If you have a drone over 249g and live in the UK you will find you are quite restricted and you may think you need to take further qualifications such as the A2 CofC to allow you greater freedom, Sadlyat the end of 2022 that will be useless! This really is the life saver for me as a beginner buying the dji avatar yesterday.and because of the brilliant snow delivery got delayed....Before I buy I never realized that the restrictions are so tight that somehow I couldn't even fly it in my garden when it arrived. This article 16 is really a Savior for fpv drivers... I really want to fly... To feel the freedom not the invisible cage.. thank you so much.

Hi Gavin great videos and straight to the point. I had done my A2 CofC i little while ago because the Drone i love flying is my trusty Mavic 2pro which is over the 250g. I then herd about article 16 and FPV UK when I joined the Gray Arrow club. I then came across your RU-vid video that explains exactly what you can do which is great and thanks. The one thing that I'm now struggling with is with all the crazy By-laws TOAL. I wanted to get some nice footage of Beachy Head and the Lighthouse but they seem to have restrictions and I would have to take off a long way just to get some shots. I have also noticed that a lot of recreational places don't like you flying drones even though some of them don't have any By-laws and some just randomly put signs up just to fog people off. I find it very frustrating as I like to get a bit more practice.

Thanks Gavin brilliant video and very informative I love flying my Air 2 it’s a fantastic drone. But thing’s are getting a lot harder and more complicated these days for us recreational drone flyers I just use my common sense and stay well clear of people and built up areas.

Thank you kindly ! Yeah same here but for £20 a year you get the liability insurance which is probably worth it alone! I just want to make sure people don't abandon the bigger drones and be scared to fly them when they are extremely relevant

​@@bownsaway The rules have got much more permissive. Previously you had to keep 150m from a congested area and 50m from a person not under your control. Now association members can fly right up to the edge of a built up area (no 150m separation criteria), or in it if the area is used solely to recreational purposes (eg a park), and 'not within' 30m of an uninvolved person (which means you can technically overfly them so long as you're 30m above - should be avoided if possible of course).

Very interesting, thank you, as I have a Mavic Air 2 and a Phantom 4 Pro, and due to the pandemic, have been pretty much grounded. Then when I recently went to check out the latest laws/ regulations, I was mortified to discover that the goalposts had changed again, and made the kind of aerial photography I like to do almost impossible due to the stricter weight categories, and "legacy drone" clauses. So I will certainly look into this as I was considering the A2 CofC (begrudgingly!)

How did the stupid scamdemic ground you? It never stopped me doing anything I still went out cycling. No nobhead politicians are going to dictate where I can and can’t go. When your drone is 300 feet up in the air how is anybody going to know what weight it is? I would say the chances of getting caught are slim to none, the police have more important things to do.

A particular youtube guy from Blackpool who has just got a mavic 3 needs to view your video. He claims he has passed the A2 cofc but then clearly dosnt care about the air law or the uninvolved people he flys over all the time.

I am told a RU-vidr matching your description has been telling people to buy the M3 and that the C labelling will be "sorted" - it really won't but of course article 16 is the only way to fly it properly and even then it shouldn't be within 30m of a built up area - and of course article 16 does not allow commercial operations so a lot of people. People have a duty I feel to give the correct information in their position.

But he just ignores any negative comments.(in his opinion) The issue being that poor flouting of the rules gives the wrong info to new flyers and could make the CAA bring in more rules. I believe his next video will be flying at night over a town. It's a pity the CAA dont step in and make an example of him. Maybe they will. Your videos give clear information and how to follow the rules. We salute you and your channel 👏👏

I joined FPVUK based on one of your earlier videos and don't regret it. Of course I only did it in case I decided to buy myself the Air 2/Air 2S. Still thinking about buying one. Oh and don't forget FPVUK have an option for them to renew your Flyer/Operator ID in case you forget. Something that I took up because I knew that I would forget and of course the included insurance. Personally I think it's an amazing deal, well worth it.

Wish I had seen this before I had just completed the C of C with UVHUB, though the information they provide is first class and supplies risk assessment info. I joined FPVUK, last year, as I needed some insurance for a greydrones meet up ! Seems £20 well spent now, especially as the C of C does not seem valid at the end of the year with restrictions back to 150m! Great information as usual, clear and concise. Keep them coming....

I do like the idea of carrying the card and risk assessment, as it will help with any Joe Public confrontations. The PLI cover is worth the membership cost alone. Another informative video Gavin and no mention of that bloody crap Mini 3 video either !!

