My MH C&P examiner wrote a nexus attributing anxiety/depression to my lower back pain replete with radiculopathy, and I am now at 80%. Next up is the PTSD decision review (in process). Still waiting on my c-file et al for tinnitus/migraines. These in-service events are all in my records. Don't give up if you have your evidence. I'm not giving up till I hit 100%. Period.

You aren't going to get anything additional for ptsd as all mental conditions are rated together aside from eating disorders, which is rated separately from others, just fyi

@@steffsaint I already know, Steff. I was service connected for PTSD last month but saw no increase in benefits. I'm ok with that. Nevertheless, I'm working on my secondaries. In fact, yesterday I had four C&P exams for: Asthma, COPD, Migraines and Toxic Exposure (PACT Act). And while the C&P examiner offered no guarantees (they never should), he definitely stated I had all four based on my C-file, evidence, migraine log, et al. Now, I just patiently wait for the DBQs to hit the VA Rater and observe the outcome. Moreover, I can appeal any or all of the four. Finally, even if the VA Rater says "nyet" to the compelling evidence, I have already put in for TDIU in February 2023, which is a sure 100%. But, hey, thanks for the comment.

I just received a denial letter from the VA. I'm 100% PNT for 16 yrs. I use knee beaces so I can move. They dissaproved my clothing allowance because my knees are not service connected. Im obese, stage 4 atritis, My knees are bone to bone my pain is 24/7. That's ridiculous, I have never asked for shit all these years, and they won't help me. Sorry for telling you this. I never talk to anyone about my problems. I just wanted to vent.

Secondary conditions don’t require an in-service event (diagnosis/ complaint from active duty). Secondary claims need a current diagnosis from private or VA and need to be linked (nexus) to one of your service-connected conditions. How do you apply for secondary claims online? I already got service connected for PTSD and I want to apply for alcoholism but I can't seem to find alcoholism listed on the VA claims application webpage.

Your not getting a VA doctor to write you a nexus letter. If anyone has you are a magician. I’ve had 2 Drs and 1 PA looked at me like I was freaking crazy when I made the request. That just something they will not do from my experience.

You’re correct and most won’t - unfortunately. Some do, and I’ve had a few Veterans luck out…but the priority list would be: 1: Primary care (VA/private) 2: Outside IMOs/DBQs - Clay

Awesome content Sir. Quick question, I'm a retired Marine and my old OIC and friend recently asked me to write him a VA buddy statement for his chronic back pain. I served under him in the mid 80s and again in the mid 90s. I never witnessed a catastrophic event that would have caused/contributed to his back issues, but I can attest to the strenuous PT we underwent. I also know 1st hand that 20+ years as a Marine is hard on your body. He's now age 68 and never submitted a claim despite the fact that his military and civilian service records are well documented. He's currently working with a VSO in order to formulate a fully developed claim, but is also seeking buddy statements from people he served with. I want to add value to his claim and was going to reach out to one of the pay-for-play claims "experts". I then stumbled upon your many VA claims content videos and decided you are honest, upfront and not running a scam. Having said that, what advice would you suggest in terms of writing a buddy statement that lacks 1st hand knowledge of an incident, but can attest to the rigors of our daily training? Sorry for the book report but I'm trying to help a brother Marine who needs help. Thanks and Semper Fi Ken

Thank you VERY much for this list!!! Ditched two VSOs, and went from 0-60% doing the leg work myself after watching your vids and others (wont name names, lol). VETs needs to get educated, research the regs and forms, and then ask each doctor up front, "Do you know what a Nexus letter or DBQ is?" If not, then "Are you willing to fill one out once you know what it is?" If not, then don't waste your's or their time. Why pay someone who won't put it in writing (learned the hard way with wasted time and $). Some physicians shriek about anything VA or gov related.

You'll want to add stroke to the hypertension secondaries bud. The Manual actually directs for it to be granted it just needs to be claimed and evidence of the CVA shown by medical. Holler if you want to discuss expanding the list.

