This isn’t the type of video we ever thought we’d have to sit down and film but we feel a lot better letting you all in on what’s really been going on. I’m sure that over the last year there have been times where things have felt disjointed or confusing so we hope this sheds some light on what’s been going on…we still can’t get over the fact that after everything we’ve dealt with, WE’RE the ones being sued! But as always, we're going to find that silver lining because in the end, it's alllll going to work out better than we could've imagined ❤
I'm sorry this was such a hassle. I'm always amazed at how many common sense single-point failures you've experienced. It seems like very few people know what they're doing anymore. I hope their insurance covers it and the pool ends up being free to you.

You explain when you can to us and when you feel comfortable. From watching your videos for over five years now and through the RVs, the dome, and now the containers you guys are anything but not prepared. You plan things very well in advance to the best of your ability from what I have seen. Not to mention all the new skills you have learned. Like for goodness sakes you but in all the electrical conduit for the Land. You have built water filtration systems to have cleaner water to use. You’ve built an amazing garden to feed yourselves. Not to mention all the other skills you have learned that we may not know of. You do your research anyone can see that just by watching many of your videos. You have been screwed over by too many people and it breaks my heart for you both. Keep on moving forward guys. ❤
As a lawyer, please be aware that consulting us about your rights and obligations does not make you litigious. It makes you informed. Having a lawyer speak/write to someone on your behalf does not make you litigious. It just means someone who is not emotionally involved can present your issue and maybe resolve it for you. A large part of my practice has always involved advising clients, not bringing lawsuits. Yes, a lot of people think going to a lawyer means you are going to sue someone, but there are many ways short of a lawsuit that you can be helped. Never be reluctant to seek legal advise.
They absolutely have a right to counter sue, at least here in the states you do. Because if they had of brought suit first against the company for breech of contract and sloppy/inadequate work performed, the pool-holes would have countered suit, surely.
Good luck to you guys. Those pool people sound awful; just show this video in court. It's clear and concise and describes the issues perfectly. You'll find the solution (seal and tile the pool like you originally wanted?) and end up enjoying your pool. We've renovated several houses, and if you've only run into one bad contractor, you've done well.

If only our elected politicians put in legislative measures to hold companies accountable for taking advantage of consumers. How hard would it be to implement a 3-strike policy for not correcting proven defective work AND having to waste court time and resources to litigate that. After the third time, levy a $50,000 fine. Companies have nothing to lose by wasting our tax-funded judicial system, unfortunately.
@@tylerandtodd I couldn’t agree more. It drives me insane how politicians ruin our government and country. There is no longer balance and checks to hold anyone accountable when they take advantage of taxpayers. Well unless you are wealthy and don’t actually pay your fair share of taxes.
@@tylerandtodd Canadians with longer memories might recall someone in a position of considerable federal responsibility - *not* a politician - advocating quite heavily for the elimination of all kinds of regulations in an effort to reduce the "red tape" that was hindering business and economic growth. This was around 12 years ago. I remember that person's immortal proclamation: "The market will be self-regulating!", the abject, self-serving stupidity of which still amazes me. When comparing consumer protections here against those in place in the United States with my American friends, I still say we're better off, but not by much. Refusing to pay for a job not well done is pretty standard practice: I know several people who've done just that and with full justification. None of them has ever been sued, so this is a first for me. I guess the pool boys thought it was worth a try just to see if you'd roll over.

The pool never made sense to me until last week's video, and this week's video explained a LOT of things that I didn't understand last year. It broke my heart when you moved to the lake house, but now I understand this move so much more. Thank you for being brave enough to share all of this with total strangers. It’s pretty common for customers to withhold final payment until the contract is completed to spec. Pretty ballsy of the company to go after you guys for none payment. Hope you’re able to go after them for damages. Glad you’re finding silver linings. It’s so important in life.
In Germany final payments can even be delayed by years, if the contracted work could have preventable mistakes that would take some time to show up. So basically if everything is fine after a predetermined amount of time, the final payment is given.
Companies tend to think that ALL they need to do is say the phrase "We'll SUE" and folk will fold. You two are good examples of standing up for your rights. Time will tell if the company will cave in. I can't believe that "The Law" won't be on your side in the end. Meanwhile, we support you!

