Tom, Can you tell me where Circuit Courts get their Jurisdiction from when any case involving a breach of legislation is before them. In the US it is the first thing to be established and declared, before proceedings can commence, but never mentioned in Irish Courts and it cannot be done privately?. Thanks.
Niall, the only courts with jurisdiction to review legislation on constitutional grounds are the High Court, Court of Appeal and Supreme Court (Art 34.3.2). Not the Circuit Court. Art 34.3.4 then envisages the Circuit Court ('Courts of local and limited jurisdiction with a right of appeal as determined by law'). The legislation enacted on foot of that provision then governs the Circuit Court. TH
Id like to here your thoughts on articles that have been removed from the little BOOK book. i have the big GREEN book 1937 constitution. ..himmm not the same constitution mate....how could a valid constitution have articles removed and altered irish text???

The blue book is not our constitution our real constitution is the 1937 , The blue book is a book of commerce, 1937 is the primary law of the land, 63 article's in an Bunreaćt 1937
You see this is what the problem is on this territory of éiRe ( Article 4) You and people like you are banging on about a little ( corporate) blue book being de Valarie's 1937 bunreacht na héireann when its not.. and hoodwinking our people. The book you are on about with 50 articles ( written in standard Irish text) that came out when we a divided island, was brought in ( but not by the people but through war time measures in 1942) though I might add we were neutral.? While our true constitution , a 63 article written in our indigenous ancient text cló gaélach was the constitution that came out in 1937 by a 32 county plebiscite of our people. and is the true law of the land. You are very misleading DR.
Berthmark: Where + how could I obtain a copy of the 1937- 32 county constitution (Gaeilge) - but with subtitles - as sadly through lack of use, I will need to brush up on the original language? I have lived in UK for many years.
