I have recently completed my ADT treatment for prostate cancer and temporarily rated at 100% for 6 months. Should I wait for the VA to contact me or give me notice of reduction? Since they will rate me on my residuals, I am currently changing absorbent materials at least 2x-3x times daily (40%), but also I'm waking up 4x to 5x times during the night to urinate (40%). Is it one claim or the other, or can I be rated for both voiding dysfunction and urinary frequency? Does this mean my temporary 100% goes down to either 80% or 40%?? please advise
This response is not intended to be legal advice. I am not a lawyer or claims agent. Per my personal knowledge and direct experience, VA will conduct a new C&P exam at the 6-month point. This is automatic, so there is nothing you need to do to trigger the exam. Only the predominant area of dysfunction can be rated, so you can’t get rated for both changing pads and frequent urination: it’ll be the highest rating between the two. I have in my VA medical record the RO Manila ordered re diagnosis exams outside private on my TOP 3 disabilities that got me 100% TDIU unemployable bedridden aid attendent and completely don't understand why and the primary care don't know anything about
VA always has a reason for ordering exams, so without knowing your exact situation it’s hard to know what’s what. Also, the VA claims people (VBA) do not interface with treatment providers, so your primary would not know about any claim related issues.
I received a 10-% for Tinnitus and 10% for bilateral Hearing Loss. On may second appeal for some other areas they have dropped the 10% for Tinnitus. How can they do this?
As noted in the video, VA has to have a reason such as reevaluations of non-static conditions; however, out of the blue reevaluations, typically, do not happen. Also as noted in the video, reductions are difficult for the VA to successfully apply in most cases. As noted in the video, only ratings held for 20 years are completely protected; also noted in the video, VA must have a reason to reevaluate a rating. VA only reevaluates a static condition per a veteran’s request or as the evidence dictates. For example, a veteran submits a new claim for a back condition and files a statement noting the back symptoms. On the statement the veteran also notes his service-connected shoulder issues have worsened. This would require VA to also evaluate the shoulder even though the veteran did not want the shoulder evaluated. So, does the VA target P&T rating? As a matter of routine, I’d say no; however, as noted in my book, VA is capable of anything including ignoring laws and regulations.

All of my issues service connected at retirement, were noted as static. I suspect that most of your issues will be static as well. After you are rated, definitely send for your code sheet to know which issues are static.
