The fact that the person had a firearm is a moot point, this intoxicated individual drove their vehicle to Applebee's. DWI anyone. Taking a drunk driver off the road is always a good reason to call the cops.

He did the right thing. Someone acting suspicious and you know for a fact they're carrying a firearm and appear to be drunk, definitely call the police. Every "mass shooting" the shooter's friends, family, and neighbors always say the person had been displaying clear signs of irregular behavior, but it is ignored and then look what happens. This fella that called the cops could have prevented the restaurant from getting shot up and numerous people killed or injured. Situational awareness is the key, this guy had it and made a good call. Carrying a firearm while intoxicated is a fucking no go.

Drinking and guns don't mix. Everyone who is serious about gun safety knows that. I might have told the manager of the Applebee's instead and let him decide. My second choice would have been to call the police. I would do this as a responsible gun owner. If we police our own ranks, we have better credibility than if we don't. Another good post, Colion.

Depending on how shady the guy is I might approach him but really I'd like to avoid a confontation, even if I was carrying no way I want to escalate things. Jeez, Mexican carrying in basketball shorts? Also another point, if he DROVE drunk and was not just a passenger then he's already demonstrated reckless behavior if you ask me....so why not let LE officers handle it?

When you carry a gun its a huge responsability to not only be trained and aware enough to protect yourself but also to make sure that your carrying doesnt put others in harms way. Ignoring the that he was driving drunk and focusing on the gun issue, as a CCW carrier you have to make sure that you know the laws and are following them. You also need to make sure you have the gear to carry safely such as a good belt, holsters, lock box for the car, etc. You are not supposed to endanger others or make them feel uncomfortable. I would have called the cops too.

one time I was at a walmart checking out ammo cans on the ground I got up pulled my shirt a bit because the talon grips sometimes cause my shirt to stay up anyways I saw a guy a couple feet from me staring at my hip for awhile trying to determine if I was carrying or not the look on his face was alnost like he was disgusted but over concerned so after I saw that his facial expression i could tell he was maybe about to call the police I just up and left I have my ccw but I wasnt about to deal with all that crap over some whimpy guy that got scared over seeing the print of a pistolin other words mind your business if you spt someone carrying and theyre not doing anything stupid or out of the ordinary just let them be

I had a person call the cops on me while I was carrying the informed the police that I was drunk . The cops showed up and asked me if I had any alcohol in my system I said no and that was it . I felt so embarrassed but I was in the right . But the cops where pissed ontil they actually talked to me

100% agree w/ this. Even if "drunk" (no proof, just body language) and he just flagged or imprinted, then that'd be overreacting and outright "tattling" as I tell my kids. There's a difference between safety and snitching. This situation was about safety, but some people and their 100% EtOH and guns don't mix business ... That's just naive. Alcohol is a part of life, so is carrying. Now walking around with it in your hand is a problem, drunk or sober, but if it's safely holstered and the guy has a few beers, even if he's buzzed, then there's a problem. Also, I see we just ignored the part where he was driving like this, a hell of a lot more dangerous than just carrying a gun in his shorts.

To my knowledge it is not illegal to consume alcohol while carrying in New Hampshire.

Erm, the guy got out of the car DRUNK?! Also, it's illegal to carry concealed everywhere pretty much when drunk, so he was breaking the law. The more people do stupid stuff with guns, the harder it makes it for the rest of us

A PERSON WHO IS INTOXICATED SHOULD NOT CARRY A WEAPON, PERIOD

The option of walking out is a non-option. As human beings and responsible citizens we have a moral obligation to our fellow citizens. They are not aware that this drunk fool is packing heat. There's a reason why it's not legal to carry when you are drunk. Drunks make bad decisions, and bad judgement + gun can equate to somebody getting hurt. I ALWAYS carry a gun. That's because I NEVER drink. Besides, I'd rather buy ammo than something that's going make me piss like a racing chicken all night.

I have never been a big time drinker but when I got my CHL over a decade ago I almost never drank because I had rather have my gun and since have just stopped completely because I just don't enjoy it that much I don't have a problem with people drinking I rather enjoy when my wife has a few but alcohol effects people more than some drugs and is not a good thing to mix with firearms.

