Innocent until proven guilty, as it should be. Many innocent people have been railroaded by the authorities by overreaching. Bond is simply set at a level that will ensure that the accused will appear in court for trial. Bond is not to be used as a punitive measure to keep the accused in jail pending trial. It is a fine line, but one that should favor the rights of the accused prior to their trial.
@@briansmyla8696 bond CAN be used to keep a person in jail b4 their court date. And a bond DOES NOT ensure that they go to court, id say over half that get out on bond never show up to court and end up getting other charges!
This officer is classic! "Shot through the shoulder, possibly the chest, I'm having trouble breathing". As he's walking around taking care of business! Hope his recovery went well.
Nobody would've blamed him for a second if he sat out from there on. What does he do? He goes to the side of the car. Used reflection to assess injury. He goes to the trunk and gets out the Big Gun. Locked and loaded.

He likely will spend many years in prison. Now that he has pleaded guilty to the Federal firearms charge and received 9 years for that the state prosecutor is looking at filing attempted murder charges. These things can take years. Be patient. He is not getting out for many many years or possibly never.
I was going to make this comment too. You HAVE to know it's all on camera now right? Dash cam, body cam, gas station CCTV. You can't just say, "the cops rolled up on me all aggressive and I had to defend myself!" and we all just believe you especially when you haven't got a scratch on you.

This officer is one of the toughest men I have ever seen. I’m sure adrenaline had a lot to do with it, but he remained calm, alert, and informative. Wow.
Don't forget it was Rtrump who signed a get out/stay out of jail card the day before he left office for a man known to his son in law who was under investigation for lone sharking and threats to kill. Doing that also closed a multiple years long investigation into organised gangs and extortion.
Walking around after being shot makes it worse. I know his adrenaline is running but, moving around speeds up your heart rate and makes you pump more blood.
Considering his injuries the officer was so composed. Still trying to handle stuff while injured like that, what a total badass. He needs more recognition for his service!
The civilian had more know-how and handled the scene better than the officer that came to assist, explaining his wound entry, directing traffic. He should get an award. As for Officer Vaughan, such calmness and professionalism even after being shot, he's an incredible man with titanium balls!

thats the judicial system in general. it was most likely a drug related crime is why they were out on bond, violent offenders don't typically get bond, and when they do they usually ruin whatever family members lives that signed their houses away to pay their bond.

You may have got the chronology wrong. Out on bond (for possession of drugs, a non-violent offense), and THEN he shot a police officer. He wasn't out on bond AFTER shooting him. Perps are generally held in jail without the possibility of bail for attempted murder of a police officer.

I get it now. The criminal that rammed a police car then led the police on a high speed chase that ended with a Pit maneuver which caused him to shoot at the police officer with no ill intent is the actual victim and the police officer is the aggressor. NM is a revolving door of a shit show, Las cruses even more so they had such bad over population in the jails and stuff they would people out for most non violent crimes or wouldnt even take them in. My friend and i were working a circle k there (we were employee in el paso but offered to help in due to them being short staffed) and we had a homeless dude come in and steal beer, so we called the police as we are required to do by our company, LCPD shows up and picks the dude up and take him to jail where gets let out not more then 30 mins later, then he come back. He causes a scene steals more beer, so we call LCPD back, they come back out arrest him again and he gets released again no more then 30 mins later, he then shows back up at the store grabs the metal trash can next to the door and proceeds to smash my friends cars windshield in cuz how dare he call the cops on him for stealing beer. Thats when the police kept him locked up, and that was the last time we worked in NM we told circle k to shove it, we werent going to go back there again. Three times they had to show up to deal with this guy. Dont even get us started on the homeless problems in general...
Blue governed areas are soft on criminals that result in deviating from bonding guidelines and felony laws that would generally call for high bond to deter early out for felony suspects. DA's and judges are grossly deviating from felony statutes. It has made repeat offenders more aggressive toward NM LEO because they know the criminal friendly DA & judge will let them out on PR bond even though they are already out on bond, they'll cut them loose the next day. Blue areas have become lawless and Homicides have sky rocketed big time. Every OSI suspects have already committed crimes with firearms and were out on PR/Signature bonds. It's not NM LEO cutting these criminals loose, its the DA and judges not adhering to NM state felony statutes, you want justice or accountability, it's best to relocate in 1 of the 12 hard red communities/counties or other conservative states.

I have a big issue with the lack of urgency the dispatcher had. They should have gotten all units to the scene as soon as he said officer hit. Especially when he said he was having trouble breathing.
And you don’t know what was dispatched via txt and electronic messaging and what was not heard audibly over public records video media. Stop being an ass 🤡 you know when their own blue get popped it’s an all out response! They had GPS location of the officers vehicle no question there, they had aid in route.

