@@reason6835 A retroactive NDA is not an NDA, it's a bribe. Campaign finance laws are fairly specific about bribery. her story had monetary value. She was paid more than it was worth on the market as an exclusive, to a tabloid. It was concealed and listed as Cohen's legal fees.

This is more about if a jury can decide if it's all credible enough or not based on if Trump's side can actually manage to explain away what they have found. My guess is that if he isn't convicted it would be more because of a technicality than any innocence.

Yup, it isn't even Cohen's testimony. they have the check documented. The $130,000 went to Stormy Daniels. Trump would not lose track of $130,000 and Cohen would not try to deceive Trump for an amount that big. It was Trump's money and only Trump would benefit from making such payment to Daniels. Also the affair happened in 2006 and only 2 weeks before the 2016 Presidential election was the payment made, obviously Trump knew about it, authorized it and was the only person who would benefit from it.

Technically, Trump was attempting to hide the payment through a bank withdrawal rather than the LLC as he wanted to pay directly in cash. That would have gotten a suspicious activity report from Trump's bank, which is why Cohen suggested laundering the money he was obtaining through a personal loan for renovations, which would not look necessarily suspicious on its face, in order to finance an LLC, which paid someone to sign a nondisclosure agreement. That someone would not have been paid if they were silent up until the election and the payment were to occur after the election according to Cohen and whatever documents or recordings that Cohen could present. Whatever invoice that Trump produces is easily discounted by the tape recording. Trump is trying to claim that the loan is an item in the invoice and as such, it is the cost of Cohen's doing business as a lawyer, but Cohen could not obtain the money stating exactly why the loan was being given as it destroys the purpose of the LLC, and as such, Trump's claim is absurd.

It could be an interesting twist, and would it have any value, when defense would show M. Cohen's flips on Trump, then the prosecution would show the flips of Trump on Cohen (when Trump was regarding Cohen as a friend and a superhero to the point of "who is this guy?")?

Yes, we should ignore that the original loan was for renovations. We should ignore the tape where Trump asked about paying in cash. We should ignore the corporation having been set up to move the loan for renovations to someone who isn't a contractor for construction. We should ignore the actual contract for the transfer of monies. We should also ignore the fact that Trump was trying to stiff by actually withholding the timing of payment until after the election, which would be irrelevant if the defense that it was not for campaign finance violations were true. On the other hand, we should ignore the fact that Cohen was deeply devoted to Trump, which explains all of his inconsistent statements. We should ignore that the reason why he lied to Congress was in Donald J. Trump's interest, and it was against Michael Cohen's interests.