New here. Do you think a 90% rating in total will go up to 100% with Sleep Apnea at 50% and having diabetic as secondary ? That the one I just got reviewed for. Waiting on the decision but is very solid claim with evidence etc. Do you think it could go up to 100% or is gonna stay the same ? 😢

Can a secondary claim be filed on a claim that is pending. I have a tinnitus claim pending can I claim secondary with medical records if tinnitus hasn’t been closed/approved yet?

It can either online or with a 526. Highly recommend the evidence for the primary SC is absolutely solid before going that route. Really an ITF would be my first option. - Clay

I was treated for insomnia during my enlistment 1987-1991.. Ringing in the ears was later entered in my military medical record. I also had dizziness and lightheadedness entered after that. I was diagnosed with sleep apnea and issued a CPAP machine in 2016. How is sleep apnea secondary to Tinnitus?

Long story short…anxiety/stress from tinnitus. I’ve seen OSA secondary to tinnitus SC with CPAP at 50%any times (although not common). You will need a strong IMO whether that’s from a C&P or private. - Clay

You’ll see the inverse relationship and tbh, I’m not sure about vice versa. OSA is known to cause Hypertension, I’m not sure about the other way around. Regardless you’ll need evidence indicating it so. - Clay

I submitted an "intent to file" and i am working my case. I want to file for Tinnitus as a service-connection (need nexus ltr). I also want to file a secondary to Tinnitus for peripheral vestibuler disorder (dizziness with slight staggering), as well as Migraine as secondary to Tinnitus. My question... should I file for Tinnitus for service connection and then later file for secondaries or should I submit for every condition at the same time?

You can file all 3 at the same time as long as you have the evidence. If you don’t have the evidence, then I’d recommend to hold off and use your ITF date or file what you do have evidence for. - Clay

So it's saying here breathing claim can cause a second type of breathing claim. In my research the va only pays out for 1 breathing condition. If my asthma caused somthing worse like copd are both paid due to it being a secondary?

Not all respiratory conditions are rated together. Asthma and Sleep Apnea are normally rated together but CAN be combined to receive a higher rating - doesn’t happen often. - Clay

Hi, as always thank you for all you do 😊 If I want to submit migraine/headache secondary to my SC conditions, which ones make the most connection? (Depression, Tinnitus, maybe OSA?) Although submitting for migraine/headache will be my first time filing for this condition (not previously denied condition), will my personal statement enough, or should I consider getting an IMO? My current Dx from private doctor doesn't mention anything connection. Thank you.

I remember when I first got mine after Boot, man, was so scared since we were told no "identifying" marks. Now a days, it seems like the military is competing with those who are locked up. Not judging, I have a few, but they are easily covered with clothing, but dang.... When did the regs get so soft on them?

I'm a Vietnam ERA, Veteran. I been told for years, that wasn't possible!! Recently, I've found out there is a way to get V H A, to respond.. It's called a V.H.A. [DIRECTIVE]. 1134(2): lat update was May 2020. So yes according to the directive they have to give Each of us Veterans, there assistance..

I was just on Reddit and it says under( Aneurysm ) If you have an Aneurysm under 5cm you have 100% for 6 months after being released from hospital . If you have an Aneurysm of over 5cm and need surgery you have 100% . I had surgery on June 26th 2023 for an abdominal Aortic Aneurysm of 23cm. How come I am not being paid at 100% ? ( Feb 1, which is Thursday , I am having an operation to replace the Aortic valve in my heart.

I have a question. I am currently rated for a few things and among my rated conditions is Tinnitus, Insomnia, Hyperacusis, hearing loss and Depression. I was just recently denied for Migraines as secondary to Tinnitus. I had 2 Nexus letters , a diagnosis and my C&P examiner said I had Migraines that are directly connected to Tinnitus. The rater denied me because in his/her words they said there is conflicting evidence that Migraines can be caused or connected to Tinnitus. My VSO was shakey and said "Oh you cant connect migraines to Tinnitus". I was like "well you shouldve told me that . What should I do ??? There seems to be something dishonest going on. The rater is not educated on this matter and shouldve considered the totallity of my conditions and connected them to all of them . Please I need guidance. Thank you

Good morning and thanks for everything you are doing for us. I have an appointment with my private gastroenterologist in January and chances are I’ll get diagnosed with IBS, which I understand is a Gulf War presumptive. Should I claim IBS straight as a presumptive? Or should I claim IBS secondary to PTSD (70%) using obesity as an intermediate? Which COA would you recommend? Thank you and blessings to you.

