One example of funding outside of annual appropriations is in Article 1, Section 8, Clause 11 allowing issuance of letters of Marque. This allowed the Federal government (another section specifically forbid state issuance of letters of Marque) to finance war through sanctioned piracy. I do not believe this is a good example of the restraining power of originalism. Before 2016, this would have been seen as a frivolous suit. The fact that the Fifth Circuit court of appeals and two Supreme Court justices bought the payday lender argument is concerning. If they are not restrained when the history and evidence is so clear, what would restrain them? Is the Fifth Circuit a preview of republican judicial future? This also effects the Judge Pittman case. I think the sole basis he gave for issuing a preliminary injunction (stopping CFPB limiting credit card late fees) was the CFPB funding constitutionality.
