My question is, in most situations they take your phone away before doing this and when they've beaten you up, you don't have any proof to show in court even if you do file the case. This boils down to your word against theirs and the courts are going to side with a public servant when there's lack of evidence. For instance- Yesterday I was out with a friend at a park smoking a cigarette and I was approached by two cops, wearing jackets, we got frisked and they took our phone away and then they slapped my friend and said that they'll arrest us and put a case of section 377 against us. I objected and said that if they're going to arrest us they have to show us their identity as per section 41B and the seizure of our phones without any written permission from SHO in writing is also not allowed. My friend got slapped again and they abused him some more and then they left. Now we did try to register a case and the response we got was that since their wasn't any evidence, no FIR is going to be filed. Now what?
