent. Cheers.

When I started my YT channels, to try to do the right thing, I contacted the BCC about 'any' filming restrictions & was put through the ringer by the FALO department, re: applications & PLI. They advised that I would require an application everytime I Vlogged anywhere, including PLI if I was wanting to do Vox Pops. Initially for filming in the Valley entertainment district, I did go through the arduous task of applying for permits, then once I obtained legal advice, ceased the BS with the BCC. You are in public, just record, there is no expectation of privacy in public you can film what you like. They are not going to chase you down when there are tens of thousands of people that walk around with their phone cameras out everyday around the city.

Nothing BCC does is useful they love pointless and confusing paperwork. Neighbour of mine complained about something they heard me and the person I live with talking about. Nothing at all fancy. The report was filed and sent to us but it made no sense. A person doing the complaint in BCC was meant to sign it before I got it. Issue was all it said was please contact (name goes here) if you want more details and quote (complaint number here). Same council that called me on Boxing day one year to argue over if my dog was registered. Dog was I had proof but they didn't want my proof they wanted to issue me with a fine and or take payment then and there. After wasting 10 mins of my time finally allowed me to talk "so what is the reference number you have for dog? I bet it wont work." Read out the number it was on the fridge next to the phone. They read it back "dog name registered to lives at address" beep beep beep. No sorry just a hang up. That pretty much is the BCC no apology "we are never wrong don't like it it's not our problem"

The problem with bureacracy like this that "oh no one follows why are you getting caught up on it" is that they will use it to screw you over when they need to. It makes me think of safety practices in any major business where theres unwritten law that noone follows them but when something goes wrong the company will wipe their hands clean and blame everything on you. The little guy can never win with such cases

Something not mentioned in your video, is also the fact that one of the places you were in the city (i cant remember which video) but you also got permission to film there, and were asked to stop filming or leave. No one even recognised your permission form. So not only is it not policed, but ira ignored altogether anyway.

In Australia, you soon realise that you don't ask, you just do it. If you ask, there'll be a rule (Australians love rules) saying no. But there won't be anyone to enforce it, so just get on with it. It really serves you right for getting involved with public service bureaucracy.

Rob, I would argue that you fall under the terms of television news crews - as we were advised by BCC and Southbank Corporate in the past when we've done our RU-vid videos in Brisbane. Additionally, for your tour of Mt Coot-tha - you were on public property everywhere and required no permission to film. (Botanic Gardens are possibly private, but I don't think so) Those terms of news crews are that you're entering and exiting on the same day with no film setup - as you've described when you filled out the form... and at the end of the day it's better to seek forgiveness rather than ask permission.

In watching this, the more people that try and do the so called right thing the more this type of thing will bring it to councils attention and before you know it you will need a permit to take a photo, they are always looking for a way to tax the average person, you are a lone person taking a bit of footage with no film crews and thousands of people are at that place every day taking photos and videos every day, tourists don't know about any forms and will go back to their own country and post a video just the same, how would a council regulate that internationally, seriously it sounds to me the world is going mad.

Pretty easy for the Vogons at the BCC to fix. Start their online form with: Are you an independent content creator on social media (Y) => Do you have a crew or just personally film? (Personal) => What is the nature of the content you are making? (quick description) => Will there be any drones or larger equipment brought in (N).... and have it skip all the other stuff as obviously irrelevant. But on what grounds would they refuse a content creator anyway? If never, they should drop the requirement, even if shortened it would be a waste of everyone's time.

I wouldn't bother and just do it anyway especially in public spaces. If its not the police stopping you then you can just ignore them and walk way. They will need to call the police to stop you and the police generally won't come as no criminal offence has occurred

Don’t even bother getting permission with the type of filming you do. Too much red tape and bureaucracy. Tell ‘em to get stuffed if they say otherwise. Like another comment said, everyone walks around taking photos and filming these days so just go along with this reason.

I just spotted a mistake you have done at 2.49 minutes. The City Botanical Gardens is in the City, where as the Mt Coot-tha Botanical Gardens is at the base of Mt Coo-tha, It has the Planetarium in it! Maybe that is why your permit was invalid?

Knowing beuorocrates /burracrats/buearcrate oh stuff it, public servants possibly operate, any tiny mistake on paper work would most likely make it invalid, hence me writing " Maybe that is why your permit was invalid?" Anywhere you go there's someone filming something with a smart phone. Do they have a permit? Nope. Are they being hassled by council goons or the Police? Nope. Take-away lesson here: complying with bureaucracy only means more dealing with bureaucracy and no doubt being out pocket with fees to support same bureaucracy.

