fighting a case and not settling ..even if settling is cheaper was called the "shark effect" in the movie "A Civil Action". If companies get sued they dont want to settle even if it is cheaper because it will encourage future lawsuits...people see blood in the water

Once again shows what a good person u r n how amazing emoloyment attorneys r they r in it to help us help the little guy those employer attorneys r the jagoffs that will charge higher rates and the defend their negligence!! I was just talking about this with my attorney he said their insurance was gonna run out after we dip out of eeoc and he said minimal will be 20 to 50k for prob 3 to 6 months n it could and prob will add up as it continues!! Is what he was telling me and i love this makes me winning money less important honestly. But i think we will....but seeing them struggle to keep council is great to hear n know!❤❤

Hey Vince, I asked a question a couple days ago but it was a bit of a mess. I think I've got my main confusion ironed out a bit - Are cases involving sleep disorders and/or flexible scheduling particularly difficult? It seems that once I explain the situation to a lawyer they lose all interest in what I'm saying and I can't help but to think it comes back to that flexible scheduling/greater allowance for tardiness. I've had a lawyer say they didn't think the case had merit because my employer "gave me what I asked for", in reference to an agreement I was asked to sign while at risk of being fired as soon as the next day; does this argument have weight or would the employer still be required to accommodate until they could prove it would be unreasonable to do so? I guess to summarize, at what point of effort is an employer freed from their obligation to accommodate a qualified worker?

Unless they have in house Counsel or a General Counsel...then they are already paying a salary.....

Defendants have contract with the school district I believe they charge $145 ish an hour. And make me sick to know its tax payer money.

I don't think you need to invoke freedom of information act to get official documents in your investigation. My Department of Labor investigator produced all e mails, documents and work lig right after ivasked her in unofficial email. Of course they didn't reveal what they bwere talking in the telephone calls exept for basics, but i could gess that was there were more than an official report when agent "accidentally" entered the desparating nickname that defendants called me behind my back, in official charge instead of my real name. Its your right to have all investigation documents.

That sounds crazy that a company will pay their attorney $300k to defend them, when they could have settled for much less. But you were very clear that the attorney will convince the company that it's better to pay him than the client.... this sounds somewhat unethical. The company should take a closer look at this practice. If the settlement comes with a non-disclosure clause this can put silence on the suing party to disclose the settlement amount. Personally I think its more cost effective to pay out say $150K with a non-disclosure.

If I were the employer I would settle only the cases where it could be substantiated and would be less vs the risk of trial or defendant asking for more Later.

@@johnworfin workers compensation court and office of unemployment, the FAA and OSHA state and Federal. The thing with the state Eoc is ongoing but I have concerns that they to are on the side of my former employer.

The quickest and most efficient way to actually get your records is to make individual requests with each agency or sub-component directly and where possible office directly. Make your requests electronically and ask that records be provided to you electronically (e.g. by email). You can make a FOIA request for OSHA. They have a page that explains how to do it in detail. Search OSHA + FOIA in a web search. For the DOL, they also have page that explains how to make a FOIA request in detail. If you get lost, they have a central FOIA request email you can submit the request to and they will try to route it. Search DOL + FOIA in a web search. For the FAA, they also have a page that explains how to make a FOIA request in detail. Search FAA + FOIA in a web search. For worker's compensation and unemployment--not sure if this is federal or state for you given your reference to the FAA--but search or contact the offices about FOIA (if federal) or public records (or "sunshine act") requests. Hi Vince, would you ever offer pro bono on an employment case? I have sent a former employer the Charge of Discrimination and mediation is to be scheduled soon. I have tried reaching countless attorneys but no one replied or had interest in my case against another law firm so by the grace of God, I’ve done the best research I could for my justice. If you ever find you’d like to offer pro bono to an average american, maybe our roads can cross. God bless you.
