The indictment process doesn't work that way. Someone in the DOJ can't just say "let's indict him", and he gets indicted. Grand Juries and/or Special Grand Juries have to be assembled, and they have to hear the evidence presented by the lead prosecutor(s), and if the Grand Jury agrees, then they recommend and indictment. Then in some cases ANOTHER Grand Jury has to hear the evidence AGAIN to get an actual indictment. The point being that the charges are pretty well vetted before anyone gets indicted.