Tyler and Todd, I am in the USA and unfortunately this deception by companies happens all the time------way too frequently. Absolutely you did the only thing a rational person with values and standards can do in a vicious world of deceivers and sub-standard morals. @@KevinCovington5453 Yes, sometimes threats to take someone to court, are a bluff. Many, maybe even most "lawyers letters" literally aren't worth the paper they are written on. That said, every time a lawyer writes a letter, count that as another one, or several, thousand dollars, added to the final bill. Laws very between states and countries, so only sometimes is a "winner" entitled to get some, even just a partial, (and even less often, a full reimbursement), of their lawyers fees and court costs paid by the "loser". People need to be careful not to spend $50k or $100k in legal fees, trying to chase a $25k refund, from a company that just declares bankruptcy at the last minute and is then "uncollectible".
I’m the parent of an adult son who is autistic. I’ve been caring for him for 38 years. Even though he’s considered “high functioning “, he still needs 24 hr care. He’s the love of my life, but it’s exhausting, and sad, and frustrating and joyful and every other emotion all at the same time. My mom, who I miss with every breath I take, used to say, “when you’re going through hell, keep going. Eventually you’ll come out the other side and the sun will shine and the joy will sing in your veins”. You’ll come through this, and the joy will sing…❤ We’ll be cheering you on!
You guys are totally in the right. Companies will try to bluster their way through with letters from lawyers etc but they owe you a functioning pool, and there’s no way you should pay them any more. You actually should be getting your money back. So glad you sought guidance and can finally share with your devoted supporters. Good luck!
@@tylerandtodd I know this from experience. We (a small residential building association) sued a roofing company for a faulty roof that we only discovered by accident was faulty. We residents run the block and many were fearful of all the threatening letters that company sent. But we persisted and got all our money back (minus the solicitors' fees, but still, a win is a win!) We put the money into a new roof build. So I am cheering you guys on!
Can't believe it's 18 (12 since seeing its installation months ago) .....but a company not completing their side of the deal....I'd Counter sue. Good luck.

@@tylerandtodd When you counter sue ask for all your money back, cost of removing and replacing everything that the company was contracted to do, I would also include emotional distress in the lawsuit, I would ask ask for the money that it cost to have all the dump trunks since you was lied to, and last I would ask for all legal cost Added I would also ask for any money that it cost to delay any other project that was delayed because of the pool

Never once, in any of your videos did the thought cross my mind that you guys didn't know what you were doing or were incompetent. Quite the opposite actually--I have seen, time and time again, that when you guys do something you are unfamiliar with that you study and investigate the topic until you ARE informed and knowledgeable. We are on your side and because you need a lawyer doesn't make you litigious--it makes you smart for consulting someone whose profession it is to know a great deal about a specific topic and can help you understand and execute your rights when the other party is not cooperating. WOOOOW! Literally that last payment is there to make sure the work is done properly. My hubby is often working hard to finish the 10% so that the client is happy and the company gets paid. This is just wild!

