In this video John discusses how to handle when police come to your door. When police come to your door without a warrant and attempt to interact with you, it is called a "Knock and Talk". This is a legal means for law enforcement to investigation; however, your rights still apply. You should protect your rights by not allowing police access to your home without a warrant. You should not give them exigency or a basis to enter your home. Additionally, you should be respectful, while protecting your rights.
You can say, "I'm not speaking with you without my attorney" and "Please leave my property". Police will either act and force entry, obtain a warrant, or simply leave you alone.
Remember, "Jerks go to Jail" be respectful.

If your DEFENSE attorney asks whether you "did it", then do not answer and IMMEDIATELY FIRE THAT ATTORNEY. There is no reason to disclose that information to anyone. Your attorney's job is to keep you out of the defendant's chair, keep the govt honest and win an acquittal by using the govt's evidence.

@@MgtowRubicon Probably true sometimes, but not always. I can think of a lot of circumstances where that info would help me do a better job in defending my client ... ie a case where the prosecution has an overwhelming case against my client. Not every case is winnable and sometimes damage control is what is in the best interest of your client. As Kenny Rodgers said, "You got to know when ta hold em, know when to fold em."

Wrong - *do not open the door.* As soon as you do, one of them will put their foot in the door, preventing you from closing it. If you try and close it they will say you attacked them or tried to injure them by closing the door on their foot.

Don’t open the door and don’t talk to the police. If they have a search warrant to enter the cops will enter right away (okay maybe in a minute or so). Just talking to them the cops escalate. Opening the door the cops put their foot in the way so you can’t close it.

Opening the door makes it hard to get rid of the cops. Most cops put their foot in the way of the door closing. They can lie and say they see this or smell that to legally enter even if illegal. You can fight the illegal acts in court but you were still violated. Most of the time the cops end up leaving if no answer to enter your home.

I don’t agree with much of his advice, but at least he addressed the “plain view doctrine.” As he said, once you open your door, the cops can claim they saw, smelled, or heard something that will now allow them access to your home without a warrant. Opening your door and engaging the police creates a potential grey area. Remaining silent and keeping your door closed and locked delivers an unequivocal message. Also, when you open the door, it now gives the cops the opportunity to claim that you invited them in. You have rights. Don’t be afraid to use them.

Like other posters said about not opening your door, just talk to them through your Ring door bell like any other salesman. And this ignores the fact they may want to talk to you about your neighbor and aren’t interested in you at all.

I was mowing a yard in a professional capacity and the police officer asked me if the home owner was home and they went and knocked a few minutes and came back to me and tried to serve a warrant to me to search the home they apparently thought I was pretending not to be the owner and they threatened to arrest me if I didn’t let them into the house I had keys but the officers were not allowed in they kicked rocks 🪨 !

Jerks go to jail. Great advice. If you are not guilty of anything it doesn’t mean you have nothing to fear. But if you keep things in a positive light, you are less likely to have your shoulder dislocated.

This is why I have a steel screen door with double dead bolts that lock automatically, they cannot open that door. I had them come two times, both times they yanked on that door, it would not budge. I opened the door the first time and asked if they had warrants, they refused to answer, so I stood there looking at them, they kept asking question after question, after 2 minutes, I finally laughed at them and closed the door. The second time I didn't bother opening the door but used the intercom and asked what they wanted, they just wanted to ask talk about an incident that happened 4 houses down. I told them to go to that house and ask them, I don't live there. Not that I hate the police, it's just that they lie like politicians looking for votes!

Maybe not the best advise to step out and talk to them. In many videos we see the police literally begging the homeowner to "come out and talk to us". This is in order to bypass warrant requirement - once you are out, you lose home protection. Check out the video of the arrest of Ron Marshall in Ohio, who was collecting signatures in his neighborhood - first the cop insists that he comes out and "talk like a man", and as soon as he does, he is arrested on fabricated charges of obstruction. If he did not, the police would need a warrant.

Police putting their foot in the door is not legal but I have yet to hear about a cop getting in trouble for it even though it is in violation of the 4th amendment. I wonder why that is.

I have a regular door and a screen door. I always keep that screen door locked. I have seen cops open the screen door, knock and when the unsuspecting homeowner opens the door and the cops barge right in. Saw it on the first 48. I realize that the screen door is weak and can probably be yanked off the hinges. The best practice is don’t answer the door.

