They only have a case if your name falls in the same realm as theirs. For example, you can't make an audio effects unit named _Holy Grail_ because Electro-Harmonix has a trademark on the name for their reverbs; but you can use the name for a harp, since there is no ambiguation (assuming you aren't infringing on somebody else's trademark by doing so).

GoblinDex, obviously. It also logo's down to GD really easily. I might go for a different company name though, that way you can switch it up for other products as they come out using the Goblin** naming convention. Could crush down "Mid-Scale Manufacturing" to MSc Manufacturing. Logo's really well, has the double meaning of "Mid-Scale" and "Miscellaneous" since you're also building and designing lots of things not necessarily tied to one product.(MSc Design, MSc Industries, MSc LLC, something like that. So then it could be the MSc GoblinDex.

My first thought of a name was "Nilbug" - kind of referring to a play on zero bugs, being a bug in the industry and of course (almost) the reversal of goblin. I would use it in the second tier to denote the product, e.g. Nilbug Indexer. Having the name attached to the product promotes the company a bit better I think and may lead people to easily trust other products of the same brand. Good luck finding a new name and thank you for sharing your content!

I'm glad you guys were able to roll with this and come out smiling - that attitude bodes well for the future success of your company. You are absolutely right that the other company had no choice but to send that letter (even if they are awesome people). If they had given you guys a break, then the next company that infringed would have the easiest defense in the world: "Well you let that Stephen guy's company slide, so why are you discriminating against us?". With trademark law, it would lead to (at best) expensive future legal fights and a fairly steep and slippery slope towards losing your mark. I have been peripherally involves with a couple of TM disputes in the past, and I can promise you that it is not a great feeling for the company sending the letter OR the one receiving - chances are that the sending company was probably starting out just like you guys, not all that long ago.

Here are a lot of words to chew on On the subject of carefully placed things: The "Bowerbird" is a bird that constructs a little hut for mating and places/arranges brightly colored objects around it to attract a mate. "Tambour" and "Luneville" are methods of bead embroidery Words relating to Mosaic are pretty well picked over, but they're fitting (Tessera, Tiler, etc) "Geomancy" is any magical/divinatory practice that has to do with arranging objects or the earth, such as Feng Shui or bead/dice divination On the subject of labor saving there are, of course, various little "creatures" who do things for/to people: Kobold, Pixie, Fairy, Imp, Tomte, Gnome, Familiar, Sprite, Nisse... and, yeah, Goblin Wordplay: The Egyptian Hieroglyph denoting a tool or the use of a tool is the Pick (𓍆) Another word for a guitar pick is a "flat pick" or "plectrum," deriving from the Greek "Plektron" A Lobster Pick is another name for a Lobster Fork and is... the thing you eat lobster with. "Locus" is latin for 'a place' and sounds way cooler than "Pono" which means "to lay down". It's probably the most similar in vibe to "Index" "Plucky" is a cute word for determined and scrappy that also alludes to the function of plucking or picking and could be spelled in various obnoxious ways (Pluki, Plucki, Plukky)

You should call the project "Picky (or Pickie) McPlacey" (If this is taken I would be absolutely amazed) or if you want something with your organization name in it How about "Courier"? It realistically takes a package and delivers it. and your organization "Credible Intelligence Solutions" or "Credigent Solutions" as a sidenote, a friend's local band years and years ago gave his band name because he was wearing another bands tshirt and looked in the mirror and that with some anagram-fu gave him solid inspiration for his band's name.

I think a smarter play would be to not engage legally at all, but blow back with bad publicity. Involve the press, involve RU-vidrs, like doesn't the EEV guy have like a million subs, doesn't LTT absolutely LOVE blowing back against corporations that don't sponsor him, try to get mentioned on The Reg, the Level1 news show and whatnot. Everyone loves the underdog. With bad enough optics, big companies usually back down. And even if they don't, you get free advertisement for the project, more customers for the product.

Honestly I think this is a great news, it's still early enough to where the name can be changed without being confusing. Don't mean to rag on it, but the word 'index' is such a generic word that's used for so many things. Quite frequently when trying to google around for videos & webpages trying to re-find things I've seen before it's been a challenge because the word index doesn't really help me get there because it's so ubiquitous. I type "index" in youtube and the pnp project doesn't even show up despite having watched every video in your series. Index funds, index finger, index of an array, book index, it's just an incredibly common word used to refer to (aka index lol) so many different things! I don't have any specific suggestions other than to come up with a name that doesn't have this problem, make it a unique name that's easy to find and won't collide with anything on youtube & google. Sounds like you've been thinking hard on it and I'm excited to learn the name of the machines I'm about to build for which parts have just started showing up in my mailbox! :)

As sucky as that kind of situation is, I'm SUPER glad it happened the way it did - "this is a trademark of ours, please use a different name" rather than "you're infringing on a copyrighted design, please stop manufacturing this". While there's some pretty big names out there already using Index/Index Machine, it really is pointless to speculate (or even mention specifically who it is), not just because they're practically obligated to do what they're doing, but they're also not doing anything malicious, and cases like this, in a way, help keep the trademark system working correctly. If they didn't do anything, it could certainly open the floodgate for virtually anyone to stomp all over trademarks, in reality. Better than some big corp full of hot air stomping on the little guys, at least.

"In the X", it places it in exactly the right spot. Might sound too much like Index though...

I would suggest looking for names in old mythology. They have some really awesome names. By extent, but somewhat the same, you could have a look the naming of some celestial bodies :)

Are they demanding you not use derivatives of "index" (not sure how that would work)? If not, what about something like "nDex" for the pick and place project name?

I am not going to lie I am kind of glad you are changing your name, because there was some issue looking up this name without already knowing about it as a pick and place machine. Sorry to hear that you had to though. I hate naming things, let alone renaming them!

How about "PutBot" for the product? Then have multiples of 1000 for the versions. "PutBot 4000" has a gadgety ring to it.

I thought it was going to be something copyright related! Glad it’s not that! Granted it does kind of suck that someone can essentially say they *own* that idea that you originally came up with *with no ill intent*, but i *kind* of get it for trademarks. Best of luck in finding a new name, i hate the process myself. (Half the time i just make some goofy bacronym )

Mad Goblin Labs or something similar is a pretty thematic name for your company. Even if it's quirky it's evocative. And I'd throw out "Ratatat" as a product name as the onomotopia of the machine doing a bunch of things in rapid succession, though that namespace is pretty crowded.

There are also plenty of very big companies, who never paid a single dime to come up with that name. So don't really see the argument there to be very honest. Some of these super big companies have absolute horrible names. About the cease and desist, yes, sort of technically they have to do these things. But the way they do it says a lot about the company. They can literally give you a call about it explain the situation and the official "cease and desist" is just a formality.

I'm pretty sure that you can use your own Name and not have an issue with it, even if there is already another company with that name. I would suggest "Hawes Smart Machines" with initials "HSM" is pretty cool. Also how about "Select and Spot" for the project, or "Grab and Drop". How about, "I pick things up, and I put them back down!"?

You probably have plans to sell other products in the future under the same company name, so it wouldn't really make sense to name the company and product the same thing. For the product name, I've always thought the word fiducial was fun! Maybe a riff off of that? Something with pick n place? You shouldn't worry, you're not the first company to have to deal with this crap. There have been many successful companies that grow beyond their initial name! You got this Stephen!
