Anne: There are two basic types of probate in Florida for Florida residents who die, and that is summary administration or formal administration. Formal administration is the one that most are, and that is a formal process that starts with letters of administration. It includes a creditor period, it includes an inventory being filed with the court, and then a winding up of the affairs and an accounting filed with the court. A summary administration is available only where the assets are less than $75,000 and the person who is doing that process, the petitioner, is willing to take it on themselves, the responsibility for debts and beneficiaries.