Thanks for the great advice. I have a question...I have seen videos where the police will stick their foot in the door once you open it, even if they do not have a warrant (some say they are waiting for it as they keep the door open with their foot). I know the best way to avoid this is to not open the door, but what if one finds themselves in this situation...they won't let you close the door and they have no warrant?

Stay strong and continue to deny access. You may call the station and ask to speak to a supervisor. As I told Tom in an earlier response, what you don't want to do is allow them to create an exigency to enter your home without a warrant, which can happen, if they believe you are going to "destroy evidence" or another alleged exigency.

Don't answer the door. No law requires you to answer a knock on the door, just as you are not legally bound to answer the phone. Let them stand out there and talk amongst themselves.

Tom, ask them to come back with a warrant and deny them access to your home. Officers may enter a residence, if they believe exigency exists to escalate the situation. So, stay calm and politely ask them to leave. You may call a police station directly and ask to speak to a supervisor, if nothing else works.

I had 4 officers in my living room questioning for hours I need an attorney asap !! I have contacted all law enforcement in Beckham county and no one gives me answers I’ve had 33 cops at my house I told them I have a gun and yet last night they were driving by my house at 3 am I called and filed a complaint these officers were from sayre Oklahoma yet they were driving around in elk city 🤔 I have filed many complaints!!!!

you forgot to say that if you have a window next to the door like many homes do, that you should partialy open the window and speak to the police that way, you should never open your door for the police unless they have a warrant, if you do even a crack like you said the office "may" stick his foot in the door and if you try to shut it they will claim you assaulted them and come in and arrest you, so only speak to them thru an open window closest to the door DO NOT OPEN THE DOOR PERIOD...

Is it normal for three police officers to come to a home for a wellness check? Because a couple of years ago, one of the candidates for mayor in Claremore, Oklahoma called the police. Which came to my families home. Due to the fact they smelled something. That was due to the cats in my house. And why wouldn't they also have an ambulance come as well, if they were truly doing a wellness check?

@@lordraydens Yes, especially the police here in Claremore, Oklahoma. You can research people like Officer John Singer, the legel issues that the Roger County Sheriff and his jail have brought on themselves. Which if you go through microscope of truth on Facebook. You will find different court documents and news articles about the ongoing problems with the entire government including the police.

In what twisted world does it make sense to call men with guns to check on someone's "well-being"? If they weren't OK to begin with, they probably won't be after the cops get there, that's for sure.

@@thewrongstuff1 Well I have no idea, because when my neighbor on behind me got a wellness check. They actually sent an ambulance to the house to check on him. So I was not buying the wellness check excuse. Especially with three cops, who parked in front of the neighbor's house to the east of me. Which one of these cops had already been noted as someone willing to plant evidence. In order to justify his lackluster behavior while making contact with a person who was filming in and around the local post office. (This cop got promoted as well to sergeant in charge of the patrol division) (So in government at least you can fail falling up, and people seem to be fine with it.) Needless to say, if there is a good example for the criminals running the government in a city or county. It is Claremore, Oklahoma in Rogers County. Because if you can fail falling up, it is here in my local. Since we have officer John Singer, who not only lied about why he was fired from his job, before getting on the CPD. (Due to the fact he was caught stealing) Lied on the actual reason he got into a wreck. (By stating he had hit a deer, and covering it up by applying deer hair to the front of his patrol vehicle). Lied on a sworn affidavit, and in court. Which is all in court documents that are online to see. Oh by the way officer Singer not only has kept his job. But has been promoted to being in charge of the detective division of the CPD. He is also cross deputized as a federal marshal as well. Plus we have officer Sherman, who on his off time called a female up, and got her to come over to his house. Then got her to let him see her cell phone, then stated he was keeping the phone for evidence. Even though she was not expected of a crime, which there was no warrant or even probable cause to take or keep the phone. Then when her attorney went to retrieve the phone, the cops at CPD would not return the phone. So that was heading to a lawsuit, and I have no idea where that case was at. Which brought to light that the practice of stealing cellphones from people happens fairly regularly and is a unwritten policy within the Claremore Police Department.

