The Tachikoma hardware and software technically can be recreated OUTSIDE the military, even if the military no longer had any Tachikoma information (they still got it in the first SAC's ending, they totally lost it and the satellite in 2nd Gig's ending). Think Terminator 3's SkyNet style Tachikoma… Yeah, it is THAT scary! Ala Philip K. Dick's Valis. Recreating Tachikoma's personality, capturing their 'Ghost/Spirit/Rei/霊': * The Major, aka Motoko Kusanagi is an avid observer of Tachikoma, much more than Batou (aka 'The Father who Spoiled Them'). She was the one who detected that the Tachikoma had been acting more than just mere machines. She even observed on how the Tachikoma first sacrificed themselves, she is their 'Mother Maria'. So she had enough data on how the Tachikoma behaved. Think the ending of Hand Maid May or even Chobits. Recreating Section 9's configuration and setting files for the Tachikoma: * They could attempt to recreate all the previous actions (improbable, Section 9're too busy on something else). Or pulled one of the Tachikoma back-up data unofficially backed-up outside the Satellite, like what the Tachikoma did before they committed their Satellite Suicide Bombing mission. If those things fail, they could always call SEGA and ask SEGA to send in more Tachikoma. What? You don't know SEGA are unoffically involved in Ghost in the Shell? From the original comics (GitS're treated as comics, not mangas) to ARISE to live-action to … Ghost in the Shell → Ghost … Shell → GS → SG → SEGA. Other than the whole pun on the 'Ghost in the Machine' saying, they were originally planned for "Host in the Shell" as the title, to imply the whole multiple layers thing (a host who hosted something but the host is in a shell).
