Cohen has already been convicted for a lot of things he did. He went to prison for it. The prosecution also made a point of making sure nothing Cohen did related to this crime was left out, so there’s no dirt the defence can dig up. It’s already been done.

The facts that Cohen paid off Stormy Daniels and then later charged Trump for legal services that he then paid and marked in his records as legal services is not in dispute. What we are waiting for is the evidence that having Cohen on Trump's payroll and paying him for legal service was done to cover up another crime which I'm still not sure what that covered up crime is even supposed to be yet.

In the interest of fairness, I'll actually answer you: falsification of business records. Trump falsified his business records in order to cover up campaign finance violations in connection with the payment to Daniels. The part New York is prosecuting him for is the falsification of business records, since that's the part that took place in New York.

Your laws in the US on blackmail are a lot laxer than ours in the UK. But in the end, if you have done nothing wrong, all you do is tell the police and ask them to prosecute them for blackmail, and if the blackmailer speaks out, sue. OTOH if you have done something wrong, then you should confess to whoever you wronged, and tell the police about the blackmail so they can prosecute. Paying a blackmailer off is stupid, and encourages them in their wrongdoing.
