What Happens if my Dog Bites Someone? A Legal Perspective 

My dads Cane Corso recently escaped from the enclosed yard and bit someone that didn’t know the dog was fearful of random people and began to chase it down to bring him home but the dog ended up biting her. I’m scared that my dad will face severe charges because he is an older gentleman that truly loves his dogs and has spend thousands trying to get this particular dog trained. Hi Barry, my dog bit someone. My dog jumped out the front door when i set the mail on the floor just inside the door. Fell to my knees and started to get up.I heard a strange high pitch noise and not sure if it was an animal or what. I walked toward the passenger side of the truck, I called my dog and she obeyed and came. I put her on her tie down. Then i heard loud crying on the other side of my truck and went around to find out who was crying. I found a woman sitting on my lawn and she said a dog bit her! I saw blood near her ankle. I asked if i could call the ambulance and she shook her head no. Called my neighbor to come over to help out. The gal who was bitten and i were very shook up. Once my neighbor got there she asked if we could call the aid car and the gal shook her head no. That's when i ran into the house to get a roll of paper towels. Ran back out to the two gals and grabbed a wad of paper towels for her to put on. My neighbored later told me that the gal called her brother and her neighbor but didn't get anyone. I asked her if she wanted me to give her a ride home. She agreed. She lives about 5 blocks away. She checked the bites and we noticed the bleeding had stopped. I brought her home and helped her to her front door. I told her i would be checking back with her and i told her i would pay any expenses she might have due to the bite. Now the gal who was bit and her brother filed a law suit with Morgan and Morgan. My homeowners insurance does not have a clause that covers dog bites. Can you either put me in touch with a personal liability lawyer or Ormond Beach,FL or Daytona Beach,FL? Also, i am thinking that loud screeching noise provoked my dog?

Good information: but one main idea i get is "get insurance... attorneys need more deep pockets to go after."

I foster a 4 year old Pitbull mix….he has all shots, is neutered. A “friend” and his niece have been staying at my house. The 12 year old started feeding the dog from the table…..the dog stays tethered 99% of the time, indoors or out….he steals and chews items and or urinates on them. On May 24th a plate was left on the table by the child. Zooby stole a piece of meat off of the plate. Zooby bit Uncle when plate was being removed….2 bruises, no puncture or blood. 5 day Memorial Day weekend for Mr.L Tuesday morning Mr L argues about house safety rules with me. Threatens me with Attorneys!!!! Goes to ER the next day, Wednesday, May 31st, one full week after bite. Dog goes in quarantine….. I have home owners….but I have panic attacked.

Thank you for this information. I will be reaching out to my renters insurance tomorrow. My dog was in my yard, he normally only barks at strangers and he has never been aggressive to anyone. Merely jump on the fence to bark and let his presence be known. My neighbor (who already doesn’t like my dogs) hired a new person to mow their lawn. The guy was warned to be cautious, but he proceeded to get right up against the fence and claims my dog bit him. The puncture wounds are too clean bit be a dog bite and could have very easily gashed his arm on the exposed chainlink at the top of the fence. He did go to the hospital that evening after working all day in the heat doing yard work. A report wasn’t filed with Animal Control until more than a week later, which I deem suspicious as well. He of course has filed charges with Animal control and is pursing compensation for medical bills and time off work.

Thanks for the worthwhile information. My question is-if the dog is in the temporary custody of someone other than the owner, is the custodian liable for that dog biting a person?

I'm in Virginia, my daughter had our dog by the collar and a lady walking the neighborhood thought it was a good idea to reach for my dog and pet it. because he is protective of the children he bit her, and now we are seating just waiting on word from the city or state attorney on how they are going to proceed. I am so stressed . All our neighbors say our dog isn't a violent dog and we have never seen this lady before . it just sucks

Just got bit by a large German Shepherd, while walking through my neighborhood, walking my own little dog; mine legally leashed, on the shoulder of a public road, where I have an expectation of relative safety, free from being mauled by stray animals. Full report with police, and went to receive urgent care from a doctor afterwards. Two large canine teeth puncture wounds in my right calf, all the while both husband, wife, and daughter owners watched, in their front yard, and screamed, as I was attacked, well off their property, and with their dog obviously not leashed. Need to confirm status on rabies vaccination, and need to find a good attorney for a well documented case. Thank you for your video, even though in this case, I am the one that received the damage, on the biting end, and looking for compensation on my physical and emotional injures.

