WHO AM I:
My name is Charlie and I am disabled. I live with chronic illness, I have a severe form of Psoriatic Arthritis and its crap! I am in pain all the time and always battling fatigue. BUT, I will not let it win. I love to learn and to laugh (even though it hurts my arthritic rib cage LOL). You will often see Ollie (she) my black Labrador. She is currently my trainee assistance dog! We are together, literally ALL the time.

I don't understand why disabled organisations are not taking the government to court for disability discrimination. These organisations have the money to do it. Disabled people are being forced to live on next to nothing and being treated like crap by DWP, this is discrimination

We cant, they changed the laws so yes we can complain about laws brought in and make them back off in some respects but the only way this ends is when the election happens

Some of them are trying to challenge things but the real problem is a lack of public support. They won’t get far without that. Public opinion is incredibly powerful but unfortunately most people seem to want to believe negative things about disability. Things will only change if we have a civil rights movement and I can see that coming in the future.

@@elleskye3521 Reality is we wont see any change unless there is an election. Tories are addicted to beating down on the sick and disabled and wont stop now. The report that stated how the long term sick and disabled will be doing the low pay migrants jobs shows how bare faced these Tories are about the respect they have fir the sick and disabled

They've played dirty with me for 20+ years. With very little support. Full medical history from specialists totally ignored. The kangaroo tribunal has been no different. I can't say any more here as yt will remove my comment, as they do every time?

This is not the first time they have done this. They did this to me during the first lockdown. 2 weeks before the tribunal date I got a call that someone had re-read my case and I was getting my award again. The stress was horrendous.

I Was on higher rate mobility and had the privilege of being able to get a car through motability... That was until the 2 years was up and despite my condition worsening and medications doubling I was seen as no longer eligible. Appealed it, gave more evidence and had a lengthy phone call only to still be told no and I too am certain they never looked at anything or took any of the newer information into consideration. As a result I've lost the higher rate, lost the car my household relied on and I have left the house maybe a dozen times since March as walking causes just too much physical pain. My next step is to try and go the change of circumstances route and see what I need to do after that... Wish me luck 🤞🤞

I hate to say this, but you done the wrong thing in the first place. You should have saved money and then brought a car, and paid for it yourself. I could have got a car on mobility, I could have got a mobility scooter. However, I saved up and got a mobility scooter. No matter what happens, that mobility scooter is mine and no one can take it from me. I have seen a lot of cases like yours, where they do remove mobility and people have lost their transport. However, good luck fighting them.

The DWP relish in destroying lives, I have 2 relatives reliant on PIP and ESA and the system has systematically destroyed them over the years with back-to-back ESA and PIP assessments, every single time has been a mandatory reconsideration and two occasions have been tribunals, they have won each time but every time the cycle starts it damages them even more, I'm so done with it and I'm not the claimant.

It terrifies me when I imagine how so many more people are going to be living in such poverty in this country. How are we going to cope? How are we going to pay our bills? When you are so poorly, then the possibility of getting a job and being able to do a job is impossible. Please everybody, don't vote for this government. it's our only chance to survive in the future.

​@SuperMarion61 I think the point the person is making is that there are many who rely on PIP as their only or main income. That's not what it's designed to be and it never was meant to be, but for some people it is.

The whole process is not fact based normal people call it lying. My so called Nurse lied to her back teeth and my claim was denied despite having received it for 5 years. Thankfully I reclaimed as I'm in Scotland which no longer goes to Belfast but to Dundee and I was given my PIPS back.

Thanks for this update Charlie. You're an absolute star doing this. The cloud of doom is never far away, is it? The familiar feelings of despondency, stress, anxiety & nausea rushed through me as I watched. Living like this is akin to the old cartoons, where there's a one tonne weight, suspended overhead by a fraying rope, ready to drop on you at any second. But oh no, you cant get out of the way, because your body won't let you.

