Lawyers must abide by a code of legal ethics, taught in a special class during the 2nd or 3rd year. There's also continuing legal education (CLE) after a lawyer enters the profession. Every law school graduate knows the ethics requirement--even before sitting for a bar exam. Prior to the bar exam, a separate ethics exam is given, which a student must pass by a score of not less than 75%, in most states. These bozos were idiots to let Trump use them. But don't worry---if you're worrying: they can teach at most law schools because one doesn't need a bar card to teach law, and the pay is pretty darn good, at the better law schools.

@Gadget Carpenter I take it that like me that you have read the full 110 page judgement. If you have not then you should. On your assertion that there is admissible first hand evidence of fraud this would seem to be inconsistent with the pleadings in the Dominion defamation case where there is no plea of justification. That is to say that the allegations are true. Such a pleading would have required evidence to be provided so it is telling that it was not pleaded that the statements were true.

You do not have the freedom to present improper cases to a court. You do not have the freedom to present false testimony in court. You do not have the freedom to lie to a judge in court. You can TRY, thinking that you're free to do so. And that judge is then free to mete out the appropriate consequences.

You're right! Dominion will have to prove "actual malice” or “reckless disregard for the truth,” in other words, knew the statements were false and repeated them anyway. Dominion Systems is a public figure and “public figure” rule also applies to “matters of general public concern". They will also have to demonstrate they were damaged by the false statements. If Judge Nichols orders the case to trial, it will be up to Giuliani, Powell and Lindell to make the case for why their statements are backed up by the truth or why they deserve protection as opinion under the First Amendment. Dominion Systems will get a chance to collect evidence about what the defendants knew, when they knew it and what they did or didn’t do with that knowledge. Dominion has a hard road ahead as well as the defendants so this really isn't going to be cut and dry.