The real answer is…it doesn’t matter. Claim it direct. The VA will look at direct, TERA, and secondary service-connection. Fill the claim as a ‘new condition’. - Clay

Do you think it would be possible to connect headaches to sinusitis(10%)? I don't have a constant pattern in my record for either because I always just dealt with it. But I have had 2 different surgeries to try and correct the sinusitis.

What are your thoughts on connecting a cervical spine condition secondary to lumbar spine? I am service connected to DDD in my lumbar spine and started to show DDD in my cervical spine 1 1/2 years after retiring.

What I would personally do…is start seeking treatment and while doing so, guiding the conversation with my provider about your lower spine causing your neck pain. I’d also look at what caused your lower spine damage and see if that could also cause your upper spine pain and go direct. Secondary is a difficult claim but definitely not impossible. I’d also like to know what lumbar condition you have specifically. - Clay

@@TheCivDiv The VA rated me for lumbar degenerative disk disease Diagnostic Code 5242. I have been seeking treatment for my neck for the last 1 1/2 years. I have done PT and prescription for massage therapy. My lumbar spine specifically has degraded to my most recent MRI showing moderate stenosis at L3-L4; L4-L5 and L5-S1 to include stenosis of the nerve roots coming off L4-L5 and L5-S1. Currently underrated for my lumbar spine IMO at 20%, will be looking to increase because medical records due demonstrate degredation in my lumbar spine over time and now have bilateral radiculopathy.

Yeah so that list doesn’t mean diddly squat and is years old. DKGVF was recently Accredited by the VA so prior to that is when that ‘blacklist’ was made. Someone made an excel and added names. There is no VA blacklist - fact. - Clay

I just filed a fully developed claim for migraines secondary to hypertension on October 31,2023. Received a email on November 3, 2023 I will be getting a call on November 6 to schedule a C&P exam. That’s what I’m freaking talking about!!!! And yes. I submitted a personal statement with the migraine log going back to January of 2023.

I’m only saying this because of the amount of times I’ve had to deal with this and been successful. Prepare for a HLR with an informal conference call and let your evidence speak for itself if rated at 0%. Rators often rate Migraines at 0% even when the evidence is clear. - Clay

I'm direct service (not secondary) connected for OSA .. the VA gives the run around.. but how do you go about a secondary to sleep apnea? Apparently it's confusing because nobody I have met or talked with has ever known anyone with sleep apnea as a primary and not secondary to something else.

Secondary sleep apnea isn’t as easy as everyone says it is. There are correlating factors (not causative factors) which makes it difficult. I just filed for insomnia secondary to my service connected cervical spine disability. Been fighting it for over sixteen months. I have prescriptions for sleep and pain. Seven doctors reports including the VA for insomnia because of pain. And shown I’m currently doing treatment from the VA for insomnia. due to chronic pain. The cognitive behavioral therapy. CBT. The CBT is a really good program!! But unfortunately the chronic pain throws a wrench into it. But,… it gives me a tool to get things back on track when need be.

You're doing it. I just got my insomnia rating secondary to my connected back pain. I did have a private psychologist write me a nexus, but I had a lot of evidence like you so I wondered if I even needed it. The CBT all makes sense, but it didn't work for me either when it's pain and tinnitus is constant. My claim took about 100 days to come back. Hopeful they'll do right for you brother.

​@dloverland no. Insomnia is treated as a mental condition. I was already service connected for back pain and tinnitus. So they sent me to a physiologist to talk about my feelings. I was also diagnosed with MDD and Somatic Symptom Disorder so they talked about all 3 in the exam since they lump them all together. I just made sure to tell him how the pain kept me for sleeping well for years. Thankfully the C&P examiner I had was pretty good for once.