Can confirm. I filed mandatory reconsideration in January (I had no new assessment!), with new evidence, I clearly stated my symptoms, even a letter from a cardiologist who confirms my symptoms, did tests, has prescribed medication and has diagnosed me but dwp won't increase my points (standard daily living, no mobility). So I've filed for tribunal and after I got all the paperwork from dwp that they hold about me, there's no sign of any of this (symptoms, diagnosis, medication) in anything they've written. Funnily enough, they've used word for word statements from that cardiology letter that supports their narrative that I'm not sick (seriouslyword for word!), yet they haven't taken my diagnosis, prescribed heart medication and symptoms from that very same letter! The fact of the matter is we're not be treated fairly. When I was awarded PIP in 2020 I was awarded standard daily living only based on fibro and chronic fatigue. Now I have postural tachycardia, use crutches and a wheelchair outsidemy home, I have trips and falls and blackout every single day but my points have not changed and no mobility. Its insane Charlie! I asked citizens advice what evidence I can provide if a cardiologist diagnosis and letter isn't enough and she could not believe they didn't take it! She said "that's it, that IS your evidence!" So off we go to tribunal. I'm terrified but I know I deserve it, my life has been flipped upside down since getting these new symptoms.

Go to your local civic centre and ask to see a PIP welfare advocate person before the tribunal explain truthfully your probs do what they tell you to do

​​@@jobby750what is a civic center? And what does a pip welfare advocate do? I rarely leave my house due to being in a wheelchair, I've been out 6 times in the last 6 months as I rely on my husband taking me as I cannot use the wheelchair independently. My local civic center is 40 miles away, I can't travel that far unfortunately.

@@alexandrasmith7682 the diagnosis is proof I have the symptoms to begin with as the dwp are denying I have symptoms at all. If I've been diagnosed by a medical professional in that particular field, it validates all my symptoms. You've no idea the gaslighting that happened to me by medical professionals before I got the diagnosis, so of course the dwp with deny all of it if it gives them an opportunity to refuse people to meet their targets. Also in the dwps own documentation they sent me as part of the tribunal, under the section detailing my histiry of illnesses, this new illness is missing so they are denying it even exists for me.

@@alexandrasmith7682 diagnosis is proof that symptoms exist. For example you can have leg pain without a broken leg but if your leg is shown to be broken (diagnosed) then that proves your pain. Also, on the information the dwp hold about me, under the section detailing my illnesses and conditions, this diagnosed condition is missing so they're denying it exists for me.

DWp did a similar thing in 2011/2012 I failed my assesment before I entered the room. As all the people hired by the DWP to carry out the assessments were set a target fail rate. I spent a year and a half going to tribunal which lasted less than 8 mins in my favour. This sounds familiar

I've been trying for 4 years to get PIP, I rarely leave my house, I'm autistic and have recently had a speech and language assessment, I struggle with forms and the ability to get to appointments, get treatments etc, yet the 3 times I've been declined PIP I've been scored zeros on everything! I struggle to get to my GP so have many undiagnosed conditions and both mental and physical disabilities, no-one will come to my home to help me so I'm stuck! It took 3 years to get a mandatory reassessment for UC as I was on the wrong grading for 3 years that's been sorted out but I struggle to advocate and with the anxiety I have and other medical issues the stress involved is too much for me.

I hope you find someone to represent you in the future and now. It sounds like you have a very difficult time of it all. Communicating this across to the assessors must be an absolute nightmare which no doubt has a detrimental effect on your health. I wish you all the support in the world that you deserve xx

​@@sarahgibbons9737​@sarahgibbons9737 My ex made a false allegations of harassment against me, the police organised a nurse assessment and from there I got a temporary support worker, it was a Speech and Language Assessment via the criminal system, although thankfully they determined no harassment and no further action needed before I had the assessment. So ironically my ex actually did me a favour by making the false allegations for a change!

This very thing happened to me last March, I have a condition which is progressive & permanent. I had never had a problem since I've claimed PiP till last year. I had to go to the tribunal stage but a DWP assessor intervened before the tribunal & corrected the situation. It took 3 months to sort out & it was a terrible experience & made me ill. All I can say is fighting, it's all you can do ❤️ brilliant video thank you.