This seems to an issue across Australia Rob. Tasmania currently requires Content Creators to submit a permit which costs >$2000 if you are filming in National Parks. This was highlighted by Harry who has the Fire n Fork channel. Governing bodies need to catchup! 🤠

insane isn't it Rob, no different to getting the drone license because your RU-vid channel is monetized. yet you can do the same thing without a license if your channel isn't monetized. another form of taxation in my thoughts. i went through the same crap with national parks to film at Kinbomby Falls just near where i live in Goomeri.many calls to their office and speaking to at least 5 different people i was informed to fill out the permit form.so i started filling it out and got stuck on a question, so rang them again and this time i was told i didn't need the permit. my question is , is anyone in any of our government departments actually aware of these thing s and what their position is within the government, as i would honestly say NO. will fall on deaf ears at the council i think Rob. much love mate

First of all, I respect the fact that you go to the effort of getting permits and jumping through these kinds of hoops. Secondly, I think that's just council. Or maybe that's just government. All their processes are designed for massive undertakings, which seems so out of step with the vast majority of projects that are small in scale. For example, getting permission to build a 100 story skyscraper requires the same forms and the same supporting information as getting permission to put a garage door on your existing carport. Dealing with council in any capacity is mostly an exercise in filling out multi-dozen page forms with only the words "proposal complies" or "not applicable". On the plus side, reading all these forms keeps a lot of graduate public servants in a job. So there's that.

In this aspect, although I know you're trying to do the right thing, you have every to film whatever you want provided there is no impact on any person's right to privacy. Do I have to make application to Council for watching the content of the videos you shoot at Mt Coot-Tha pathways, and in the Botanical Gardens precinct? If I ask a friend or friends to view with me are there guidelines I should familiarize myself with prior to turning on my laptop? Should I advise neighbours of my intentions including the hours I'll be viewing? If I view at night is there a curfew? If I watch alone can I still give myself a lucky door prize?

Whoa Whoa - that Safe-Work-Method-Statement is no-good! - You've gotta list Hazards and Controls! hahahahah - I have done so many of those things - and I never resist the urge to take a Dig at the site owner in-writing in the SWMS. Hazard : No satisfactory pathway to yard - approaches have rocks, trip-points, lips, puddles - Control : shuffle very carefully Hazard : Ear-Plugs [mandated by site] prevent hearing approaching machinery - Control : Spin around on the spot on a regular basis to observe Hazard : Heat-Stress exacerbated by site-mandated long-sleeves pants - Control : relax in airconditioning lots [a site I went to recently had broken AC in the lunchroom - so I left and went to the pub] Fact : SWMS aren't to protect you : they are for absolving them of blame, "Well, he knew we had a pit of Snakes."

Theres no legality or logic in preventing people from filming at or of a public space or structure (unless certain, very specific conditions like a crime scene) alongside those waivers only existing as a recipt for not only insurance (if a production damages something) but also a legally binding contract that forces film, tv and music productions to follow (ie certain times allowed, noise mitigation, compensation for businesses)

I feel some things are there just to give authorities grounds to act if a person is being a nuisance. If a person is not bothering anyone they don't care, but if they do a Johnny Somali on people at least the authorities can ask if they have a permit and kick them out when they don't.

Only ask permission if it’s obvious you need it. Every second person has a camera in some popular areas, I am sure all but the very rare exception has no permit if pulled up say you are following a precedent.

This is about taking personal responsibility. If you're doing commercial filming and have a large crew with lots of vehicles and equipment, the council wants to ensure you are not hindering traffic or pedestrian and the form rightly applies. For single-person work with no space requirements why would you bother with a permit?

It’s understood that the word ‘film’ has evolved. It’s becoming a but outdated but if someone asks you to “dial a number” you understand that they don’t expect you to use an old rotary phone. Many words evolve like this, if you want to be pedantic you have to take in every aspect of a thing. There are probably other more pertinent issues you could be annoyingly pedantic about.

I don't think everyone who films with their phones gets permits. Doesn't make sense you're allowed to film in public areas as long as youre not creating a nuisance or invading peoples privacy ie having a camera in their face. You worked for LCC didn't you, you know what its like 😅.

Did they reject or approve your application? I guess it is Council's "property" but presumably there's no laws or fines that could even be enforced. Maybe they could sue you for damages in a civil claim, but what damage would even occur.

Oh - sounds like a Brisbane City Council employee is trying to meet their quarterly quota, to secure their bonus and pay for their lifestyle. Naturally, as a government employee, I wouldn't think they have enough communication etiquette to engage in conversation with you and assess your true and entire needs as a RU-vid Content Creator; buy hey, and they'll tell you, they're just 'following policy', because extending themselves beyond what populates their computer screens could cause them injury, mostly psychological, and then we enter a whole new realm of Brisbane City Council bureaucratic B.S.

I honestly think that the local laws need to be changed to encompass content creators who are monetizing their content. There is obviously no expectation of privacy in public and that should be codified and made explicitly clear that if you walk around in public, you may be filmed, if my eyes can see it from public land, then it can be filmed (exceptions to prisons and military bases of course) and there is nothing you can do about that. If the filming is simply one or two people with a GoPro or a phone, then those forms should no longer be required to be filled out, whether you are making money from that or not - as to be frank, anyone can upload to RU-vid nowadays, and anyone can monetize their content at anytime - you can't police that, and RU-vid is now pretty much the default for amateur and semi pro videographers to upload their content, where in the old days you'd just put it on a VHS tape and share it around with friends and family - from my perspective this is not much different, apart from the fact that you no longer use tape to store the content - whether you make much money off it or not doesn't matter!