I had a dog bite me in florida and my hand was broken and my back was broken L4 when I was shoved backwards. I can't work now because my back bone grew back deformed. I have a wife and two kids and we have been homeless because of it living in the woods on a sheet of plywood under a blanket that got soaked a couple of nights while the kids were trying to sleep. I have a corgi mix with shepherd. he bit the owner someone in the dog park. my dog was playing with me fine. then a puppy came rushing toward my dog and tried to play with my dog. My dog got surprised and my dog went after the puppy. i was able to call off my dog to walk away from that puppy. After i walked far away of that area and continued to play with my dog, the puppy followed us and challenged my dog. at that point my dog ran after the puppy who is a young shepherd. the puppy ran back to his owner. then i saw the owner tried tobkick my dog. then my dog bite him but did not drawn blood. The owner of the puppy reported my dog to the police, i got fine $125 for the incidents and my dog got taken away for 14 days quarantine. after i got my dog back. the other owner asked me to pay his medical bills. the police reported that the bite was not severe. i have friends that tell me to ignore it because the issues happen in a dog park and the other dog instigated the problem. i am not sure what to do in this case. your recommendations is greatly appreciated.

I don't have much on the guy who bit me past a description of him and his dog. I do have the number and name of the person who's dog was to my best assumption "I came up after anything between the dogs happened was resolved." The name of the person who's dog did not bite me and was working with me says that he saw it as Aggressive behavior. I am more on the side to agree.

What if my side was barricaded and theirs was not and their dog bit mine thru the fence and my dog went under after their dogs then the neighbor stuck her hand between the dogs got a tooth in her pinky but never went to hospital and want me to pay for their pets damages. And they haven't sent any proof my dog was on their side first should I wait for animal control to investigate first

Hello I left my dogs in my car to run into my mom house, an this lady was walking by with 2 of her dogs. so my dog got excited an started scratching again the door of my car an she pressed a bottom inside my van that automatically opens the door, an she got out an attacked her dogs an bit her on the hand the ambulance came her dogs was fine they gave her a few stitches she denied going to the hospital. when I talked to her she said it’s fine I’m ok I just have to wear this bandage on her finger for a couple days an then she sued me my state is strick liability state an I don’t have insurance what should I do?

I got ate up pretty bad in 2006 by a neighbors German shepherd. Still have pain in my hip and leg. I killed the dog and the neighbors home owners insurance paid. We are still on bad terms all these years later. I’ve been a horrible neighbor on purpose towards them. Keep your dogs up, it isn’t worth the trouble it will cause you if it bites someone.

We have two large attack dig cases that just fizzled out in court after the victims ran out of money to press on suing the dog owners. It is nearly impossible in my province for the legal system to deal with owners of vicious dogs or for victims to see some kind of compensation for their trauma. Everything is in favor of the dog owner and the victims are left with no closure. Suing a dog owner is expensive and most lawyers consider suing dog owners dicy so they always ask payment up front. Meanwhile all the legal protection tools are available for the dog owner no matter what.

So...some guy came in a few days ago...mind you we have a closed off fence and beware of dogs in both sides. This guy came on our property with no permission or ant kind of warning...just came in and our window was open...no need to say what happened but my dog didn't like it and jumped out and bit him on the leg..this happened 2 days ago and I wasn't home. We were visiting my parents that live in FL and we live in GA. We were on the beach (which is a private beach) and a man was walking behind us. Our dog felt threatened because we were with my young daughter and he nipped him in the back of his leg while passing us. We thought he had gotten the 3 year rabies but found out it was just the 1 year. We provided him with all our information and our vet info and gave him antibacterial cleaning solution and bandaid. (Bite was about the size of two pen heads) The man went to an urgent care for treatment and the drs called law enforcement and said we would be receiving a call from them. The dr gave him an antibiotic shot. We offered several times to pay for his medical bills, he said not to and repeatedly said he’s not looking for money. He’s waiting the vet records to figure out “what’s next”. Florida laws seem pretty intense on this whole situation, do you know if they enforce it? Also, any advice on what we should do next ? (We are bringing him in for his vaccines tomorrow already) thanks!

