The one thing you did not talk about, is being sure that the physician that signs the death certificate, knows about all the Veteran's service connected issues and considers them while determining the cause of death. It is extremely hard to get the death certificate changed in most states. If a service connected condition is not on the death certificate as the primary or contributing cause of death, it will be very difficult to get your DIC claim approved.

The veteran does not have to have died from a service connected disability. If rated 100% PT as totally disabling also qualifies according the the VA. .

Yes according to the VA they have told me because I have been 100% totally disabled for over 25 years and counting that my wife will qualify even if not service connected

@@louc8782 Yes it’s true, You either have to pass from a service Connected Disability OR be 100 percent P and T for the spouse to get Compensation. It says it Right on the VA website.

What happened if the veteran suicided because of his/her service connected combat PTSD? Does the spouse and/or kid receive any benefit?

My dad was a 100% service-connected veteran, he served in Korea and Vietnam and was exposed to agent orange. He was diagnosed with prostate cancer and that was his cause of death in 2017. Can my mom file for survivor benefits and would she get back pay to the date of his death?

You only get one year from the date of death unless you filled out an ITF (gives you another year to file). Outside that window it is the date of claim

My father just passed w away and never received his VA benefits Al the way back to the 70. I was just told there just gone and I can't receive them cause I'm not the wife which also passed away. But I'm the child. Sucks . I need help with finance his burial

Would this apply if the veteran had a mental health issue that was service connected (deposition, ptsd, etc) and they die by suicide?

Yes, that would be possible. This would not be and easy case. As a Veteran Service officer I have won two such cases one within three months of filling and one at the BVA after about two years. The other VSO that I worked with had a case go all the way to the Veterans Court of Appeals (hired an attorney) and lost. That took about five years.

My husband died from hypertension,,I got survival benefits,,Then I turn 60 and started receiving his social security and took it away ,,But he was percent from his knee,,But got a letter saying can apply DIC

I'd like to hear some of the questions below, answered. A mental health claim (lets say depression and anxiety, NOT PTSD), 100% P and T, and when they die by normal circumstances, does the spouse get anything? Or, must they commit suicide

you need to have your 100P&T in place for 10 years, to be able to die of non-service connected issues for the surviving spouse/child to be eligible for DIC benefits. This is an important point as most of our SC issues do not lead to death. Without the 10 years in place, you will need to a have it noted by the coroner that your SC issues contributed to your early demise. So...no suicide, just live long enough so it doesn't matter if you get hit by a bus, or have a heart attack.

@@payne7761 yes... if you die of something that can not be attributed to one of your ratings. Doesn't have to cause death just aggravate the condition and increase your chance of death. After 10 years, you can get hit by a low flying plane, and its all good. This is why people file more claims even when they are schedular 100.

DIC benefit only if its service connected death? How about those who died causedby non service disability but, have been 100% for more than 10 yrs? Please clarify. I am 100%( 2012) and housebound (2013).

you will have the 10 year requirement locked down, you are free to get hit by a bus, and your spouse/child will receive DIC benefits.

I file for my husband benefits since January 12 2023 I file for burial benefits and Dic last week when I call they inform me that the application was in PA veterans administration office since March 2024

Also 100% P&T Veterans together with their spouse more than 10 years after the date of the award, the spouse can receive D.I.C regardless of service connection or not.

Why do you always leave out the veterans who are paid 100% for 20 years for IU..?..DIC is granted regardless of cause of death?..🤷🏻‍♂️