A diagnosis of Hypertension will result in a doctor providing meds to lower and stabilize the condition. Then if you claim this, the VA will see you don't have Hypertension during a C&P exam...thus you are not showing signs or symptoms. Am I mistaken? I have back pain amd radiculopathy but am given meds to manage it. So this makes the c&p exam less effective at showing my true disability.

Hypertension is different because medication is a part of 38 CFR which would put the Veteran at 10%. When it comes to your back, you won’t find medication in 38 CFR. What is the medication for? Muscle spasms? Medication would at least indicate something is going on and would most likely rate a 10% based on RoM. - Clay

If you disagree and believe you had all the evidence needed, you can submit a HLR within 1yr. If you need 'new and relevant' evidence you can submit a supplemental appeal. Ideally you still want to remain in the 1yr mark but supplementals can be filed for any denied claim. I'm not going to cover the Board as I would recommend getting a lawyer if this is the route you're going to take. - Clay

@@TheCivDiv you might add a caveat that it will not do anything for you compensation wise since bruxism cannot be evaluated as a stand-alone disability. It's rated as a symptom or component disorder of the disability causing it. I am unsure if it would help open up dental treatment eligibility.

Thanks for all your support to Veterans. Question. I started out as 20% ankle. In 2015 I had 3 surgeries. Condition has gotten worst. I just got awarded 60 % nerve damage. Nerve damage is permanent. I also received 50% Mental Health. Sitting at 84% round back to 80%. I plan on going after some secondary conditions. Does the VA ever look at your situation and decide if you should be 100 % based on what you have or do I need to keep fighting the fight for what I think I should be rated at.

@@jimmajetic8289 hard to get is relative to you, your disabilities, and your ability to keep gainful employment. You will absolutely need another C&P Exam and I think it would be safe to say that the VA doesn’t generously award TDIU. You’ll need strong medical evidence. - Clay

I would file the tinnitus as a primary. If not in service records. A good personal statement and buddy statement can get you an extra 10% if your C&P examiner is not an asshole. Personal statement: "Noise exposure while in the military. Mid July 1988 - assigned SIMA Long Beach - Pistol range in LA or Orange county qualifying for Pistol Expert. Approximately 36 people firing for qualifications, 45 shots each. Around bedtime after being on the firing range had reduced hearing on both ears. By morning it seemed to improve somewhat but not to original hearing. The following day hearing quit improving and I first noticed ringing in both ears. It has been continuous 24 hours a day since that time and never goes away. " Followed by 5 other examples of noise exposure. Buddy statement from my now wife who I met while in the military: "To whom it may concern July 20, 2023 : When I, Nxxxx Wxxxxx, met Dxxxx Beekman in November of 1990 he was enlisted in the US Navy. He complained then that he had ringing in his ears. I have been in his life since then. I have noticed that Dxxxx cannot hear high pitched sounds. He misses hearing alarm clocks, telephones ringing, or timers. I have to constantly tell him that some device or another has gone off or alert him to any high pitched sound. He often says that the sound matches the same high note as his tinnitus and he can't hear it unless he is within inches of the source. I have noticed that at times Dxxxx stops what he is doing and winces or shakes his head. When I ask him what is wrong he states that his ringing in his ears has changed pitch."

Huuuuuuge question...First, look at what symptoms you are experiencing and what it could possibly be. If your legs go to sleep or tingle and you have lumbar strain service-connected...speak with your primary care. If diagnosed with any king of sciatic nerve damage, then you know to submit sciatica secondary to your lumbar strain. You can use that template for just about any and all conditions. You will definitely need to think about your symptoms and speak to your primary care. - Clay

Had IMO. Cp said it couldn’t cause osa. She never addressed that it could make it worse. Or didn’t acknowledge that the weight gain could make it worse.

@@Kenny-lk3bv well…I’d like to see the IMO. If your IMO said PTSD causes OSA, then your C&P Examiner is right and whoever did that IMO is wrong. That’s just instance and instead of speculating I’d like to see the IMO if you’re up for it. From there, we can make a plan. - Clay
