I used to be a probation officer, and I wrote many pre sentence reports. A CENTRAL question was: “Is this offender likely to comply with terms of probation if the court should see fit to impose it? Is he a candidate for probation?” There’s no point recommending probation, with its various conditions, like seek counselling, report monthly, submit to drug tests, etc, if the offender is essentially just going to violate every term he doesn’t like. In this case, I think Trump’s attitude towards the gag order means that he wouldn’t comply with probation, either. The judge shouldn’t impose it if that’s true.