I was taking my dog on a walk in my neighborhood when all of a sudden he went to take off at a passing jogger, I quickly pulled him back but he twisted his head and got loose and ran and bit the jogger. He broke the skin with only 1 of his teeth and we offered to pay for all of the medical bills, but they said they needed to run home first before taking the jogger to the hospital. We exchanged information and this is the 2nd time he has bit someone but the first time in public. I’m not sure what to do and seeking some advice.

Who is considered the owner when a police dog bites an individual inadvertantly or inappropriately and outside their scope? This was just litigated in Minnesota and appealed to the supreme court but what do you think the answer is? Is it the handler or the agency?

A MAJOR must have, that is EXTREMELY important is to have cameras on your property. If you have cameras, it will make it very difficult, if not impossible for a trespassing victim to file a lawsuit against the dog owner due to the dog bite. If you think about it, if a trespasser got bit, the dog owner could show the footage to the police. And, have a BEWARE OF DOG sign. That way, you are not liable and neither is the dog for a bite due to trespassing. Because, I think this is how it works...if someone is trespassing and the trespasser is bitten by the dog, the owner has BEWARE OF DOG signs, then police and animal control CANNOT quarantine or euthanize the dog if the victim was trespassing. This is especially true if the dog owner has cameras. People are going to lie. There's nothing that you can do about that. I always like to joke by saying that you can throw someone out of an airplane and by the time he gets to the ground, he will have fooled thousands of people with lies. It is so amazing of the kinds of lies people will tell. I was walking to my car and my neighbor's dog jumped the fence! And, in fact...that person was actually in the neighbor's yard. That's just one of them. So, have cameras. And, never rely on neighbors cameras. Have your own cameras. Have a BEWARE OF DOG sign. And, replace the BEWARE OF DOG sign every 5 years. If you allow the BEWARE OF DOG sign to get faded, then that BEWARE OF DOG sign becomes a "ghost sign" that means nothing and everybody ignores it. But nobody ever ignores fresh sign. I don't anybody who ignores fresh signs. Do you? So, replace the BEWARE OF DOG sign every 5 years. Maybe rotate the wording helps too. Say after that 5 years is up, then instead of BEWARE OF DOG, maybe WARNING: SECURITY DOG...NOTICE: VICIOUS DOG...stuff like that. Change the wording up every 5 years. And, if your dog is growling for any reason, do something right away. That can be an indication of something. Also, pay attention to the kinds of people who are around. Obviously, Kim Jong Un, Aloysius O'Hare from the Lorax, someone who looks threatening, I guarantee you that the dog is going to growl and snap at those people! However, it is not always immediately obvious that someone is a bad person but the dog can sense it. A bad person can look like a nice person and you may not be able to see it right away. But, if you pay attention to the person who is around, you can see cracks in his/her pretend nice that a dog can sense. If that is the case, then maybe you should stay away from that person. And, you really should stay from someone like that anyway. Point is, find out why the dog is aggressive towards the person. Don't relax just because you have a sweet dog. I have actually seen more legal problems, bites, and stuff with sweet dogs than I have from vicious dogs. A vicious dog, you're going to be more careful! But a sweet little dog, you let your guard down. So, don't relax because you have a sweet dog.

