The reference ASTM F589-85 that they are using is now obsolete and replaced by a more modern version from 2017 which adds airsoft to the list of unaffected replicas with bb guns and paintball. Going by their own wording, what they are doing is incorrect and it shouldn't pass if everyone fights back.
The issue is of the hundreds of thousands of views I've seen on videos pertaining to this only 12k people have commented on the regulation. Too many people are lazy and comfortable and won't do shit to help protect their hobbies until its too late and they just cry about it.
@@PervasiveFire some people believe it is just an orange tip rule, some people don’t want to submit a comment because they are not a US citizen (valid) or they don’t want the government having their info (they already have it and you can submit anonymously), or the site has not updated yet. Yesterday, we say about 7k more comments.
I've said for years especially with the Canadian c21 bill that RU-vid influences need to start interviewing their elected officials and getting them involved.
Even if this doesn't directly affect airsoft it's obviously being interpreted both ways by the community as a whole. If that's the case then in court it'll most likely be interpreted the way that fits the narrative most at the moment. Can't hurt to oppose it until the wording isn't up to interpretation.
This isn't 'proposed legislation' it's a regulatory agency outright changing the wording, through their 'Rule' process, of a law passed by Congress. With the original wording only becoming enforceable law because our representatives voted for it. Regulatory agencies are getting out of control.
"We're not coming for your guns we just want common sense laws to make things safer for the children" "We're not stopping you from playing airsoft we just want to make it safer for the children" I'm seeing a pattern......
The ones pushing this crap are aged Boomers who don't want people to be wealthy and have fun, narcissistic abusive soccer parents, or the cowardly liberals.
I love how the bill says it will have little to no environmental impact, when they physically have to add on distance to every single shipment to get them inspected, as if none of these trips produce additional emissions.
we need to more than just just stop this legislation, though stopping this is the first step that we MUST succeed at! i'd be in full-support of a class-action lawsuit against the CPSC if all major airsoft companies, and NERF, and everyone else potentially affected by this legislation got together and demanded reparations for sending us all into a frenzy over this unjust and unwarranted regulation that threatens to cost multiple companies millions of dollars, and potentially destroy my favorite hobby. ALSO, we need to make sure they cannot do this again, EVER, just change the rules without the affected parties being aware of ramifications until it's almost too late to stop it! this goes beyond over-reach, this is straight up injustice!
This is not legislation! The CPSC is an Executive Agency like the DOJ and ATF. They have rule-making authority to make rules to "enforce" a piece of legislation passed by congress. Similar to ATF's recent Pistol Brace Rule, the CPSC is abusing said rule-making authority to put in place what amounts to legislation by reinterpreting a law to push current executive leadership's anti-gun agenda. They recognize that toy guns get kids interested in real guns, which leads to gun-ownership, so they'd like to cut off any related merchandise that they can.
Most of them are banned on RU-vid lol, grand thumb and t Rex are the only 2 that actually put airsoft in a good light. To my knowledge airsoft is for kids in the eyes of most real steel owners
I did my part! Question, when we know if it does pass the regulations, and how much comments would we need to not let this happen? First time ever doing something like this
Wait I'm confused so they didn't do any research about it and just chamge it but not only did they change it they have added a few that don't need to be checked like nerf guns. They have been around for years why now they have to be checked? This sounds like a very stupid thing to do/change because now people who have ordered airsoft, paintball or nerf guns have to wait for who knows how long and might not be able to receive it
@@humbleguardsman5578 i guess to make sure it hasn't been modified or anything likr that because it can be modified but even so it's stupid since you'd buy them from a legit company. Like nerf guns shouldn't be on the list
as someone who just found out that airsoft is for more than just shooting your friends in your backyard 3 days ago is there any word on how this turned out as of almost august 2023?
Ok, I'm dense. I am missing something. The ruling states that airsoft guns will be held for inspection, how does this actually impact the industry beyond delaying shipment?
This is not okay. They don't understand airsoft is not just for casual pick up gamers. There is an entire community of veterans that use airsoft as a platform for PTSD aid. It also helps veterans integrate back to civilian life. They have a use for the skills they have acquired that otherwise would go unused.
Nothing in this rule will require inspection labs in Taiwan or anywhere else. A general certificate of conformity (GCC) is made by the manufacturer to attest that their product meets a standard. Anyway, a GCC is only required if requested. All of the regulations that have applied for years under Commerce still apply and there are no new requirements. I'm happy to answer any questions off line or here. I'll check back to see if there are any replies.
If you’ve dealt with certifications you would know it’s foolish to not do them unless someone asks. They are typically available to customs and big retailers will require them for new products. They don’t ask for them with every shipment.
For those of us who work in this industry it’s about showing policy makers that we won’t let them try to sneak in new regulations. If we let them do this over and over again, our guns are going to look nothing like what we want. Let’s take real firearms for example. They can’t outright abolish them in the US, so they side step by raising the taxes on ammo and/or requiring background checks to buy it. This gives them the toehold to keep adding more legislation which would ultimately make getting ammo impossible. Therefor rendering the use of firearms null.
@@DesertFoxAirsoft Did you call the Compliance officer listed in the docket to verify these rumors about new regulations? I called him. He told me that nothing is changing except the jurisdiction.