There are literally hundreds of content creators wandering around out there filming stuff with no regard to whether they need a permit or not. Ask for forgiveness, not permission I say, if anybody pulls you up for basically being a tourist and putting your content online. I have seen videos in China where people make political commentary and get kicked out of the country for it, but short of that, who gives a rip if some dude is wandering around commenting on the history of various neighbourhoods. It's all pretty innocuous and informative. Sure, you may be infringing against the letter of the law if anybody cares to investigate, but as was once said, "the law is an ass". If anybody knows where that quote comes from, comment below. I do know the answer (because I just googled it) but I'd be curious to know if people generally are aware of that quote, and that concept of the law.

We need to recognise your little discretion when completing the BCC application form. I'm sure all your fans will agree that this error obviously occurred due to your modesty rather than pure intention to deceive. It's seen under the section "Film activity: Describe the filming activity..... yada, yada, yada". Your response being, "I'm going to be filming trees, plants and flowers..... yada, yada, yada". Come on now Rob. Really? A little too modest here we feel. What you're really filming is..... "Rob, yourself, you, they & them, in today's woke parlance". It's time to throw yourself on the mercy of the BCC and beg forgiveness. ;-) P.S. Why not be setting off explosions? lol

This is just the case of the law not catching up to the modern realities of content creators. It'll probably take just one formal challenge for it to be reviewed and new policy developed. That is probably why they aren't actively policing it - they are aware it wastes everyone's time including their own, but if you ask they have to give the official (aged/obsolete/not updated for the times) advice as public servants.

Unfortunately it comes down to risk......risk of accountability. If you asked and they said, "yeah, no worries" then you tripped and broke your leg, theres an accountability risk. Did BCC due their due diligence to prevent you from being a clutz? BS, i know but its probably about corporate risk mitigation. Having said that. The permit does need to be updated to recognise the content creator industry - should be a few mins to fill in and everyones happy..........except the lawyers who wont get a juicy negligence claim 😂

Exactly the form is useless.. theres a dozen videos year per year vloggers plenty of videos... your in the open world. Your not in a military area 51 hehe. think about it. The form is pointless.. All you have to do is read the law of filming can you film brisbane any such way? if it says theres no law where you cant film brisbane then the form is pointless.. Just go have fun filming do your documentries of the potanic park. Dont stress out.

I guess the council needs to cover themselves for any potential ‘commercial’ activity from a risk-assessment perspective. That form you filled out would seem to be a total overkill for only a single camera operator but they would still probably require public liability insurance if you’re a registered business.

It never even crossed my mind that I needed a Filming Permit. That would be such a pain as I would need hundreds of them. I'd go to the Botanical Gardens, Southbank, Kangaroo Point, Wynnum foreshore, a couple times a week.

not sure if maybe I can not see the screen correctly, but none of the documents required seem to be mandatory (at bottom of screen "* denotes mandatory" I cannot see the "*" on the fields you uploaded to. are you sure they were required? I get the process may not appear to be applicable for you specific form of content, but those fields did not appear to be mandatory anyway.

The overall point I was making with the video was that I shouldn't have to fill in this form at all, regardless of what is mandatory or not. To expect people with only a hand held camera to even fill in one space on the form is pointless, since it is never policed in person and people film there everyday regardless.

I know this feeling all too much, You're absolutely right. Like always government hasn't kept up. If you're turning up with tripods, crew, and rigging, of course, you need permission, it's going to disrupt the public space. The council doesn't charge for "low-impact crew" Surely this should just be an option? Film-making kits have become so small and accessible nowadays, considering almost everyone has a smart phone in their pocket the council needs to catch up!

Rob Take it up with the Shrindog or would you like us to bring up With Cr Sandy Landers she serves for the B Ridge but for environmental parks? This would be a huge issue with drone photography where your flying in BCC nature reserve and getting a City shot or a backdrop of the Glass mountains its quite concerning

I should have warned you about this, as I read the act the only exception is for news broadcasters, so POLICE, Government Agents, road cam, Security Body Cam, CCTV overlooking public space, people taking video selfees, and content creators such as yourself require a permit. Talk about a free society. So much for filming you kids in public spaces for prosperity reasons. P.S. if the Police film you report them. P.P.S, does the Brisbane City Safe City Camera System have a permit to record? Just saying.

some content creators do have a large crew and production look at 'viva la dirt league', i think end of the day is YES there should be a RANGER and if they see a crew of 30 set lights battery packs cameras etc then they need to step in, as clearly that could be a issue to the park. ultimately its common sense, maybe the person you spoke to thought more would be involved, i prefer requesting call backs from supervisors etc to sort these issues out to clear up the facts.

The number of content creator with a large group of assistants bringing multiple amounts of equipment is beyond miniscule. The vast majority are one-person shows.