Of course not. People get excited I understand but some channels have been talking about this for months - even if DJI launch one this year it's going to be before Christmas or at least November ( year on from the mini 2 ) don't see any point in talking about the mini 3 yet. I'll leave others to claim they have inside knowledge whist showing a fake video 🤣

@@GAVINHR temp is 28 c ,i flew it for like 15 minutes or so it was great but i get so bloody scarred when i fly it every time , i wish i get over that ,the Mini 2 is and always been reliable but still maybe in time, i baby it to much i think LOL but ya that phone cover is just awesome Gavin i cant recommend it enough for like 12 bucks your getting great quality and they now have a newer version with buckle snap i noticed for about the same price ,as for dimming screen on my phone never had that problem really

Strangely, tempting though you made the new Article 16 agreement, this has convinced me to get the Mini 4 Pro as soon as I can free up the cash. Otherwise, a great reference video!

Another great video, I've joined FPV UK. Also had to do the IAA operator and flyer ID so I'm registered and part of EASA so I can fly in Europe now as the CAA isn't recognised anymore , maybe worth doing a video about flying in Europe 👍

@@GAVINHR 👍 I also watch Ian of london's RU-vid channel and I've not seen his video regarding flying in Europe so I'll take a look, the problem on various forums like Grey arrows is conflicting information, some say once registered in any EU country that's part of EASA then you can fly on all of the EU but other state that you still need to register in each Individual country you intend to fly in. The Luxembourg EASA A1/A3 is very good.i actually found it harder than the UK A2 course and its free to do and sit the end of course questionairre.

You should do a risk assessment anyway, it proves you have done what you can to minimise any risk if the unfortunate actually happens.

Hi Gavin, Thank you for the awesome information in your videos. What I wanted to ask was - Would I be able to film actors who are involved in my movie, from any distance in an open park area? Or does the distance rule apply? I am thinking of getting a DJI Air 2S or using an existing DJI Phantom 4 These new laws are so confusing - I wish they had made these simpler by just putting up a size table for the drones and what each size range can and can't do legaly.

If they are actors who are aware you are filming them then you are fine, they count as "involved persons". It's people who are out and about that you have no contact with. Technically as long as you ask other people if they mind you flying, you could argue that you have involved them too.

The amount of people that don't like article 16 half think it racing only and half are jealous because of the distances and do nothing but bad mouth article 16. I've even been told article 16 is being being scrapped. Thanks for the video wicked to hear I'm on the right track with article 16.

You are most certainly on the right track with it. I think a lot of people who bad mouth it are the ones that believe they are extra qualified because they paid for the A2 CofC qualifications only to discover A16 allows more freedoms with the over flight. I understand people associate FPVUK with drone racing however it's just a association like the rest allowing more freedoms. It's certainly the way to go if you are a hobby flyer

Quality video Gavin, could you explain flying in a recreational area in a built up area please, under article 16 could I take off from a beach promenade in a built up area as long as I keep 15M from uninvolved people for take off and landing ?

Just a question, I wasn’t aware that FPVUK a flying club but more of an insurance broker, I have just recently renewed my insurance for another year, am I automatically part of this club and share the benefits you mentioned regarding Article 16? Well said. So many people think if they get the A2 Cof A they can then fly over people and buildings. Didn't they learn anything from the course they just did and paid for. Apart from get down to 50 mtrs closer to buildings That's about it. Complete waste of money and time. And in 2 years time they can bin it. Either fly out in open fields with your bigger drones or get the mini and have much greater freedom

100% unless you are a commercial pilot the A2 CofC makes little sense. Article 16 makes more sense or as you say - get a mini 2

I disagree its a waste of time having sat it. That said i did the EASA A1/3 and found that just as if not more useful. Being free up to the point of the exam its actually a half decent course for educating noobies.

Hey dude I'm a member with bmfa and I fly article 16 and have the A2 CofC. So I've been flying the 30 metres too. I think it's £40 or £50 per year so when mine runs out I think I'll join fpv UK 👍🏻

Good video with the actual info needed to help inform a drone purchase and avoid unwanted affection from Plod et al. Most folks will want the flexibility to be in public areas like parks etc and not 150m away from other people, or buildings etc, since these make good and interesting features in shots. But this is the end result of bawbags flying drones round Heathrow and Gatwick and shutting them down for hours at a time and means everyone has to do risk assessments and have restrictions put on what you can and can't do. Think this means I'll not bother with a larger drone, too much ball ache. Mini 3 Pro will be the way to go I guess.

There is a field behind my house and a main road with coucil houses around. Without the A2 and only having A1 and A3, flying a air s2 in sport mode at an altitude of 100m-200m in the air at night, is a big no then? Despite keeping 50 metres away from my surroundings? Also don't you have to adjust your flight altitude, ie if i went up 100m, everything else should be away from me by 100m?

The video is currently incorrect re: automated flight modes. The FPVUK article 16 OA only covers hands on sticks flying. Quote from the current (Feb 2023) FPVUK article 16 authorisation: "The use of any automation, such as automatic flight modes which alter the position of the aircraft, places the operation outside the definition of a model aircraft, and therefore outside the scope of Article 16. The aircraft must be flown with direct control inputs from the remote pilot."