My partner and I had a very similar situation with our koi pond build. The bottom drains weren’t installed properly, the pump and filter system wouldn’t work. The project was suppose to be done in two weeks….the pond was eventually completed two years later. We too made the mistake of trying to work through the situation ourselves…we ended up hiring an attorney, the best decision we ever made! I feel your pain, good luck on holding the company accountable and move forward with your dream. . I know you will be successful, ours was settled four years after the start of the project, in our favor.
Not smiling at your stressful story, but at recalling friends who built a koi pond. They'd bought an old house and were renovating. Outside their dining room. Front window was the remnants of an old pond. We'll fix this! They said to thrnselves, and get some beautiful koi in there! So thry set to themselves - re-mortaring, lining fixing leaks, installing pumps and filters, landscaping rocks and water plants. Making sure they had all the ph correct, etc. etc. FINALLY the pond was ready and beautiful and they went to purchase their koi. Settled them in. Watched them closely over the first few hours. Swimming happily. Lovely. Next morning they set up their new breakfast table by their window do they could watch their koi. Lovely. The next day, the same; breakfast overlooking the pond. Could only see 2 koi this time, but assumed the others were lurking under the water plants. Next morning, sat down to breakfast, only to observe a Blue Crane standing in their pond! Quick as a flash it struck into the water and came up with a large Golden koi in its beak. It paused, one eye looking at them as if to say; "Thanks for breakfast!" and then flew away. They shrieked and ran outside. Sure enough, not a single koi left in the pond. $800 worth of fish gone. Talk about a gourmet crane restaurant! Thry decided not to restock their pond with koi, or any other kind of fish, as that would require installing an ugly protective metal mesh cover, so they settled for just enjoying their pond & plants and little fountain. 😅
@@LinMonasha local resort nearby, Australia, had a impromptu pelican feeding show most days. When the pelicans got greedy they figured out that the automatic glass doors, into a area of ponds connected to the reception, had 30 to 35 Koi, mostly 2kg plus each. Don't make me tell you who won that battle 😅
Ugh, you gentlemen have been struggling with alot of the trades throughout this entire build. Dumpey seems to have been your saving grace ... too bad he doesn't know pools. We all wish we had a Dumpey in our life. Best of luck in resolving the issue.

I’m sorry to hear you guys are going through this. I have been flipping houses for over 20 years. I have remodeled over 60 houses. I have been in the situation more times than I would like to remember. The payment schedule to contractors has always cracked me up. Your supposed to pay that way in order to get the job done correctly but in my experience 75% of the time they do not correct the job or come back and do a half assed job and then sue you if you don’t pay them. The biggest relief in most situations is firing the contractor and taking over the situation yourself. Every time I asked myself why didn’t I do this sooner. I can’t imagine if I had been filming my experiences. I don’t think I would come across as sane as you guys do. Keep up the good work. THIS TOO WILL PASS😊

I had a similar experience with a contractor many years back. It did take me years to rectify the damage done by them. Meanwhile the ceilings caved in in my house, the walls filled with mold, it was a MESS. And I had to live in the house with my kids with all that mold and pans under the leaks for years. Contractor never fixed their errors. I had to get someone else to make the many repairs. Meanwhile I had a catastrophic health event. Stick to your guns. You both deserve to have the home of your dreams. I hope your attorney spanks those pool people! Hard!

I went through something something similar (with 18 other homeowners) when we all bought into a brand new forward thinking environmentally friendly outside of the box condo in Banff. The builder was a trusted local and from the first winter we had a roof leaks due to the design coupled with a poor build. We were promised they would fix it for two years until we were outside the window to sue. When after 10 litres of water came through my neighbours ceiling we were told to get a lawyer. ( luckily the first judge said the two years started when then stopped trying to fix it so their plan backfired) It took 10 years. Our homes were worth nothing. We could not sell and we could do nothing as we needed it all for evidence. In all of this the trusted local ran for town council and we could say nothing. It was the most frustrating and experience of my life. Everything eventually got fixed and I had a beautiful home for 16 years but it was a lot.
My goodness, sadly corporations don’t care. You both have kind hearts and following you from the RV to today you are being taken advantage of and that’s what corporations do they wind it up in court until you just run out of money or get worn down. I work in a property developer's office and having to resolve short comings of our subcontractors is a daily event and you are exactly right....we aren't asking them to go above and beyond their contractual obligation but do the work they agreed to do. It is usually a situation where the sub has made an error or took a shortcut and it didn't pay off and wants the developer to share their expense and pay them (again) to do it right or fix it. It amazes me that companies do not want to fix problems but ignore them instead especially when they are at fault. Even if they installed everything correctly but the pool leaks, wouldn't they still have come back and fix it like under warranty? Sorry you are going thru it and glad you are taking the reins and moving forward!!
If the pool had turned out great and everything worked as advertised you would have given them a big shoutout. I think it would be a public service to let people know what company to avoid in the future. Love you guys hope things take a turn for the better.