Colion, I have a California CCW Permit and can affirm that it is a violation of the permit to drink alcohol and carry at the same time. In fact, it is a violation to carry in an establishment (bar, beer tasting room, etc.) that does not also serve food - and a little box of peanuts or Slim Jims doesn't count. I'm VERY late to the party, but I want to sincerely thank Mr. Noir for his willingness to openly discuss these kinds of situations! We live in a country with the right of free speech and that's a beautiful thing.

When I was drunk under a month ago I almost cut my finger off with a pocket knife(total accident. I always carry a knife on me and I was opening a package of naan bread or some Shit and it slipped) and that was my little pocket knife. Handling a firearm that fucked up would have been the end of my life and or others so I'm glad that guy called the cops. Drunks aren't known for emotional stability and overly emotional people make bad decisions.

There are people who safely open carry AR-15 rifles in the public streets and they don't concern me as much as an irresponsible drunk guy mishandling his .22 at the range. The latter is going to be called on.

To me, him stepping out of the car with a gun IN HIS HAND is a red flag. Most concealed carriers, including me, would have it, oh, I don't know, concealed. And he didn't own a holster, just stuffing it in the back of his shorts... that's a red flag to me. Add being clearly drunk to that, and I think I wouldn't even have waited to call the cops. I would agree with the assessment that he was up to no good. Either way, carrying while drunk is illegal in most states, to my knowledge.

It's situational in my opinion. A good man won't murder someone even if he's drunk. I work security and reading people is part of my job. I usually judge a book by its cover and trust my first impressions of someone. Don't try to treat everyone the same. If someone freaks you out trust your gut and act accordingly. I always do.

I agree with Mr. Noir completely. It's a judgement call and the guy made it. I find nothing wrong with the caller's actions. Personally I'm not one of those "alcohol and guns don't mix at all" type of people. I firmly believe that if you drink you should drink and shoot (in a safe manner). I'm not talking about getting trashed with guns here, I'm saying have a few while out in the middle of nowhere shooting cans with your buddies. Why? Because alcohol changes things like your balance, fine motor control, reaction times etc. Even just a couple drinks will do this. If you have a gun in the home and you drink you should know how those drinks affect your weapon's handling ability. I mean seriously, if you're the type that likes to have a few cocktails after work what are the chances that home invaders pick a time to hit your house when you're dead-nuts sober? The last thing you want is to be on your third cocktail on Friday night, have a home invasion and get killed because you missed the safety catch on your pistol due to the aforementioned cocktails... But I digress. Would I have called? I don't know, there are a lot of little details missing from the story, so maybe, maybe not. There are a lot of non-verbal clues people give you through their body language even when they're drunk. I would also have had to access how drunk he was. Like tipsy or black-out wasted? There's a difference. Good mood or bad? Is he acting like he's looking for trouble or is he just waiting for someone to come pick him up and he doesn't want to leave a gun in his car where it might get stolen? I certainly would have had an eye on the guy though.

I'm a bit late to the conversation but here is my take Personally, I would have done the same thing. I am all good with people carrying firearms with permits either openly or concealed, but alcohol and guns are an extremely bad combination. Now granted its not to say that they are going to do something wrong. While I don't see how you can carry with basketball shorts on and not have your pants fall down, I would assume that in this situation the person was simply putting the gun back after removing it while driving. However, I would air in the side of caution rather than risk them being an angry drunk dude with a gun looking to do some harm.

Depending on the man's actions I can't say I wouldn't have done the same thing. Although with that being said I would have made sure that I assessed the situation completely before I making the decision to call the police.

You cannot legally discharge a firearm while intoxicated in any state in the US. Also, as a concealed carry holder (making an assumption) you are accepting a higher level of responsibility for the safety of yourself and those near you. In this case, the drunk guy elevated himself to be the higher threat. Lastly, with the bad publicity around guns, currently, an incident like that would be very detrimental to the law abiding carry community. Our "whistleblower" did the right thing, in my opinion.