There was a recent incident where a small dog bit a child in the face. The dog was tethered and leashed with about 3-4 ft of length and away roughly 15-20 yards away with me sitting next to them when I am not playing, usually they would have their little fence but I decided to utilize the tether and leashes for that day. Each individual were asked to make sure their kids does not approach the dog without me being there, ( several people can provide fact that this is true as I’ve made this statement each time due to no matter how friendly my dog can be, he is still just becoming two years old with teeths growing out almost filled)since we all gathered for a simple game of volleyball. Next thing you know a little 3 year was by my dog touching him in his ears and she got bit in the face. One reason why I always warn everyone to not touch them unless I am there. The parents were not supervising her as they ran from across the other end of the volleyball net. She was sent to the ER for scratches and a few teeth marks on her face. I followed up with the parents to show empathy, and check on their child. Of course there will be mixed feelings since we all know know each other. They later filed a police report and I answered, complied with the officers investigation. Regardless of a child who provoked the animal with everyone being warned the child and their parents will always win the case. It’s a lose lose situation just from reading and learning more about these incidents. I will be doing my very best to take responsibility, but I do want justification so it is fair in the end. The pup has vaccinated records, unfortunately everything else is in the process for since 2022 was suppose to be the year of becoming a FTHB since we are already on the market and approved. It’s unfortunate that this will possibly set that back.

I’m currently in a situation my dog bit the mailman and he got stitches nerve damage and all that . My house insurance paid already but now they wanna sue me again because my car was parked in the driveway blocking the sidewalk but there was no other parking . I have a fence but my car was parked in the driveway and the mailman decided to go between my car and the fence which was a small space that not even a toddler fits .and that’s how he got bit .I have no assets and i currently don’t have a job .and im 20 . I live in a 36 unit loft building. I have two pit bulls one is leash aggressive and the other is very friendly with 3 legs. I was taking the one out that is leash aggressive , as soon as I opened my door a neighbor was right outside my door picking up something they dropped. The dog I had on the leash and I were caught by surprise and my dog began to bark I had full control of my dog on the leash but she is very strong. While I'm in my doorway trying to back out in my home my other dog bolted out within seconds out past me and the dog I had on a leash. This excited the person in the hallway and she began to bat at my dog in fear. This caused my dog to nip her finger. This all took a matter of 8 seconds or less I called for my dog as I struggled to keep the one on the leash in my control. I feel awful for what took place. Animal control was contacted and my dog was quarantined for 10 days and was not deemed dangerous . However the person but is seeking payment for their injury and I have been fully cooperative but the victim is insisting my management make me get rid of my dog who has no prior history of this behavior and has always been very friendly and approachable. Is there legal grounds towards management to honor this request? I don't want to lose my dog because of this unfortunate accident. Please help 🆘

My dog is half pitbull and half Pyrenees she has anxiety so she's scared of new people meaning she'd try to bite them at first but after meeting them for awhile she'll get comfortable with them so since that problem of her wanting to bite I started training her having her restrained when she's outside and about 2 months ago my neighbor started being negligent with his 4 yr old daughter he started letting her out his yard and out of his closed fence and most times my family had to watch for her cuz she almost ran into the road with on going traffic and when we had to save her from getting her so many times we gave up cuz it's not our child so we talked to the father and he found it offensive so he held a grudge against us for awhile and 1 day he wasn't watching her as usual my family was outside having a bbq no one knew she was coming over but to enter into our yard she had to open 3 gates and for that reason is cuz I'm training my dog still cuz I don't want an incident to happen with her bitting anyone buy the girl came over unexpected and she got bit and for her to had get bitten she had to open my 3 gates to get to my dog who was harnessed and chained to keep her from trying to chase people when walking by our house she's never done that but I'm training her so but the girl got bit and I was so mad at myself cuz it was my fault I beat myself up for weeks and was depressed but I got told it wasn't since the father wasn't watching her and she's not our child and now the father is suing me and I'm freaking out and he recently claimed my family is stealing stuff and selling it to people so he got our landlord to stop us from having yard sales and it hurts cuz I have no idea what to do

WHAT OR HOW ELSE SHOULD WE PROCEED? WE TRY TO BE A KIND COUPLE WITH IN OUR NEIGHBORHOOD. WE LOVE OUR DOGS AND EVEN THOUGH THEY DO BARK AT BIKES OR MOTORCICLES THEY WOULDN'T AGRAVIATE TOWARDS SOMEONE. AND THIS NEIGHBOR IS KNOWN FOR BEING A TROUBLEMAKER AND IS WILLING TO TAKE IT FURTHER.

