It's not bad. It's may not be completely true to the Silmarillion, but even Tolkien changed his mind often and contradicted himself. They're doing a great job considering they don't have the rights to even use the Silmarillion.
The thing is, you pretty much already said it, they don't have the rights to the Silmarillion. The Show was not supposed to be an adaptation of that book, more of a retelling of events in that particular time span