I agree with every thing you said down to the letter. I don't think the guy was wrong, nor was he overreacting. You would rather feel bad getting him in trouble than feel bad because you didn't do anything and something really bad happened. Like they say, it's better to regret something you did rather than something you didn't do. But I am also with you when you said you wouldn't have called the cops personally. The same for me. But I also would have definitely kept my eye on him and if he didn't anything else alarming, then I would have reacted. So I think you nailed the response 👍

Do I think it is right to call the police on someone who is carrying while drinking, no. Do I think it is right to call the police on someone who is acting like an idiot while drinking and carrying. Yes.Some people can still be responsible while drinking, some are ass clowns 5min after alcohol hits there lips.

This man did the right thing. I don't think i'd be able to live with myself if I was in the same situation, ignored it, and then something terrible happened (be it a shooting or negligent discharge). God bless

You should think before you drink. If you are a significant distance from your home and don't have a trusted friend to drive you home you should avoid alcohol. If you are carrying a gun you should also avoid alcohol. Both are tools that can greatly benefit you in your right mind. However, in an intoxicated mind you become a danger to others.

I don't think he was over reacting. He was making a smart and logical choice. If I saw someone drunk carrying any kind of firearm, I would bet nervous. You have no clue what that man, woman, or even child is going to do. I agree with his choice. I would have called the non emergency number and filed a complaint.

you did the right thing. as concealed carriers, we face the stigma that we are already a danger to society because we carry guns. Carrying is the most important decision we will ever make and it needs to be taken seriously. This guy was abusing his right to carry and deserved to be arrested. Had he been more discreet with his firearm, you never would've seen it and never given it a second thought. We face enough unfair criticism as it is from anti-gunners, this idiot just adds to the narrative that all carriers are a danger to society. Colion, I agree with your take on the situation. For me, he would have had to do a little more wreckless than what was described. Heck, I've heard of police being big violators of this, from other police.

I think I'd lean more towards your method Colion, to observe and wait for something a little more telling. but yeah, I'd definitely have my cell phone on the table ready to make the call. I may even ask to speak to the location manager and tell them that I think the guy may already be drunk so they won't serve him any more alcohol. Not sure if I'd tell them about the gun though as that may make them freak out. that could cause more trouble than it'd save.

Concealed carry can't consume in VA either. ONLY open carry may consume. I concealed into a bar today for lunch. Tucked in my shirt after sitting down, so that I was openly carrying; and had one beer with my lunch. Then un-tucked my shirt as I was leaving and went back to concealed. It isn't just interesting how different the laws are, it's a PITA. Every time I travel I have to do some research online to double check what all the little laws are in which ever states I'm traveling through.

I personally wouldn't have called the cops. As long as he isn't doing anything that is a major threat to anyone else (like committing a robbery or shooting it) then why bother. I'm not saying it was wrong to call the cops I'm just saying I wouldn't.

Once alcohol is involved all firearms get put away period. If it’s at the end of the day hunting or working. Once the first beer is cracked it’s time to secure your personnel firearm and enjoy. Don’t risk it.

The old me would have felt like they were be wrong but the older me will feel like they're right I guess it's just called growing up and another thing thank you so much for all the information you've given me and making me more aware of guns and guns safety

My neighbor who is a good friend of mine got wasted one time so bad that he ended up pointing his loaded Glock 26 at my face and I had to disarm him. It was definitely one of the scariest things I've encountered. But the point is that it doesn't matter how nice a guy you are or responsible you are (btw, he is a very responsible gun owner, this incident only happened because he was out of control drunk. Plus he usually locks all his guns up safely, but he just bought the glock that day.) if you are intoxicated and have a gun in your hand, you're a very scary person in that moment.

I would have called the cops. He already made 3 mistakes; 1 drunk, 2 mexican carrying his glock, 3 wearing basketball shorts in plubic. :)

Agreeing with MrColion, he wouldn't leave my sight, constantly assessing the situation. If he does anything above my tolerance, I'd make a decision, more likely speak with manager and have him decide whether he wants to call authorities.

I absolutely would have called the cops. You dont carry a weapon while drinking. It is dangerous and illegal. I am a cop and wont drink a beer and carry I expect the same from everyone else. It is part of that "responsible" gun owners thing.

