The hitboxes did seem wrong when he called them out, but it might be more likely it was just very minor server lag, like the piranha plant was actually a tiny bit higher than it looked

Nintendo could genuinely port this to the switch and make a shitload of money. But knowing Nintendo they dont give a shit about the fan games all they care when it comes to fan games is cease and desist orders.

Maybe If this developer made something interesting with the idea, built on it, proved he is a trusted developer that can make something of his own instead of with stolen assets, and then pitched this to Nintendo, he might have a chance.

While I know that the assets in this game technically belong to and are jealously guarded by Nintendo, I cant help but feel recently that in addition to having an archaic business model, some of the Nintendo developers (sans Eonuma and Sakurai) have begun to lose their touch talentwise with their creations. It is always a sure sign of a companys long term decline when talent begins to wane, which is perhaps one of the reasons why they focus so much on protecting what theyve got left. Which is why I too believe that perhaps it may be wiser to hire the people doing amazing things with their stuff rather than banishing them outright with lawyers and copyright law. I mean, what do you think will happen when, and not if, they eventually die off or go make hanafuta cards again anyways? People are going to take those assets, and do what they please with them anyways, and it will have been such a shame that these creative projects they COULD have taken advantage of were wasted with protective effort when you could have had the chance to make something happen with them. Take Necrodancer for an example. FamilyJules did such a great job with his remixes of that game that he was hired on to do Cadence of Hyrules soundtracks, to enormous benefit. But I dont really give Nintendo that credit, they only lent their IP out while the creator of Necrodancer called the shots. Perhaps the folks up in Japan might want to learn a few new tricks from them.