When I had my assessment last year they read the medical evidence but the assessor actually put down the opposite of every thing the doctor had written, every question she asked me she wrote down the opposite of what I said, this all came out in the tribunal. There was even another couple waiting to go in as well and after overhearing their conversation I asked what they were there for and they told me the assessor they saw had lied as well which turned out to be the same woman. I bet she still works there to this day

It’s my understanding that most claims don’t change anyway at MR stage. My husband had no change in December at MR stage and the MR was very good, we appealed and few weeks later had call from DWP decision maker, who was very nice and she awarded enhanced for both ongoing…..she was very knowledgeable in her questions and had definitely read and knew everything about his case. So yes MR often fail people and let’s be honest they hope people just give up at every stage….

I thought Charlie & others would know, barely anyone gets a changed decision at MR stage. That was the reason it was brought in, to stop people going immediately to Appeal. Doesn’t anyone read up on or listen to these things? It’s kind of important 😂

I had a car accident that left me with a damaged spine, severe pain, I was on injections for pain, and suffering from severe migraines daily, including headaches daily, severe pain in my spine daily, and years ago I made an application for DLA, this was before PIP came out, I had to go to a tribunal even though I had medical evidence, but I was in too much pain to go to a tribunal so I did not get any DLA, this was before PIP came out, and even though I was really suffering with severe pain I never did bother again as it was too stressful, as far as I can see the system hasn't really changed since DLA, and the changes over to PIP, we have to fight and some people do not have in them to fight, or are too ill to fight, or don't have the help they need. This is the same for many many people with life-changing illnesses and disabilities who were entitled to DLA, and entitled to PIP, but the system is designed so that the DWP make it hard as possible for sick and disabled to get any extra help on PIP.

You have very similar condition/circumstances to me but when I applied I got full pip for years and I couldn’t believe how nice and supportive they were. Now they have revoked it for completely bogus reasons and they have even been discriminating on several occasions, and I have to fight at tribunal despite all the evidence I have sent

My MS is worsening after 20 years. I now need walking aids, adaptation of my home and cognitive and physical therapy. PIP decided to cut my monthly amount by a third in September 2021. They've now received a demand to reapply. The form didn't arrive and I called PIP to tell them so. By the time I get the form, I'll still be waiting for a reply from my GP and MS clinic to tell them what needs to be reported to PIP. I'm dreading PIP being cut again. I have sleepless nights.

Years ago I did an assessment by a Dr before computers. The dr sent paperwork to DWP. It was rejected. Someone sat in an office sat and Crossed the Dr's writing on some questions crossed out what Dr wrote and put Disagree. I did get it over turned in the end.

Got plates in my head from a horrific car crash 3 m8s died so you can imagine my injury I lost my hair over the years and the scar goes from one ear over me head to my ear and am loads medication and when I was in my assessment she told lies saying she could not see my scar on my head to back up what I said on the appeal in court I was in the room less than 5 minutes the Dr and judge said you should not be hear were sorry then said I can see the evedence from here meaning he could see my scar and 15 minutes later goes back in and there was my white paper with my turn over and how much back pay but it's ok winning it's how long it takes mine was after COVID had just started 2 year or more thanks on good luck to anyone who has to go through it

@@VMM34 I understand. I tried for PIP and had it refused. They do NOT cater for depression/anxiety/depression! I DID get it for a gammy hip. My mental state was also flagged to them. BUT once I got my R Total Hip Replacement it was discontinued!

I have been turned down for PIP over and over. I have Ataxia. Ataxia is comparable to MS or MND. Anyway 14 months on, I am unable to post forms etc. BUT now I have a social worker and disability charity who is on the mission to get me PIP.

About posting forms, if you go on the royal mail website you can pay for postage on there and Royal mail will collect it from your house and bring a postage label for free. Its fantastic, I use it all the time. They've usually able to collect the following day.

I'm waiting for my decision and have already been on it for years. I have had to fight their decision a few times even having to go to tribunal. I've had M.E since 1995 and am losing the will to fight. I've even had a Police visit to make sure I hadn't topped myself.

I have chronic health conditions that will only get worse so I don't understand what the delay is?