I work at the CPSC as the Consumer Ombudsman. My comment keeps getting deleted, but I need to correct some misconceptions about this Federal Register notice. All the notice does is change the jurisdiction for these products from Commerce to the CPSC. Congress did this and it is posted in the Federal Register as a direct final rule because it doesn't change any regulations. There is no requirement for 3rd party certification in this rule. I'm happy to answer any questions!
The switch to CPSC does now apply CPSCs regulations (according to what I’ve been told) to the category and manufacturers of non-toy “imitation firearms” such as airsoft, have to test and certify that the product complies with the marking regulation (a GCC). This was pretty clear in the certification section of what CPSC published. No matter how you slice it, that’s new, even though the text of the regulation being reissued is not substantially changed.
@@lookoutforchris That's not right. This is a self-certification strategy, like all of CPSC's GCCs. All the firm has to do is attest to meeting the standard. There's no testing needed. And, this GCC in only needed if requested by the CPSC. It will take as long as it takes to write an email.
Am I missing the part where this bill is something bad? It just sounds like buying an airsoft gun will take longer and be a bit more expensive if anything, but so what?
The delay of airsoft rifles will greatly change the current market for these toys. Guns that originally cost 1000 may double in price and shipping times will increase dramatically meaning that the barriers to enter airsoft will increase even more. This puts more strain on the amount of new players joining and could maybe even start to kill airsoft. New players won’t want to spend thousands of dollars on a solid gun and won’t want to wait for 8 months to get it.
Mr. DesertFox, Do you think that the comments in opposition to the legislation would actually stop it from passing or is it more just to show that they would upset a lot of people? sorry if this seem too formal but I don't know how to address you spesificly.😅
I'm not Mr. DesertFox, but to me it seems like the government is going to do whatever they want to. We've been letting them go unchecked for too long now. They need to start working for us again.
Typically, I stay out of things that are political but I openly commented on this bill because I love Airsoft. No way am I going to stand idly by while the Government starts messing with my guns (even if they are toys). To throw the logic back at you, why not fill it out? It takes all of 2 minutes and you can forget all about it. If it works and it fails, then cool. We won. Otherwise, you burned 2 minutes.
There's fine print on the document: F. Effective Date Unless the Commission receives a significant adverse comment by June 12, 2023, the rule will become effective on June 26, 2023. The requirements of 16 CFR part 1272 apply to look-alike and imitation firearms manufactured or imported after the effective date.
Since they can't take our guns they're going after the only thing that's keeping them alive the image of them and the fun of them so if they take them away to where kids and people who have made a hobby out of playing with airsoft can't touch them anymore they've taken a generation of possible gun owners out of the playing field 🤔 or at least that's what their logically attempting I mean what else would they want to go after It looks like it after all Canada did everything that they're doing here but went a little further with Nerf guns... Oh God officer Tim young 10-year-old Jeff over there has a Nerf gun but the worst part.... It doesn't have a serial number 🙄 and yes that's not a joke They literally force people to put serial numbers on foam flinging freaking toys imagine what they'll do to these things that we enjoy 😠
This is absolutely absurd! So it's basically a crime to have toys and use them to have fun?!?!?!?! This generation is doomed thinking this far ahead and this generation needs God more than ever right now!!!
Be sure to also be telling your legislators about your 2nd amendment rights, because airsoft will 100% fall under those standards, and if not, they will make them so.
So new guns will be effected and old gun and owned guns on hand will not be. It was made to sound like all including personally owned are gonna be effected. If you really think about it. It’s not too bad of an issue but it’s still a big one. I already submitted my comment. Just be tactful and respectful
from britain i feel what is happening i feel a better way for them to come across this would be to add the two tone rule where you just need to apply for a license to remove your colour from the gun
Screw your dumb Brit licenses. It’s a toy, this is ridiculous. All the original legislation does it allow criminals to paint orange tips on real firearms to be less conspicuous before committing a crime.
Quit the fear mongering, airsoft is not in jeopardy. This whole thing is being blown way out of proportion. The new ruling does not change anything. In fact, all it says is it’s just changing who’s responsibility it is in regulating the marketing, sale, and whatever of toy guns, adding the current rules to the new governing body, and just creating a new certification. It doesn't apply to non-firing firearm replicas, die cast gun models and the like, and traditional BB guns, pellet firing air guns, and paintball guns. Stop blowing this out of proportion, it's not America's C-21, airsoft is not ending in the United States.
It is being blown out of proportion but it is unreasonable how it impacts businesses. The letter of the rule is not changed but because it’s CPSC issuing the rule now there are certification requirements that’s did not exist before. Manufactures and importers will now have to test and certify by using a General Certificate of Conformity that their products meet the marking requirements. There’s uncertainty about how much more than the markings have to be certified as the CPSC has a large jurisdiction and many rules and regulations. Since this rule was reissued using a very fast process there is not much time to sort out the uncertainty, do the testing, and do the certification paperwork. This certification has to be done for every product produced or imported. It’s a lot of work over a very short time period and it will likely cause some amount of delay in production/importing/shipping/and sales.
@@lookoutforchris except those certifications have been around for *years*. Nothing is changing. It just means that someone else is in charge and all the same rules and regulations still apply.
