He can appeal - and be out on bail until that appeal is heard. UNLESS he continues breaching the gag order or otherwise is in contempt of court for some reason. The way he's going, he may well end up in prison for the defamation of people involved in the trial and intimidation of witnesses. The Judge can hand down a custodial sentence even for first offenders if they have no respect for the process and constantly breach the court rules. He has already breached the gag order 11 times, without consequence other than small fines. The Judge may yet add some time to his sentence for these and/or revoke his bail if he continues to bad-mouth the Judge and others involved.
Because our constitution is for everyone. Because he hasn't been sentenced yet. Because he has a first amendment right to "spew rubbish" and if he defames anyone he will again be sued and it will cost him millions.
