Authors Insurance could lower your risk as a self-publishing author, but do you need it? If you aren't sure what authors insurance is, or you are worried about liability with your non-fiction book this video by author Julie Broad might help clear up some questions.
Of course, it's important to note, this is not legal advice or even advice from someone who is an expert in authors insurance.

My wife and I have written a children's book and were told we need "author's insurance." Haven't decided yet if we'll purchase or not, but I'd never heard of it until now. It's always something...!

Thanks for the advice. As a fiction author, I already take the precaution of changing the names of public figures whom I want to use as characters precisely for this reason. Often, it's not difficult to decipher whom the character is based on because of the initials, but it is nonetheless a fictional character that does not bear their name, so any lawsuit would have nothing to stand on. But it's still nice to know that this exists.

Hi, Julie! I haven't heard of author's insurance; however, I created a publishing company (and will assign full copyright ownership to the company) to create a level of protection for my upcoming non-fiction book. I'll definitely look into getting insurance. Thanks for the video on the topic! Insurance is available for life coaches... already on the agenda 👍

Oh - interesting. Is it called 'life coach insurance' and does it protect you from someone suing you for following your advice and everything goes wrong? Or, what does it protect from?

I'm new to this research myself, but one should also look at negligent publication claims. It's when a person gets harmed from following your instructions. For example, your book is on jogging and the person gets a heart attack. My book attorney told me that an LLC or Corp. won't help an author on a lawsuit. The party that's been damaged will sue the author, LLC and publisher separately.

Hi could I write about my actual court case that I won and could I use initials for the other parties name and could I use newspaper clippings that were talking about me without being sued ?

I used fictitious personal names and company names. Seems safe to me. I did reference company information from published news sources. Still okay, I think. The book is about my first in advertising. Thoughts?

This matters in fiction writing as well. You can't write a murder mystery that takes place in a real place and references "real" people. For example, "killing" someone in the locker room of a real team will get you in tons of hot water. Even if you change names of the players/staff. But it's not just murder mystery, anything where the team/player could be recognized is off limits (romance, etc.) It's why authors create their own teams in cities where those types of teams don't exist. Just one example but this stretches very far.

This was the first time I’d heard about “author’s insurance.” Very good to know. I’ve wondered a time or three about protection since creative nonfiction. As a loophole, I’ve heard you can change the names of the people involved. Is that the better route? Or would you still need a release and possibly protection even then? Is it enough that the friends and family have verbally given consent? Or would it still be best to get it in writing?

I've heard of it. But I am wondering. I am working on a story and have used names SIMILAR to names of people I grew up with. Its not their exact name, so do I need a release from them even though the story is fiction?

I'm not a lawyer and really can't say what your exposure is in this regard ... and the links I shared above talk about fiction and really say the risks are lower but if you are worried I would check with an attorney or change it up more.

Hi. I am an author. I have a publisher telling me I must pay a warehousing fee and book insurance. Is this normal and true. They are offering me a contract as well.

Again, I am absolutely not an expert in this and if there is any questions about this I highly recommend you consult with an attorney. My understanding from the links I shared and other research is that you have to prove that they are the same person and that is hard if you changed the name - but you may want to blur a few other details if you're really concerned about it.

Nobody posted rates - the few places I found it required you to 'request a quote' which I didn't do. IPBA would probably be the best place to get it if you needed it (And you're a member).
