Sound is better than ever. Regarding commercial real estate, maybe you could get admitted to the bar in a place like California where employment attorneys are still in demand and there is an abundance of higher end wage earners?

Double dipping, I hadn't even thought about that with regards to the attorney fees. I do want to mention that in NYS at least, your settlement is also subject to payroll/income tax, so keep that in mind. The tax man cometh! Thank you for such an informative video.

But what about a jury verdict award? Is that subject to tax?

I think if you have a solid case for employer fraud, it’s best not to settle unless it’s really high. And I mean REALLY high, in the 7 figures. Otherwise, take it to trial. After proving fraud in civil court, criminal charges can follow. That’s another scare tactic that can sweeten the settlement pot.

Hey Vince thanks for the bit on attorneys fees. I unfortunately do not have an attorney, but if I were to pull one in at like a settlement hearing. That agreement would come in handy. I was able to have an attorney stand in during a bs mediation. Not his fault it was before discovery and I only had my evidence not all interoffice communications. They tried to offer less than 20k for me to go away. I am now waiting for Judge to rule on MSJ.

I am currently in litigation against another business and in Canada we pay Attorneys up front. Just the retainer is 10k and even if you earn fees in the judgment it's paid after by the defendant.. maybe. So we pay the Lawyer and it might be years before we get reimbursed. I was amazed by the numbers you deal with though. Million dollar cases here are pretty rare, 300k in attorneys fees would be insane.

Hi Vincent, I really love your show. I wanted to share something with you about my experience. My lawyer took a year to file told me they believe me had my back wanted to fight this in take this into litigation and then motion to withdraw in the middle discovery. Please know there has been no new news if anything possible more claims to add. I disputed it and now they’re still have not withdrawn as we have to appear before a judge, but they’re not talking to me. I mean at all, not telling me when court dates are not telling me what forms are submitting although they are saying they’ve submitted forms. I didn’t even know who all the defendants were. I mean, they didn’t even alert me of proceeding like discovery. They didn’t bring all the causes that I had a lot of proof for, and when I mean proof, I mean people admitting to these things, but that’s OK and I’m trying to believe that there’s more to it which is understandable I’m assuming because I’m not a lawyer so maybe that’s not what they do regardless of proof and more than just a few pieces of proof I don’t know. they also didn’t do some key things like file with EEOC (very much mandatory ) and didn’t get my client folder for almost a month after asking several times when it was supposed to be sent according to my attorney the same day they told me they were withdrawing. That I mentioned there was almost 3 months that didn’t hear anything while being contacted by media? valid concerning things, this is frustrating. I’m not sure what to do. I have to pro se because it’s really hard to find an attorney where I live and because of who I’m going up against. Not to mention it’s late in the game. This case was pretty serious and I don’t want to end up with their attorney fees, but if I don’t fight, that’s exactly what’s gonna happen. I almost lost my life behind these action’s. I’m still trying to get back on my feet. Have you heard of something like this happening? What could I do to put myself in the best position? Am I allowed to ask for a hold on the case? It’s funny because I was applying to next year, but I don’t think I can because I might be fighting this on my own I am not that savvy to think that I can learn in a short amount of time, but it takes people years and experience to learn. I’m really grateful for your show and I guess those are my questions. Have you ever heard of anything like this happening before people normally get holds on cases and can I get one by amending my concern/ claims because I would like those causes to be brought and told although beyond time frames the EEOC will still provide a right to sue. Thanks for what you do.

@@ProSePlaintiff yes, makes it worse is it didn’t read the reviews I didn’t realize it but it’s happened to a few people I guess. I was just distract in need of immediate medical attention, I trusted things were going as they should and lo and behold here I am.

I love to watch this video cause it gives me idea when I entered my deposition I don't understand why my lawyer asked me to submit my paystub before mediation as I was making 27.61 before I got fired and now I am making 21 per hour and I am 57 years old,fo u think I will a good settlement thanks vince pleasure watching your video from Toronto Canada

Some attorneys say that contingency means that they don't charge you by the hour, however you must pay expenses, which includes travel business class , lodging in five stars hotels and even office supplies. They even may ask you to pay expert fees. after you pay all expenses attorney takes his 35-40% of winning. Plaintiff actually ended up losing money after paying taxes which apply to whole amount that represented to IRS as one week wages and put you in a highest bracket. Like you made $100,000 in one week. Don't settle, go to trial.

Are you saying a settlement is taxed, but a trial award is not taxed?

​@@MyOtherChannel-zy3tf Settlements are not taxed because it's considered compensation for pain and suffering and not income. Workmans comp wages are taxable though

@@MyOtherChannel-zy3tf no, he's wrong. They don't tax settlements and jury awards. The only way you lose money from a settlement or award is if you owe money to the IRS, back child support, and liens that a company may have on your settlement. The liens portion are usually in personal injury cases where doctors treated you without payment upfront.

Good Sunday All - Vincent, in a retaliation case where Attorney fees can be awarded, are those fees worked into the settlement? Or does/can the EEOC award those on top of the settlement?

Vince I have a question? If defendants makes a dispositive motion. Let’s say it’s 5 claims are at play. You give one away in deposition because you’re not seeking that one claim because of different section in employment claim like /age. The defendants can not get other claims dismissed or case thrown out. Is that a great thing for the plaintiff? and like a summary judgment move in retrospect? Does it mean that defendants knows there position moving forward? Pls answer

Hi Vince, I'm a Pro Se and I submitted incriminating evidence of my employers forgery of documents. Now they made me a job offer before they give their final Motion to dismiss statement. Can I still receive the damages that I lost? Thanks