Im sorry to say Charlie, but this has been happening to some of us for years. I have MS, and that is a medical fact. Somehow Iv had three assessments, three mandatory reconsiderations, and two appeals (those I won). The last round over the past 19 months the initial assessment I was given zero, 0, nil pout. I was somehow cured of Multiple Sclerosis of eight years. (If only) I also know that some of those assessment interrogations lie. My baby brother (who has statemented Asperger's and a myriad of other issues, apparently was a polite, talkative and genial chap. According to our Mother his answers were monosyllabic and he turned his chair round and faced the wall after he noticed he wasn't being listened to. (he may have a host of issues that dwarf mine, but he is not blind -.- ) A person I work with mentioned his partner had an epileptic seizure IN the interview, that somehow never got mentioned in the returning paperwork. An aunt for whom complications during spinal surgery have left her partially paralyzed down the left side (they initially thought shed had a stroke) who is still fighting to get the mobility aspect of her PIP. And myself, the last assessment I attended (the one where I was miraculously cured) the assessors laptop crashed about 20 minuets in. Causing the security dongle to fubar an shut down the entire offices' network, I could hear the reception desk complaining that the printer had stopped and her pc was frozen. I never got the requested interview recording as that was corrupted too. Not that having to restart the process doing it all on pen and paper would have been thrilling viewing. So yeh, I have plenty of faith in the actual external appeal as they actually listen and do their jobs (100% success to date personally so far). But everything that precedes that step, no quite the opposite. Then again how is that unexpected when these sub-contracted companies are incentivised to drag the process out as long as possible. apologies for the lengthy rant. tl:dr ATOS/Maximus sucks extra edit: please dont get disheartened, Im sure thats what 'they' want. My aunt (mentioned earlier) loves your channel, I introduced her to it while giving advice from my own experience. So simply put we all need to support one another, and never give up, painful as that can be. Keep up the good fight, and free hugs all round :D

Can be anyone from a physiotherapist to a dentist! Until they suffer from the pain and anguish people suffer on a day to day basis, especially if what they have isn't curable as in chronic pain for example or fibromyalgia... How can they assess someone with no experience or training in those areas?

I got my first appointment last Monday, I took a day off, asked my friend to be with me so I had emotional support, I stayed in a hotel the night before so I was close to my friend, so I didn't have the added stress of travelling on the day, met my friend 2 hours before, so I had time to calm myself, and they called but hung up straight away, did the same on the 2nd call attempt. Literally rang a max of 5 seconds. So called them, the call centre couldn't get through to them, but left a message, 3rd call, I managed to answer quick enough, they hung up at 2 seconds! I honestly believe that they did this to try to close peoples claims down. I then called again, and they said we needed to rebook next week. I actually lost the ability to speak, I was thankful my friend was there, because I was a wreck. But that wasted a day off work and my travelling, and worse, risked my friend not to be able to attend with me for the next one, I'm seriously panicked thinking that they might do the same next time.

It took 2 years for me to get a tribunal date for my first pip assessment when I changed from DLA. Only upside is all that money that should have been paid in that wait is backpayed. The system is scandalous and they couldn't care less!

@@jamesbannister8470 I tend to agree... unfortunately 😔 Edit to add.... this is the 2nd appeal. His last one was from DLA to PIP in 2018. I have been in touch with Disability Direct in my area and the person I spoke to said that the courts don't take kindly to overturned decisions, which has now led me to believe they didn't even read the form or the evidence sent. Suppose we'll see when we get to court.

@@NothingByHalves I would the work assessment to be much easier than PIP. I didn’t even need to fill out any forms. They just spoke to my GP, asked me a couple of questions and that was it. But then again, that’s just my personal experience. I’ve heard many horror stories regarding work assessments.

The same happened to me, I went to Mr and the same person checked her own work again, completely ignored the evidence, how can it be right for the same person to check their own work? Of course they are going to agree with their first decision, the system is a complete joke, I'm now waiting on my tribunal, even this can take up to a year, I'm 5 months waiting now.