I love seeing civilians helping our officers. They risk their lives, literally for us. Those saying there's bad police- there are bad people in every single profession. We need police. Also blows me away seeing a bunch of vehicles not moving over for the officers. Anyways, these officers are amazing and bravo to the civilian who helped!
Adrenaline is a powerful hormone. He was lucky that round didn't nick his carotid artery in his neck. Bleed out quickly. Rounds to the shoulder can easily bounce of a bone and go into a major artery/heart. Very luck man indeed. Was not his day to go.
How in the hell can anyone justify the way law enforcement is treated when they are literally waking out of their homes each day for the last time, they truly don't know if they will return. He's shot twice, one in the neck, bullet still in him, having trouble breathing but stays the course. Later he's taken to the hospital and released that same night. Thank you for everything you do, all officers! To the guy who ran to the officers aide, in pretty sure he said he's an emt, you rock as well! Those who were on both sides of the officer helping keep traffic away from him and the situation, you're amazing as well. Seriously this is how it should go, everyone stayed a safe distance until they could help and then all jumped into action where they knew they could best help. ❤
The officer who got shot was unbelievable. He said he was shot in the shoulder, possibly in the chest and was having trouble breathing. Even with all that, he kept going, relaying all the info, watching where the people were fleeing and remaining unbelievably calm. The civilian who helped was fantastic, put himself out there when he didn't know what had happened other than someone had shot a policer officer (and could possibly still be around). He said he had stopped most of the bleeding so he was "no longer bleeding out". Whether he was bleeding out, who knows, but it is possible he saved the officer's life. Meanwhile, the second officer who showed up seemed panicked. Couldn't get the back door of the car open, didn't know where the first aid kit was and seemed to concentrate of some bleeding on the officers chest while the civilian had to tell him a couple of times that there was a bullet hole in his neck. I don't want to be too hard on him, I probably wouldn't be that cool in this situation but it was a contrast to how the first officer and civilian handled it.
Adrenaline that the body produces in a critical injury is an amazing medication. Huge props to the officer that was hit. He kept doing his job to keep the community safe. Thank you to the Good Samaritan and other officers who rendered aid. God bless you all!
A hero for stopping someone using drugs in a bathroom….not worth possibly losing your life over…until it was escalated it was a victimless crime. Also, a civilian calling doesn’t establish probable cause or reasonable articulable suspicion of a crime. That is a fact as stated in case law by SCOTUS. Glad the officer is ok tho. The hero would be the ones that came to his aid. Also, the one who called could’ve cost him his life or someone else’s.

Edgewood near I-40 is a bad area. A few months prior to this a shoplifter lit the super Wal-Mart on fire, bad enough that the store was closed for several months. Several years ago, a Bernallio County Deputy was murdered during a traffic stop by a murderer who was on the run trying to avoid capture for a murder in Albuquerque. That guy was finally located in Juarez, Mexico and brought back for trial, conviction and life w/out parole sentence.

The lieutenant pulls in behind him with his music blasting and assertively knocks on the window. NORMAL immediate reaction is "WHAT'S THAT?", sees the officer and complies. Immediate reaction if the car is already in reverse, I can see him hitting the gas and striking the cruiser. But that was not the case. He had the time to think, "Fu@# this, I'm out", put the car in reverse, strike two vehicles, run over railroad ties and flee. Now he's being chased, and he knows this, for several miles. Tries to make a right turn and gets tactically pushed into the guardrail. He knows who is behind him. He knows he has a firearm. He knows he's out on bond. He CHOSE to use the firearm and flee on foot. But, no, he was the victim of an over-zealous officer and he is the victim... I think not.
The guy was out on previous bond for previous crime. then tried to murder a officer. There is no way he deserves to be released on ANOTHER BOND! He derserves to serve 15 years no parole or early release for attempted muder of a LEO. Judges need to be strict in their decisions and sentences.
It is so frustrating to listen to the suspects relating his “story” especially when the police have already watched the body cam video or the dash cam.

Defendant lied totally in his statement. Trooper never said a word to him at the gas stop. 🙄 Courts need to really rethink their bonds. The current system is flawed.

As of Feb 24 Caleb Dustin Elledge pled guilty to the federal weapons charge and is facing 9 years for it. The state case for shooting a police officer has not begun yet.

They were out on bond for different charges "at the time" of this shooting. Meaning, they committed a crime prior to this incident, got out on bond, and then did this.
