Transport Canada vs. Buffalo Airways: Ice Pilots' Biggest Challenge 

This is NOT Transport Canada, this is an individual at Transport Canada changing previously accepted procedures...it is essentially a form of entrapment and there is no choice but to have a major lawyer approach the Minister of Transport.

The re-runs of this show are never dull and boring.

I have my suspicions of Transport Canada pushing out old planes and small companies to make room for big conglomerates that might be possibly foreign operated and the inspectors from Transport Canada and others higher up get monetary incentives for doing that.

That's what happens when one person has that much authority.

I'm with Joe on this one. Bureaucrats really are the lowest form of life.

Hands down the worst aspect of being an aviation operator is dealing with some of the clowns that turn up to audit you.

That the higher eceholons of Transport Canada were prepared to even partialy annul the Inspectors decision leads me to belive that , later, behind closed doors, the question was asked 'How , this side of sanity could you have come up with that one?'

So the Canadian FAA really thinks that pilots who have been flying every day in harsh arctic environments need more training, that has to be the epitome of a bureaucracy

Drama, drama, drama. During my flying career I flew for a few sketchy operators and never experienced such drama but we didn't have TV producers and cameras around. Plenty of FAA inspectors though.

I've heard stories about US carriers that kicked some of these overzealous FAA inspectors off the property and told the FAA not to ever send them back and banned them off the property. Anyway loved the flying ! I flew DC-6 and C-82 in Alaska. Those were the best days!

Keep the classics running and the supplies moving. Excellent that Joe has been doing this and well for so many years. Government needs to settle down and remember they work for us the people not the other way around.

Here in Australia, CASA is the regulator and as an operator, you have to make a choice. You do it their way of you are grounded. So there are specialist businesses who work with operators to make sure all the paperwork is perfect. They act as an interface with CASA for you on compliance issues. Their people are all ex CASA inspectors. Yes, it costs, but not as much as being grounded.

If it is a charter flight, the trip is ended once the plane is empty. The empty trip back is non-revenue. Charge the customer a "repositioning" fee to get the plane home vs billing them for aircrew and fuel costs on the way home.

This happens with every external audit in all the fields, every year you get a different clown with different interpretations of regulations. It is not limited to airlines.

Government officials need re educating. They are there to help and assist companies not be at war with them. An empty plane returning from a delivery used as training makes sense.

That Transport Canada thing where pilots on a flight that aren't specifically set as a training flight doesn't count is mental.. Time in the air flying is time in the air flying... Best way to learn something is by doing right?

Sounds like the easiest, but expensive way to conclude a task between private industry and government is by legal means when communications come to a halt. Same with filing for bankruptcy, taxes owed, or in a panic qualifying for Medicaid.

Paperwork is the downside of any type of business that must by necessity be regulated. Doing the proper maintenance and training is a no-brainer. The flip side is that regulators can't verify that the training or maintenance is good, but only that the paperwork is. As long as everyone is held to the same standard no one has a competitive advantage, but it still sucks. Even if I had the discipline that you need to fill out the paperwork in some professions I wouldn't have a clue where I put it.

To say something is being done incorrectly, the inspector MUST show them the regulation where it states how it is to be done. Otherwise, they are in the wrong and have NO basis to back them up. 20 years in the Air Force taught me that. But then again, power hungry people can and DO wield their power over you...

MSHA can be just as bad, we've had some good mine inspectors and a few that sucked. One of them pretty much told me that they're required to find at least a few infractions.

People who engage with regulators without lawyers are unwise.

FAA says consistent fuel leaks are a sign of structural failure. Idk about these older planes though, seems somewhat normal.

those inspectors are criminal. People like that have no right to have any form of power.

Joe getting a temper is already a known sight, but when Justin who's level-headed says there's something wrong, that does say a lot.

In New Zealand we have the CAA (civil aviation authority) but everyone dealing with them knows it stands for "conspiracy against aviation"

they make standard flying procedure look like life and death situations.

my step dad was a captain in a medellin, colombia airline called SAM flying this electra 4 propelled planes, i always wounder what ever happen to this planes and found them...lol

Scratch "non-revenue flight" and substitute with "training flight" for documentation. Everyone can go home now.

Listening to their comments, the "training" involves demonstrating proficiency in certain maneuvers. Routine trips did NOT include those maneuvers from what they said on camera. Ergo, invalid training; quityourbellyachin! A smart manager would have read the book and followed the rules.

"Good Officer's Conduct" requires the Inspector to conduct himself without prejudgement nor malice. If the Inspector does this malfeasance in the name of and representing Transport Canada. Then Transport Canada is responsible and the inspector CAN & SHOULD be held to account as well as personally liable & responsible beyond the protections of the Canadian Government. This means anything & everything he owns or will ever own is at risk to be forfeit.

