The judge said in his order that it was ineffective, but it is unfortunately the maximum fine allowable under New York State Law. And immediate jail time is allowable but not necessarily a good thing. Judge Merchan does not want to leave any avenues for appeal open, and he wants to establish a clear pattern of giving Trump sufficient warning first before jailing him.

Yeah. That's the maximum in New York courts. It's fair in cases where some poorer person makes an outburst in court--gets the fine and then shut-ups after that--what normal people would do. Usually judges just have to warn them and they stop.

Maybe the judge should sentence him to one hour jail time per violation of the gag order. Sentence to be carried out consecutively. He goes to jail, sits there for one hour, gets out, and immediately goes back in sit for another hour, and so on until all 9 hours of jail time are completed.