Bottom line....drunk+gun=trouble. I'm glad he called the cops. And if the guy wasn't a threat it's better to find that out under the security of trained officers just in case.

Actually there is no general statue in NC that prohibits the open carry of a firearm while intoxicated. The law does prohibit the concealed carry of a firearm while intoxicated only. I am a deputy and we went over this in detail last year during an in-service training class.

When it comes to firearms everyone is a RSO (on or off the range). If you see something unsafe happening with a firearm you are doing the right thing to report it. In most places conceal carry is prohibited (or restricted) by law where alcohol is served.

If a drunk is carrying it in his hand call the cops, if in a holster let them go.

Actually had a situation at my daughter's friends house. The dad and his buddy had been drinking and shooting a rifle( there was a river and open area behind the target). There were kids around, I made sure I and the kids stood behind them at all times keeping an eye on where the kids were and the rifle. After a while, I said I was not comfortable with it and left. My daughter wanted to stay with her friend, so I told her, if they continued, to stay in the house which was well behind where they were shooting.

After 2 drinks at a bar, I'm certain that I would be considered drunk if I chose to drive. After 6 drinks at the bar, I'm positive that I'm perfectly fine to drive. I would never want that scenario to play out with a weapon in the mix.

I agree, snitches suck, but if there is drunk driver, or a serial killer, then the police should be informed, I'm not worried about nonviolent crimes, like drug use, none of my business.

State troopers in Pennsylvania told me it is not a crime to be intoxicated and carry. They also added that your attitude dictates if they take your gun. This is a public/personal safety issue according to them, and if you are just going about your business they won't bother you. 4 troopers told me this, I was surprised and asked them to repeat it and they did, I live in Crawford County, Pennsylvania and it is very gun friendly, maybe other places have different outlooks on this subject.

Well. Depends on the person id say. my rm/best friend at the time got drunk and got into it with his cousin.only gun he had in the place was his ak47,his fiance told me he was going to use that to kill his cousin who lived 4 doors down,sure enough he came downstairs with it,so she of course asked me to do something(I was drunk also)so while she distracted him,I stripped it down and hid all the parts around the house...handed it back to him and told him "here ,now all you have is a club" He was pissed(we ended up knocking the snot out of each other) but next day thanked me and we also had a weird scavenger hunt as I ended up forgetting where I hid the spring. Thats the only time ive been around someone thats lost it around a firearm while drinking. (I quit drinking 5 years ago also so I try to not be around drunk people as a rule,too volatile)

I think he did think he did the right thing. First anyone carrying Mexican in basketball shorts already isn't in their right mind. Especially for the normal ccw holder. It just wouldn't be common. Then you add being noticeably drunk on top of that, that a problem. It's a misdemeanor already and depending on which state, the class of misdemeanor can vary. Ccw can be revoked and you can lose your permit. If it's against the law to be drunk and carry even with a ccw, I'd be concerned if I saw what he saw. I mean, c'mon, laws are in place because of idiots like that in the first place!

If they are in a public place yes call the cops but if you are say camping or in the woods or something and drinking go for it

I'm ok with what our whistle-blower did. I think I might've tried to get a little more information about the guy's state just to be sure before getting the cops involved too. If I say "howdy", how does he react? Slurred speech? Friendly response? Jerk? I've been around enough drunk people to know that an experienced drunk can probably function better than many sober ones. If in doubt, call the cops. It's better to have that guy checked out by professionals with partners before he makes a bad decision and chooses to hurt someone. Not to mention, a ND might be more likely when falling through the basketball shorts.

The type of gun, how it is being carried, where this occurred... all irrelevant and immaterial. The only two questions that need answered are 1) Do you believe he's intoxicated and 2) Is he in possession of a firearm. If you answer yes to both, it is your civic duty to report it. Responsible, law-abiding CCL holders don't need people like this in our ranks. We have enough of an uphill public image battle as it is.

I'm actually curious, if I'm in my own home drinking and someone breaks in and I shoot them, would I be charged for being intoxicated with a firearm or am I legally protected in my own home by law?

