I kept the headphones, after all it is very cheap so i am not complaining too much. But i'd rather get a different one than spend my money on getting the same headphones again, i won't risk it. There are headphones that are a bit more pricey than this one but worth it (can't even use these headphones for more than two hours)

yes kakadating lang niya, nagwo-work naman siya pero kapag naka charge lang pero kapag tinanggal mo na sa charge doon na siya hindi nagana, ni-try ko na rin ulit ulitin buksan pero it doesn’t work talaga
I guess better talk to the seller and tell them the issue then return mo na lang kasi sayang bayad mo sa item. Then try buying it again siguro from a different store or ask them to replace it
