suing for assets you weren't given is bullshit. but there are plenty of reasons to go against your parents wishes. the same ratio of horrible people become parents. the worst parents are the ones who dont question their own actions because they think being a parent makes everything ok.

My mom established a trust fund. I was named as the will's executor. This turned out to be near genius. I had a brother who mom had documentation showing he borrowed money that he never paid back. As I sold furnishings, cars, and her house and sold back some stocks, every penny went into the trust every time I filed out any money, I doled it out evenly. My brother's amounts went right back into the trust until he had paid back the amount owed. I kept all documentation so there was never any disputes.

Guys always be careful with this kind of stuff... as a doctor who frequently sees people die or in their last moments, I'm telling you, you wouldn't believe the family fights that are caused by this kind of stuff... literally destroys families. It even happens with poor families, this is not sth that's important just for rich kids.

Grand Mother Put a Stipulation in her WILL with a Exclusion penalty. If ANYONE (Either the inheritant, or their Children) Contested the will, then the person they are Representing would LOOSE all rights to their portion of the Estate. IT was as Civil as possible.

The main draw towards trust funds isn’t to stop a law suit, it’s the stupidly high interest rates. At least in the UK, a trust fund is one of the highest earning forms of account you can get purely because they are inaccessible until they are of age and the account cannot be instantly withdrawn from. I think my fund is earning around 13% this year, which is honestly not a great year for it historically speaking but considering what’s going on with our economy makes sense. That and being next to untaxed is also pretty nice

my grandmother recently passed and had money in a trust...so the way it worked out was my grandparents had 4 children but the only one still living is my aunt who had no children. she got her share but i'm one of 7 grandkids and since i'm one of 3 and my other cousins are two bro-sis duos me and my sisters' split got to be less percentage-wise but the lawyer was shocked when we mutually decided to settle it after we got our initial checks to even it out (it was easier that way). so the other 4 cousins gave the difference to me and my 2 sisters to make it even among all us 7. lawyer said he'd never seen anyone do that with inheritances? lmao. but lord no it was not millions or even hundreds of thousands of dollars. still even a few thousand extra bucks is a blessing these days

unfortunately not even a trust is foolproof sometimes. my grandma set up a trust to split her assets evenly amongst her 4 kids when she died, but now 1 of them is claiming she told him/promised him more money for directly taking care of her towards the end of her life. my family was going to throw an extra 250k his way and instead, he came back expecting 1.1 mil and full ownership of my grandma's 1.8 mil house. he had control of her funds when she died and keeps fighting everyone every step of the way to a resolution. so far they've blown ~150k on legal fees. at this rate, all my grandma worked for will end up in lawyers pockets.

You, uh, skipped over the negative side to a trust: you better be 100% sure the person you designate as trustee is 100% trust worthy and will execute your wishes. Because there's no probate, and like they say in this video, there's no lawsuits. The trustee determines EVERYTHING. So you better be real sure about the trustee you pick.

Question. Grandmother with severe dementia passed away shortly after my dad did. Oldest son took over all items and executed the will. Sold the house for the use of her care in a great care home. She then passed shortly after. the rest was put in a trust. Said he had to split it a certain way by law, but I think he could have split it anyway he decided as he had power of attorney. The house that was sold was suppose to go to my dad, but he passed before her unexpectedly.

I think you'd have to get the courts involved. I believe the person overseeing a trust fund is usually specified by the individual who set up the trust fund (the person who died, not their lawyer). You'll have to be able to show what the trustee is doing that is inappropriate with your money, or prove that money you've been denied you are actually entitled to under the terms of the trust - not just you said you need money and they said no. So if the trust is limited to say, tuition and an allowance of $2,500 a month for living expenses, and you asked for an extra $1,000 for books, you don't have grounds for a complaint. But if you handed a copy of your tuition bill that is due in 3 weeks and you are meeting any conditions (like some trusts will not pay for a failed class, etc) but the guy says he's not paying the bill because he doesn't think you should be taking X class as an elective, then you have grounds to request a new trustee be appointed.

Careful a will is NEVER guaranteed. Anyone can come in and challenge it and it is based on the judges discretion how it should be distributed accordingly if there are any disputes. Another thing it will also cost you money to go through probate for that will

My mom put a sibling I dont trust (he talked her into buying real estate for a homestead and rentals that's making little to no money, history of rarely paying her back) in charge of the will when she dies who will be giving me my share over time. I worry he'll use this to try to control me like mom has (I'm LGBTQ+ liberal he's like our parents very patriarchal conservative and controlling), maybe even try to use the money as an investment in his money making schemes against my choice. Any advice? I'm pretty much planning for my future w/o the inheritance at this point.