If (and I do say if) we get the full story here, the CTA inspector is way out of line! I am used to deal with the FAA (American CTA) and I have never experienced something like this. Yes you shouldn't train your pilots on revenue passenger flights but here we are talking about cargo revenue flights. In America it is normally accepted that you do pilot training on maintenance, ferry and to a certain degree cargo flights. We have no rule (as far as I know) about the pilot training flight should originate and terminate in the same airport, so that might be a Canadian thing. Anyway the pilots received the required training so why should they train again? Is their training any better without boxes in the aircraft? Again if we get the complete story here, I am glad that I am not dealing with the CTA!

Worked at small one horse fbo. Owner always on good terms with inspector but some times the official would get a little too close to stuff they shouldn't see. He would always have an "oh by the way" question asking for their expertise, knowing they wouldn't be able to answer right away. They would inevitably leave not wanting to look silly.

What an embarrassment. This happened because one or two people wanted to justify their positions. What a complete clown show at TC.

The more i learn about Canada the less I want to visit. Transport Canada nerd sounds like he was waiting for a payoff.

There is nothing more useless than a bureaucrat. Nothing.

The other thing to do is keep up the pressure on Transport Canada to promulgate specific regulations by oversight by the Canadian Parliament. Bring political pressure. The other thing is sue them to recover all cost of training flights. File charges against them for official misconduct with the RCMP and have them arrested when they show up. They want war so take the fight to them.

This is certainly made for dramatic effect. But there is an underlying truth, that the purpose of government is to provide income, pensions, and arbitrary power to government officials, while hurting citizens freedom, productivity, and economic well being. Government is esshoe.

Transport Canada is a flawed institution. I have been a commercial pilot for 42 years. Since CARS they are all about interdiction and shutting aviation down. The office environment is caustic and they have trouble keeping personnel, except the most incompetent.

Transport Canada reminds me of the dmv. The dmv came to do a yearly audit of my shop and looked at a piece of paperwork and said I was price gouging because I charged 25 bucks for a part that cost me 10 bucks. When you own a shop and you buy parts on the receipt from part stores it will say what I paid and what retail price is, I paid 10 bucks retail was 20 and I charged 25 so I said how can you tell me what to charge? Where is the law so I can make sure I am doing what the law says? He said it’s a gray area. So I said ok we’ll look at this receipt this part company has insane recommended retail prices I paid 37 bucks for brake pads and the retail on the receipt is 150 bucks so ur saying that would be fine with you? He didn’t say anything for a min and said it’s a gray area you can’t charge 150 for those brake pads. I said well you can’t have it both ways if ur telling me I have to not go over retail then because you don’t like the retail price from one part company how am I to know what is legal? I said if you gave me a write up or fine I would get my lawyer involved if you couldn’t show me a document with the law I’m breaking and if you can’t provide that every judge is going to throw this write up in the trash. I told him that every shop marks up their parts that’s how we cover warranty’s and make enough money to stay in business and the mark up percentages I use are the same that 99% of shops use It’s the same percentages that the company I pay for my point of sales system put in when I opened the shop so if you went to another shop they would be charging the same exact price for this part. Then I said when people get their cars repaired at a dealership even the dealership marks up the parts the customer could buy the part from the parts window at the dealership for less then the service department charges them when they install the part! Even places like Pepboys that have a part store and service department it’s the same thing they charge more then what the customer can walk up to the parts counter it’s not ripping a customer off we have to make money on the parts to stay in business it’s no different then any business they all make money on their products The dmv guy said I’m not writing you up I’m just telling you to be careful. All that meant is he knew I was right! People think auto repair shops make so much money but we just don’t it costs so much money it’s almost not even worth it. People think because I charge them 1,000 bucks to do work on their car that I put 1,000 in my pocket but in all reality I put $50 in my pocket after paying the bills.

I have had similar encounters with pencil-pushers from the Ministry of Labor- when I recited the existing legislation and asked the Inspector how he would propose to perform the work, he suddenly became mute.

Here is my take on the training, what Buffalo are doing as for flying empty planes back as training flights is taking off from a frequently airfield typical of their destinations and flying back to Yellowknife meaning they get to understand the weather paterns of the routes again they take frequently, they probably fly through a lot of harsh weather on that return trip weather thats quite probably not around yellowknife doing circles. So flying back empty on training flights in my opinion gives greater experience. What they should have done is maybe got the training flights empty return trip counts in writing but I do also wonder if Buffalos paperwork was also up to date, I mean certain parts of this show and I guess doing paperwork does not make good TV but you see a glimpse of it when they preparing the passenger flights and it does appear disorganised.