Hi, im confused. I am thinking of getting a dji mini 3 Pro, and the larger battery, but its said they are not selling the battery in Europe and the UK, because of taking it over 250g, and c label which I dont u understand. Fact it, if I got the mini 3 Pro and managed to get the larger battery, now just over 250h, what do I need to be able to fly it in a built up area. Im in the bmfa, hot my A certificate in fixed wing, and would come under article 16, as im in the bmfa

The bigger debate is what constitutes ‘commercial’ vs recreational. Caravanning in Yorkshire took some shots of the site, gave them to the owner free of charge for his own use. It was recreational for me, but as i gave the footage away it became commercial even though no monetary reward existed.

Did you watch that section of the video? I covered this exact subject. Unless the primary flight is commercial the CAA do not class it as a commercial flight. If you sell footage after the event you are perfectly fine to do so.

Yeah I'll happily speak to the guys at coverdrone if needed as I have a working relationship with them anyway. However 100% unless the job is paid or at least a monetary value agreed then it is not a commercial flight. I've confirmed this previously with the CAA. The intended purpose of the flight has to be commercial. If not and you happen to sell a print / photo / video after the event this is still a hobby flight.

TBH Gavin for £5 i just pay the commercial insurance. Even though i have £25m through BMFA. I have read the new Art 16 on FPVUK website i cannot see anywhere it says automated flight modes are allowed or at least mentioned. It doesnt affect me but would be good to know.

Hi Gavin, I am a total newbie to this great pastime. As an keen amateur photographer I recently bought an fantastic little DJI Mini 3 Pro and love the extras it gives me. I stumbled on this vid only this eve and had no idea about FPV UK and I have paid and joined. I have already registered my drone with CAA but the FPV website is continuously telling me I reminding me to take the the test and get a CAA flyer ID. Is this the same as a CAA Operators ID? So much info, its confusing. Can you advise please

I'm still confused. I fly my DIY drone's weighing 500g - 2kg in the A3 category meaning 150m from everything. Will the A2 or A16 cover me for flying closer to people with my DIY drone's? I tend to get a few dog walkers just wander in to the field i'm flying and walk directly under my drone which i'm in the process of bringing back down to land until they're gone. I'd love to fly my drone's closer to home or at the beech but still unsure what i exactly need? Failing that it's bite the bullet and buy DJI rather than build my own. :(

The automated flight modes exemption no longer appears to be part of the article 16 authorisation for fpvuk. Its back to hands on sticks if it ever changed and wasn't just a mistake in the video. Quote from current authorisation in Feb 2023: "The use of any automation, such as automatic flight modes which alter the position of the aircraft, places the operation outside the definition of a model aircraft, and therefore outside the scope of Article 16. The aircraft must be flown with direct control inputs from the remote pilot."

Still a bit confused!? I have a drone that's 320g (parrot anafi). If I join the fpv do I get the same flying rights as one that's under 250g? What are the differences. Sorry I'm a newbie 🤣

UI have already obtained my CAA Operator & Flyer ID qualifications and currently operate a DJI Mini 2. I also have £2million public liability insurance. I am a pro photographer and have clients who are asking if I am able to conduct roof surveys of residential and commercial buildings located within built up areas. I was already considering booking an A2Cof C course but need to know what other qualifications and courses I need to complete in order too be legally compliant in order to do this. What would I need to do in order to be able to carry out this kind of work? many thanks.

Hi, yes it does. Providing that area is primarily used for recreation you are fine. For A16 authorisation all you need to do is become a member! It flying in a built up area you need to do a quick risk assessment as per the template in the video description, pass the DMARES test and away you go!

How will the authority know that I have the article 16? With article 16, where else will I be able to fly the DJI Air 2s. I was thinking of taking it to places with hills and mountains. Etc. As explained in the video you can buy a card which shows you are member, I would suggest you watch my first video on article 16 it explains everything in full detail :) if you are 150m away from people in hills or mountains you can fly there anyway!

So, i live in a picturesque village with stunning views. I recently flew my 249g drone to get some birds-eye photos of the medieval village. I did not fly any less than 50m and mostly at 120metres. Should i have completed a risk-assessment?

Thanks cos i was going to pay £90 to do the A2 Cof C course and then sit the online exam so joined FPV, passed their competency test and good to go. I currently have a DJI Mini2 - can i use the operator ID on my new DJI Air 2s when i get it ? Thanks again.

Be a little careful with the new relaxations. The automated functions are only allowed where the drone doesn't move as part of the mode. So panoramic photos, yes, Active track, no. Waypoint, no. Interestingly, FPVUK themselves seems to have misunderstood some of the modes since they cite dronies as allowable. Because these involve the drone moving up and back then they would not be allowed under my (and others) understanding of the revised Article 16.