What about a cop that bangs on your door, no warrant, then starts banging on your back door so hard a large picture fell off the wall. I was scared to death. Somebody had changed my license plate. He threatened to arrest me. I did not let him in the door but he wanted to see my license and when I got it he opened the door and walked in the door.

Liz, I'm sorry to hear you experienced that event. Officers can get over zealous. It is important to try to stay calm and call the police station and ask to speak to a supervisor. In some instances, you may be entitled to seek compensation from law enforcement for improper conduct.

I would not open the door for the police or go outside. If you go outside you have lost your protection from search warrants. If they insist to talk they can talk through the door; otherwise, lawyer up until they leave.

what do you do when after paying $30,000 retainer you ask your lawyer the same question twice, because the divorce is getting really contentious,and you hired a lawyer because of the stress, and the lawyer turns to his colleague and says "it's like talking to a brick wall" ? and when I spoke to the owner of the law firm he said you can file a complaint and it will take 3 months to get back to you. Do I trust the lawyer anymore than I would the police ? What do you think? This is a genuine question.

That’s one instance. So because of that one instance where instead of doing your due diligence you went with a shitty lawyer does that mean all lawyers suck? Or even the majority? I doubt it. You taking that view point of they all suck will not likely lead to anything good for you or anyone else, it rarely does for someone who’s perception is willfully skewed.

@@colbyd.5044 I sourced 4 lawyers and was told these were one of the top 3 in London. I did due diligence, a lot of it , the lead lady was incredible and had she been able to complete my case I truly believe all would have been fine, it was when the two d.......d partners took over it went downhill and I moved firms after wasting a lot of money. Having dealt with lawyers several times over the years the instance of great was 1 out of 10. That is the experience of an intelligent consumer. If you believe anything different you have your head in the sand!

I hired a divorce lawyer and I would call him to ask questions and he never returned my calls and never talked to me until we meant in front of the judge and he started asking me the same questions I wanted to ask him so I would be prepared and then he had the balls to scold me for not having the answers. Then I later found out that he was talking to my wife and giving her advice. So who is worse police and judges or lawyers? It’s a toss up. But lawyers take your money and say they will help you but many times they are only helping themselves so that could make them the worst of two evils.

Don't open the door. I opened the door for them, and had them lie to enter my house looking for someone that lived there before us when I was right out of high school rooming with a couple friends. Rather than admitting that they were wrong when they entered, couldn't find the guy, and asked us to show them that he wasn't on the lease they screwed us all over instead because there was some alcohol in the house, and we were all under age. Since then I've only had the cops come to my door once, but I did not open it, or talk to them.

Question; So what about when the police enter your place of business instead of going to your home?? What rights do you have then??..can you demand them to leave after refusing to engage in conversation even though your store front is open to the public. .???? Thank you!

Funny how laws consider law enforcement can lie, and manipulate citizens, yet it is unlawful if citizens do same. Attorneys do nothing to contest, equal rights of this country. Attorneys don't even try to prevent the unfair rights that police have, for the literal criminal activity they do. Police contracts even permit, said criminal activity, which, by law, are unlawful.

Richard, great question. Many times are words can be twisted and if the police come to your door, it is typically not for your welfare, rather it is for a criminal investigation.

One day, I was sitting at my computer with my headphones on. My back was to the patio door, which was standing open. The gate from the parking lot to the patio was unlocked. I became aware that I was not alone and turned to see which neighbor had wandered in to socialize. To my surprise, there were two uniform officers standing in my kitchen with me. Turned out they were looking for someone who had given my address when they were arrested and bailed out. After I established that I wasn't that person and let them search for that person, we talked a bit and I asked if they were allowed to come in unannounced like that. They said they had a warrant for a person at this address and that they did announce themselves, but I had my earphones on and didn't hear them. He said they were about to move into my peripheral vision to get my attention, but I noticed them first. I probably did that wrong, but I knew that I had committed no crime and that there were no illegal substances on the premises. I decided cooperation was better than confrontation.

This is all terrible advise. I always recommend speaking with police officers if they want to chat. They offer some very amazing services no matter what position your in whether innocent of any crimes or guilty. They can help remove dangerous drugs from your home or help you stop raping children and so much more, so always talk with police and if your married to a police officer ignoring them as suggested in this video would be rude.