Ego moments are incredibly stupid. I know of a situation where a nursing home made a mistake in administering medication and the patient almost died. The family later went to the administration asking to be reimbursed for about $3000 to cover travel expenses incurred when the patient was hospitalized. The nursing home legal reps refused to pay the demand, so a lawsuit was initiated. End result: a settlement 100 times MORE than the original request for reimbursement of $3k was agreed upon. My dad used to say the quality of a businessman's honor is not when things go right but when things go wrong. I hope the pool contractor admits fault and makes it all right. xo

The most important thing in your “construction years from hell’ is that you are both healthy and still together. I have seen stress from remodels and new builds tear couples apart. You are solid and will get through yet another setback together.

The pool situation is a scam by the company you worked with. Like in the USA, it’s unfortunate that companies think that they can take advantage of folks who they think don’t do their due diligence. Hi guys from New Zealand. You need to speak to your Lawyer re Counter suing, What a nerve that Co has, doing shoddy work then expecting you to pay for it. Im thinking as you have to pull it all apart and 'do it yourself' then that Co should be sued for negligence. Im of the mindset ' if you do a job, do it right the first time!' What a terrible Co, they are fools, their bad reputation is going to catch up with them. It will be interesting to see if others come out of the woodwork with complaints about them as well. Oh god this is so hard to hear/see what the pool company put you through 😢 🤬. We’ve only had construction-y / contractor-y things like this happen to us on a very small scale, but it’s still shocking when professionals don’t bother finishing a job and then ghost you, leaving things in a worse state than they were before. I’m learning this is more common than I ever imagined. But to then sue you? Wow. I’m so sorry this happened and also glad to see you taking back control.
Thank you for sharing and I understand (on a smaller scale) the frustration ... had a not great experience with 2 bathroom reno's ... hired 'professionals' and one all but started a fire when working on the copper plumbing ... followed by substandard work that would have flooded my home out. yup, on a Saturday evening we had to do it ourselves ... 15 years later ... no problems. I'm sorry you've had to go through this agro ... as you say, middle group everyone can live with it ... relieved that you are staying the course! This Ontario gal is most grateful for everything you share with us building wise and it's beautiful to see two great men, live, love, thrive through all of life's challenges ... you have me smiling at the end of each of your videos :-)

I’m so sorry you’ve been and continue to be dealing with this much stress and concern and extra work & confusion over how to proceed. So glad you are holding that company accountable for their lack of professionalism, lack of integrity, and, let’s face it, lack of morals. Different topic: Tyler, you stated what I’ve said for years: a therapist is the person who is outside of your life looking in, who sees things we all miss. Their ultimate, true value is that the only thing they are interested in is what is best for you. When we speak to people who are a part of our lives: friends, family members, a pastor, co-worker, anyone who knows us socially etc, they are, with hopefully the best intentions, going to want us to go in directions or make decisions that aren’t necessarily what is ultimately best for us. Finding that therapist who is the right fit is not easy. Todd is so on target about sometimes it’s just having that person who is outside of your circle who can listen when you need to say you’ve had a rotten day. Why do I suspect that the rejuvenated pool, with Dumpy’s on point commentary and help, will be perfection!
Please know no one out here thinks either of you are incompetent. Also, thank you for your honesty and transparency. This happens so often to anyone who has work done by so-called professionals (home repair, renovations, car repair, even medical!) and so many of us often feel helpless. Having you share that we are all vulnerable and that this can happen to anyone while massively unfortunate, also lets us know we are not idiots or suckers- there are just a lot of people taking advantage out there. I’m sorry about the lawsuit, that sucks, but you have our love and support.