My baby girl is a mix terrier and she's all updated on her shots, n she claims my dog bit her but I never saw my dog bit her cuz she was on a leash n she was by me. But it's her word against mine, there was no open wound or no mark. She didn't report it to the cops she let it go until the next day she went to the hospital cuz there was a bruise n it was infected . But still there where no cops involved only animal control that came to my home Monday. Hey so supposedly my dog ended up biting someone but i dont see it being possible hes chained up friendly old dog but i had to give it up to the animal control so they can do a rabies test even tho hes all up to date with his shots(this is in Texas) I was told to give the dog up and pay $15 a day for 9 days until they get the results or pay a $500 fine but when i asked the animal control guy if they took a picture of the dog that bit the victim to prove it was him they said that the sheriff said it was a pitbull, bulldog type of dog but mines a boxer and matches the color description. Even tho there are alot of strays and there is a pitbull that comes matching the same discription. They said he got bit while he was running but i feel like they got bit on my property since ive caught someone stealing fence posts but they ran away into the dark and the dogs bark all night and the same person who claiming to be bit ended up stealing my smaller dog that i had chained up next to my boxer and i hear it barking in their house but they never take it out. What can i do about it since im going to have to pay $135 just for them to quarantine him wven tho they have no proof other than what they said

How do you prove a dog is NOT yours? I recieved a citation saying my dog attacked someone and that’s I possible. I had to put my dog down 2 months prior to the accident. And the description doesn’t even match my old dog. Seems like there just looking for someone to pin it to with assets

Hi, thank you for this video. It was helpful. You said have insurance for your dog. Do you mean renters or homeowners insurance or actual medical insurance for your dog? I have renters insurance but not dog medical insurance. The day of the incident I offered to pay for her medical expenses (thankfully the alleged bite was super minor.) And what medical documentation am I allowed to ask for? Meaning I want to ensure I'm paying for the incident related expenses ONLY. Can I ask that all expenses to be paid come directly from the doctors office? Thank you for your time.

In Ohio if the person trespass I am not liable. However it was a 10 yr old who jumped over and got bit. Now I'm being sued, I am familiar with law and have educated my self. Paid their bill and their still trying to come after. Lawyers I've spoken say I'm on the hook which I don't understand why when the law here in Ohio says I'm liable unless the person trespasses and or torment the dog. What do I do now?

My daughter's 6 pound chihuahua bit the fill in mailman on the shoe and he's threatening to sue... I have a chain link fence but he's so little he gets right through it. Hello! ive been attackedby this one dog before when i was young but i stupidly said i didnt want my parents to press charges even though it was a serious attack and my legs were bitten and scratched all over and bleeding everywhere. But the owners have started to not care about the dog and it has attacked some of my neighbors before and its violence of chasing and attempting to attack still goe son. Even after ive done the steps of how to keep safe like dropping objects, stop motion (since it triggers a dogs insticts), and many other things... it still tried to attack. I'm sure that it will soon land on me again since i go by that area a lot since im an active person but try to avoid there. the dog likes to leave the yeard and go where it pleases so it doesnt matter where i am. If i ever do get attacked again, would i be able to file a law suit agianst the owner?

I just went through an incident My dog has been vaccinated 1/11/2020 He needed his vaccines 07/01/2021 He went on a dog fight with another owner’s dog he got loose from my backyard without me knowing, and Because the owner of the dog was carrying her pet, my dog bit her (like a hard pinch). But he didn’t mean to bite her. It was because she was carrying her dog. My dad said the best option was to put him to sleep since he’s not registered but I have the pdf files of his most recent vaccines. We were planning to register him, but then the incident happened. What do I do? The owner pardoned us, but if her daughter goes to the hospital to gets checked, that’s where the issue is for us. Animal control could come. I bathe my dogs, and clean their ears, but where we live is in front of almond fields, so it could be very dusty, and it’s summer. I don’t know if there’s another way to get out of this situation
