List of all Exempt Institutions Registered under Section 12AB or 10(23C) or Section 80G:- The Income Tax Department has released the database of all 4,26,920 Provisional OR Final Registrations granted u/s 12AB or 10(23C) or Section 80G on its website. incometaxindia.gov.in/Pages/list-of-exempt-institution-form-10-ac.aspx The database is last updated upto November-22-2022. अब यदि ट्रस्ट बना लिया है तो फिर ट्रस्ट में ही काम कीजिए। अब फिर से दोबारा Section-8 कम्पनी बनाने का खर्च करने का कोई औचित्य नहीं है।

हां, यह बहुत संभव है कि आप अपने परिवार के 2 करीबी सदस्यों के साथ अपना ट्रस्ट बना सकते हैं। बाकि सभी जानकारी के लिए यह अधिक उपयुक्त होगा यदि आप किसी स्थानीय दस्तावेज़ लेखक से संपर्क कर सकते हैं; क्योंकि ट्रस्ट की स्थापना एक ऐसा मामला है जो स्थानीय Sub-Registrar कार्यालय से संबंधित है।

1-ट्रस्ट डीड का रजिस्ट्रेशन, सब रजिस्ट्रार के यंहा करवा लेने के बाद, ट्रस्ट के नाम से प्रॉपर्टी खरीद सकते हैं 2- ट्रस्ट डीड रजिस्टर्ड होने के बाद ट्रस्ट का रजिस्ट्रेशन अनिवार्य है या नहीं या ट्रस्ट डीड से ही काम चलाया जा सकता है। कृपया मार्गदर्शन करें

1. जी हाँ, ट्रस्ट डीड के रजिस्ट्रेशन हो जाने पर एक नये क़ानूनी रूप से अलग संस्था का जन्म हो जाता है और इसके नाम से कोई भी चल अथवा अचल संपत्ति ख़रीदी जा सकती है।

ट्रस्ट डीड के रजिस्ट्रेशन हो जाने का अर्थ ही यहीं है कि ट्रस्ट का निर्माण हो चुका है।अधिकांश राज्यों में ट्रस्ट रजिस्टर करवाने पर अलग से कोई भी Certificate of Registration जारी नहीं किया जाता। केवल महाराष्ट्र राज्य में ही एक अलग से Certificate of Registration दिया जाता है।

There is no legal bar as such for 7 family members or persons closely related having common surnames for form a Society. But you can not change the Perception of the Regulators/ or Public at large that the NGO is owned by Close Family Members and sometimes this may be taken negatively by the Donors, Authorities and Public at Large.

While Section-8 Company is created for Public Charity Purposes, it`s objectives are not to earn profits. From Companies Act, 2013 point of view, there are no hinderances/ fetters. But as a Govt Employee you should check with your Office; I am sure there might be some internal restrictions as per your terms & conditions of employment. In such case, you can easily make either of your core family members as members-cum-directors of your Section-8 Company.

All 3 Formats are absolutely Equal and perfect for working in the field of Education, Employment and Skill Development. दरअसल पूरा विडियो सुनने के बाद यह फ़ैसला आपको करना है कि आपके लिए इन तीनों में से सबसे बेहतर विकल्प क्या है। उदाहरण के लिए यदि आप केवल 1-2 लोग ही हैं या संस्था का सारा नियंत्रण एवं प्रबंधन अपने ही हाथों में रखना चाहते हैं तो ऐसे में Section-8 कम्पनी या ट्रस्ट आपके लिए बेहतर होगा।

इस बात से कोई फ़र्क़ नहीं पड़ता कि आप हज़ारों प्रकार की Charitable Activities में से आप कौन सी Activity करना चाहते हैं। आपका निर्णय इस बात पर निर्भर करता है कि (a) आप कितने लोग मिलकर इस काम को शुरू करना चाहते हैं? (b) आप किस प्रकार का नियंत्रण और प्रबंधन अपने NGO में सुनिश्चित करना चाहते हैं? इत्यादि-इत्यादि। मेरे विचार में Section-8 कम्पनी ही सबसे बेहतर विकल्प है।

ट्रस्ट के नाम पर Demat Account खुलवाने से पहले कई बार इस पर विचार करना होगा। आमतौर पर ट्रस्ट अपनी Investments Shares और Mutual Funds में नहीं कर सकते। हाँ यदि ट्रस्ट को किसी ने शेयर गिफ़्ट करने हैं तो Demat Account खोला जा सकता है।

फ़ाउंडेशन नाम का कुछ नहीं होता है। Foundation शब्द का प्रयोग सभी प्रकार के NGOs (Trust, Society या Section-8 Company) सभी के द्वारा अपने नाम में शामिल करके किया जाता है।

There should not be any Bar on becoming a ‘Member’ in a Section-8 Company, just like a Govt Employee can buy and hold Shares of any Listed Company. For becoming a Director in Section-8, you must check the Guidelines governing your service conditions & terms of employment.

In my view, if there are multiple Trustees in a Trust, then the Board of Trustees may for their internal control and management, or segregation of Roles & Responsibilities can designate themselves such as Chairman, Vice-Chairman, Secretary and Others.