100% correct - I have removed that section of my video after speaking with Simon from FPV UK. Initially it suggested the modes were accepted but now it's clear the drone cannot move.

I’m going to start doing roof inspections on new build homes on estates. I’d like to fly the air 2/2s. I have an operator amd flyer id. Can I fly the air 2/2s over the building of a client with their permission? I’m not sure exactly what I need and want to stay on the right side of the law

Having read the new Article16 from the FPVUK website, it seems that NONE of the autonomous modes quickshots, mastershots and focustrack on my Air 2S are allowed. I may use those autonomous modes that DO NOT move the drone but merely rotate it in place. That is a huge restriction. Your video seemed to suggest that they were all allowed. Have I got it wrong?

This includes: - Any ‘model aircraft’ - Any ‘control line model aircraft’ - Any ‘round-the-pole model aircraft’ Page 10 of the FPVUK hand book also nails this down: `The CAA defines a Model Aircraft as follows: "Any unmanned aircraft being flown purely for the recreational sport of model aircraft flying. This includes shop bought or home built aircraft, which are flown ‘manually’ using traditional control inputs rather than with any automation other than for flight stabilisation purposes. This includes multi rotor aircraft which are being flown with ‘direct’ control inputs, and without any automation, other than for flight stabilisation purposes.’" ... Nb. Using automation modes such as RTH is permitted in an emergency situation - eg in the event of a radio link failure. Also, automated modes which don’t move the aircraft in physical space, such as position-hold making the aircraft stay in position against the wind or Panorama mode which yaws the aircraft to take a series of photos whilst staying in a fixed location are permitted. Modes such as Tripod mode (which makes the aircraft fly more slowly), beginner mode, cinematic mode, etc are also permitted.` Can you help me understand this apparent contradiction please?

​@@GAVINHR Hi Gavin - I was going to join FPVUK but this video gave me the nudge to actually do it. However, I was surprised to see autonomous modes such as Follow Me which you showed in the video as being allowed under Article16 OA. The FPVUK website is absolutely clear they are not allowed. I managed to have a bit of an email to and fro with Simon Dale at FPVUK and he confirmed my fears. I had hoped I had misunderstood it and your video was now showing what was now possible. Alas Follow Me as well as (most of) the other autonomous modes available with my Air 2S are disallowed under the Article 16 OA :-(. Simon has said you will remove that particular bit at around 11 minutes 25 seconds which was the only poor bit in an otherwise excellent and informative video.

Hi Andrew, yes indeed that section has now been removed. I spoke with Simon further and we clarified the situation whereas some autonomous modes are allowed the drone most not travel. That was perhaps my fault at my misunderstanding of the literature first given to me however as mentioned I have removed it. Either way it still reduces the distances over and above A2 CofC which is well worth it in my personal opinion

Superb information and delivered professionally Gavin, i do have one question or even two maybe. In 18 months the A2 CofC is no longer in force and the Air 2 (Drones over 250 grams) returns to class 3, but does this mean that article 16 and the excellent negotiations that FPV have got for its members also comes to a end? And if i may ask does this ending of the A2 CofC affect the 250 gram or less category in any way? (Just joined the FVP excellent value for the insurance and card id alone, didn't even realize it existed until this video) Regards, Sergent Slow.

Article 16 has no end date. It will continue indefinitely. (The CAA will review it annually, and issue a new Operational Authorisaiton hopefully with whatever enhancements we have negotiated that year - and they'll audit FPV UK too, but the provision itself has no time limits). I have only taken a serious interest in the drone scene since purchasing the DJI Mini 2 about 6 months ago and also getting a new found interest in photography/video and editing. Without the time and effort put in by Gavin and several other RU-vidrs i wouldn't have learnt a tenth of what i know now, both with regarding the drone itself and the photography side, so its probably not your marketing, just me been a newbie. That said i do believe in having professional body representing us as hobbyists, along with all the benefits that your organization brings to us through membership. Many thanks. Richard.

No! This is useful for those wanting to fly drones OVER 249g, under that you will see zero benefits from either this or the A2 CofC however FPVUK do give you public liability insurance if you join but for the smaller drones you wil see no benefit rules wise. Hope this helps

I know you don't need it. This entire video is about drones over 249g. You're the one talking utter rubbish. If you want to operate a larger drone over 249g in areas which an A2 CofC let's you fly and want to do commercial work then you need the A2 CofC. If you don't want to do commercial work then article 16 is suitable for most people. Seems you just made yourself look very stupid by even saying you have a mini 2 and if you was paying attention this video isnt about drones that small. Tell me where in the video I say you need one for a mini 2. Take as long as you like