I'm currently on DLA (higher rate for both)but have been dreading the change over to PIP for years. I'm 72 and on DLA for 11 years after struggling to get it for years. My problem is that I'm really not fit to fill in any forms. I have the added issue of being phone phobic and having situational mutism. I really need an advocate. I'm physically disabled with mental health issues, including CPTSD, chronically ill with fibromyalgia, CFS and musculoskeletal issues and other conditions, am diagnosed autistic and waiting for an ADHD diagnosis too. I'm immunosuppressed due to having Non Hodgkin's Lymphoma (I've had chemotherapy and 2 years maintenance immunotherapy too but it's only treatable not curable.) I spend most of my time in bed and only go out for medical appointments or rarely to see friends and family. People tell me that I shouldn't worry because they *can't* refuse my PIP claim but I've heard such horror stories. I don't need this hanging over my head.

I've been tribunal for esa once disability once and pip twice last time no money for over a year court took 5 days short of a year nearly killed me, last judge said she was awarding me straight away and couldn't believe I've been to tribunal 3 times for the same thing, just filled out pip update forms and I know they are going to do this shit to me again every time Ive had citizens advice help and still ended up back in court being treated like criminal one time I was taken into a room in the court and strip searched because I'm held together with metal and Covered in scars made me fell like dog shit on their shoes

The same happened to me I had over 50 pages of doctor consultants, and specialists, I have major physical and mental health issues, I have over the year my health has declined drastically, if not fibromyalgia, osteoarthritis of the facet joints. Copd, myasthenia gravis, carpal tunnel syndrome, Bipolar disorder along with borderline personality disorder. High blood pressure, IBS urge incontinence and stress incontinence,lower back pain, double vision, blurred vision and the list continues lol Like you I'm in pain 24/7 fatigue total exhaustion. I was denied so I did MR and got denied so I then went for tribunal but before that came up DWP then changed their minds and awarded me back enhanced on both. I think tribunal told them to revisit my paperwork as I had called them out on all the assessment phone basically calling them liars but using this instead saying this statement was also untrue

Charlie, in ref to my assessment I told them I would be recording it. I was told that only THEY could record it as appropriately people have recorded before and edited /posted to the internet. They told me the reason they have to record is to ensure they have two copies , one sent to me and the other they retain!

I had requested a recorded assessment, plus I recorded it myself, just in case they 'lost' my recording, but they did send me my cd within 5 days, I did get my pip but only standard rate and there's multiple zero points that's should have points, but the manager only goes off the written assessment, they never hear the recording.

I have a third tribunal since I have been on PIP since 2012 in a few days. The last tribunal was in front of the secretary of state at the time and I was successful (2nd time doing this). I suffer with a condition that is permanent and will not improve, it can only get worse, and I also suffer with complex PTSD. My conditions have been assessed and been granted twice through the previous two tribunals, so why am I having to go through the process once again, this is surely discrimination. Something is VERY wrong here.

Just had my pip review back. They agree with my mobility problems and I scored 10 points. They then said I can plan and follow a journey unaided. I have rheumatoid arthritis in my hands, I also have synovial hypertrophy and no movement in my right thumb at all. They have the hospital letters stating this, their score was zero as apparently I have good pinch and grip. I've asked for a mandatory reconsideration as the results don't make any sense. Some days my feet are so painful and swollen that I can't put any weight on them (pip have seen photographic evidence and x-ray results) but hey apparently that wouldn't be a problem travelling unaided. This whole pip process is so stressful. My doctor has now referred me to mind as I'm struggling to cope with the additional stress it's all causing. I'm now having to repeat the whole process for universal credit. Bloody exhausted but have no choice

I got enhanced Daily, but turned down for mobility - I think I should have received standard, but also failed MR, and was told that if I go to tribunal they would look at my entire award again; losing everything is more frightening than not getting the full award, so I've left it for this time. Considering the wealth of our current PM, this system is truly nasty.