Booze and guns do not mix, any more than booze and cars. I first took offense to a sign on a local restaurant that said patrons could not carry guns (PA is an open carry state, and you can get a concealed carry permit) until I realized that it has a bar. The bar is the only legitimate reason to tell patrons to not bring guns onto the premises.

To me it depends on where you live and the laws there. Colion stated he didn't know of a state where you could carry a firearm while intoxicated but I live in an area where carrying a firearm while intoxicated is in itself not a crime. You have to be intoxicated and actually use your weapon in a criminal or negligent manner before it is deemed unlawful use of a firearm. I'll quote the active police Sargent that owns my local firing range "you can be drunk, stoned, or high on any number of illegal substances or even commit any number of other crimes with a firearm on you but until you use the actual firearm in a criminal manner we cannot charge you with unlawful use of a firearm" he goes on to saw that the change in the law which happened a few years back was not popular with the law enforcement community but it is what it is. So here merely seeing a drunk person put a gun in their pants is not something I would call the cops over but I would watch him like a hawk. In other states with differing laws my answer would adapt to those laws

I wouldn't have called the cops because their could have been unintended consequences. More people could have gotten hurt when things escalated with the cops showing up- you just don't know. Plus, you could have cost a man his job if he was unable to get to work the next day. I definitely would have kept my eye on him while in the restaurant.

Well, now that you bring it up, what would someone have to be doing with a firearm in public for you to make the decision to draw YOUR firearm and attempt to remove his firearm from his possession? Or her. Wow. What would a LADY have to be doing for you to attempt to remove her firearm from her possession?? Very curious here. Given the circumstances of the situation I think you made the right decision. Being as someone got out of their vehicle and was acting intoxicated and you seen their weapon I would have probably made the same call. In my own opinion the major problem with this situation was that he was intoxicated but the second being that the weapon was not secured in a proper manner, which I think shows recklessness. Now if the situation was different being if you seen someone had a weapon that was concealed properly that was eating dinner and clearly not intoxicated I personally can't say that I would say nor do anything about it. This person was being reckless on multiple levels, the fact that his weapon was not secured before he left his vehicle and that he wasn't even holding the gun properly is a big problem.

Perhaps you may be a part of the problem with society the way you draw your thoughts. Too many are scared and focus on what could happen or what one might do. Instead of focusing on what did happen! One cant be willing to value their own fear over anothers rights!

My personal motto is never call police for anything. They dont help anyone around here. If no one was harmed or in immediate danger your just a snitch!! Who did you save? If you cant answer that, then ur snitch was pointless.

I think that what this guy did was correct for him. He did not feel safe with the situation.

I would never call the cops on a man sitting, standing or walking around in a restaurant that is minding his own business and not causing harm or discomfort to anyone there. It matters not how he's carrying his weapon or the brand of weapon. And weather or not he has a ccw isn't your problem or business. One thing that's fact is, he might've just came from the gym and hanging out with friends or simply stepped out the house quickly to pick up food for his family. We dont know his situation or is it our business until he makes it our business. And now, he didn't make it back home. He now has lost his weapon, ccw, thousands of dollars for legal expenses, maybe his job and most importantly strain has been put on his family. All for what? It would've been a very noble thing to do if he was an immediate danger to himself and others.

I absolutely felt compelled to comment on this situation. I am a CWP holder. Without foreknowledge lets assume the gun wielding person also is a CWP holder. In my state you are NOT allowed to enter with your CW any establishments licensed to dispense alcoholic beverages. So no bars, no Olive Gardens, and no Applebee's. So even if he WASN'T drunk he was in violation of state statutes for a CWP holder the same as if he tried to walk into a courthouse or a school. So he is breaking the law just by being in the building. And in fact making every other CWP holder look bad.

When you get a CHL and start carrying, you give up certain things. I can't drink and carry (I don't drink anyway).I can't intervene in a fight. I can't walk toward a situation that could escalate. I have called the cops when I have seen an obviously intoxicated driver, I would do the same with an intoxicated person carrying a gun unless I felt I could approach them and get them to disarm.

This is what happens when you live in a police state like Nazi Germany and everybody who "see something say something" probably just messed that dudes life up, Also do you know how the man act's normally or when he's drunk no? mind your business until trouble calls then make it your business.