My Father went permanently deaf 5 months ago, he had all sorts of test from the hospital, ear injections, more tests and the consultant ent Dr has confirmed my Father's ears are totally dead and a operation will not work. my Father's solicitor did all the paperwork which he specialises in, which Dr's and consultants have confirmed, yet the DWP says my Father's not eligible for pip and informed him to learn sign language he's 69 years old never missed a day of work and has always payed his way, now he needs help the Government as turned its back on him.

What is happening is that they are hoping most people are too ill and afraid to go to tribunal. I should have received full mobility in 2016 based on my assessment, my MR request was denied back then even though I'm certain I would have won at tribunal. The HCP described me as too breathless at rest to attempt a peak flow, while sitting in my wheelchair because I was too breathless to walk.

I am a new bie and have watched your last couple of video thank you i claim pip atm and like you i have been claiming for about 7 years 1 time during the covid era i got my 1st video call or phone call assessment and the woman i had rejected my application so 6 months later i won the case back and they moved me from standard to enhanced i have a brain tumour and suffer depression etc also nerve damage to my left hand and i am left handed must admit my assessment is due any day and i know they are probably going to boot me tbh im worried sick 😫.

Happened to me then I applied for tribunal..have waited 2yrars and another 5months waiting for court date.they rang me to tell me why they originally refused me.when i told them i was waiting for tribunal date and was told by the gentleman my appeal was placed in the wrong file and assured me i would be given priority.still waiting for date.i actually(with help)told them i thought my claim had not been read.im ready to give up but dont want to.thank you for your help Charlie xxxx🙏🙏🙏

I’m at the tribunal stage-had one over the phone in January as I couldn’t get to the court due to anxiety & lack of transport/support, we got to the judge who said it would be better in person at a closer court (which I could get to & have support with me), that I wouldn’t hear before March. We’re now nearly June & still heard nothing. Beginning to feel forgotten!

If all the MRs get declined the wait for a tribunal will be longer, surely the cost will be more for them. They should not stop paying until you have MR or tribunal. People will lose money they rely on for over a year until they get a court date!

I insisted on my assessment being recorded, because my ms brain fog/cognition is so bad, I'd never remember what was said, not surprisingly I did get my award, though just on standard rate, the pip letter had multiple areas marked as zero points, totally contradicting what the recording says and my full medical records say, with a mandatory appeal do I risk losing what I've been awarded already?

I am so worried since the pandemic my pip assessment as been put on hold till about 2026 at least that what they said when that comes around how fucking bad is pip going to get i can hardley walk the pain makes me tired and i cant walk far without being off my feet for weeks and a sit down job wont work as i need constant toilet breaks or i wet myself im so worried that there going to try to force me into work

My first PIP assessment got rejected, and had to go for a reconsideration. The assessor who came to my house basically lied in all the responses to my answers, what she wrote was not what I answered, I have Asperger’s and she would not allow my wife to say or help me at what was an already stressful time that’s even worse for me, I was told I’m not allowed to record (Audio only) which means I had no evidence of what I actually said.

I want to let you know that I followed your advice re mandatory reconsideration, I was 1 point off higher rate for daily living.There were 2 clear areas where points had not been awarded. I wrote to them clearly stating where the points were not added and provided further evidence. I won, your advice does work for some people,I am so grateful for the information you provide and wanted to let you know sometimes the right outcome is awarded. Thank you x

Think this is pretty standard practice from DWP. A year ago I went for an MR and had to take it to tribunal. I think they do it to make people give up. The key is DO NOT give up.

My renewal has come through this month and I'm scared sick. If they stop the money we're screwed. We bought our own home before I got sick and never recovered and I'm terrified they'll stop mine. I don't have a life, I exist! And they get my PIP back as it pays for my council tax, food and prescriptions! What more do they want? No one will employ me as I can't do much of anything! I used to work in retail and can't afford to pay to retrain and I can't see anyone hiring someone who can't even come into the office.

I always assume that the main bulk of my correspondence with the DWP will be skimmed over. So, one thing I would suggest to anyone writing important letters to the DWP or wherever, the first thing on the first page should always be a concise summary of what is in the rest of the letter and on the other pages, and the very last thing on the last page should mention clearly whatever the most important information you are trying to convey is.
