Dave is super wealthy so he doesn't remember that the ordinary person will never pay a cent in gift tax. For some reason Dave gives a lot of wrong information about estate planning matters. Here's how it works: The $15k per year is called the "annual exclusion amout", which is the amount you can give per donee without being required to report the gift to the IRS. If you give more than 15k per year per donee, you must report the gift on IRS Form 709, but there IS NO TAX DUE until your total lifetime giving exceeds another limit called the "applicable exclusion amount". This amount is your combined amount of lifetime giving plus giving after death through your estate that will be completely exempt from gift and estate tax. The current applicable exclusion amount is about $11.5 million, indexed for inflation. It will sunset to $5 million indexed for inflation in 2026, but any gift tax exclusion used before 2026 will not be affected. If you are married, you can "split" a gift and effectively give $30k per donee per year without using any of your exclusion amount, but you still have to report the split gift on Form 709. If you are blessed enough one day to exceed the applicable exclusion amount, the current top tax rate on thise gifts in excess of the exclusion is 40%.

What did he say which contradicts what you wrote? He gave general information and to double check everything before you gift to make sure you're not hit with a tax. Do you think he should have left that information out?

@@larrybud He very clearly said if you give more than $15,000 to an individual you will be hit with a gift tax "upward of" of 50%. The minor issue of exaggerating the tax rate aside, almost no one will ever exceed the lifetime exclusion and owe any tax. It's a tiny fraction of 1% who will give away more than $5 million during their lifetimes, much less the current $11.5 million exemption. Moreover, he is addressing a question from someone who stated he is in a position to give for the first time in his life. The information given doesn't match the situation of the person asking the question or the situation of the vast majority of the audience. I am particularly sensitive about Dave giving bad estate planning advice because I have clients resist following good legal advice because they heard Dave Ramsey say something different, and I'm sure I'm not the only one. We're not talking about a difference of opinion here. These are factually incorrect statements of how the tax laws work.

@@Zachary_Setzer He said to get advice from a tax expert on your individual situation. He's talking to a lot of people in different circumstances, just laying out what could happen before you make this decision.

I'm afraid I just don't the the same joy/feeling Dave talks about when giving to a non profit. Just being honest and I don't know where that money is going despite whatever the group may say.

So why give through an organization if you're worried? Find ways that you can give directly to the causes that you value. He often tells the story of the guy that spends like 50k a year on bicycles and hands them out in a poor neighborhood to the local kids at Christmas time. No mistaking where that donation went at all. He literally is handing the bikes to the children himself.

My takeaway: when you become too generous with your money (that you have already paid taxes on) and decide to bless other people, the IRS gets jealous and demands that you give them half of it out of spite.

You did not mention a Trust. Example is if I wanted to donate a Vacation house to my fire station. The membership at the fire station say they want money, you so no you can have this vacation house that is in a trust... You can use it for fundraising vehicle, but you can not sell it! ect.... Generally the the social members would do the up keep of the house and either they rent it out or a realtor would rent it out. Profits go to the fire station.

You can gift 60,000 to a couple as Dave explains with no gift tax. Most people wouldn't want to carry around more than that much cash to gift it, all while committing a felony in the process.

Yes. You even make an upfront contribution of $60k to a 529 plan and average it over 5 years ($15k a year)

@@sethbender2863 hi Seth, Dave was wrong in his response. The 15k is 'the annual exclusion amount' this just means any gift value above this needs to be recorded with the IRS via tax return which will be deducted against your 'applicable exclusion amount' - which is currently 11.5 million in your life time + after death via your estate. In summary, you won't pay any gift tax until you gift more than 11.5m, and you are taxed at 40% above this, not 50% as Dave said.

"When you start giving, that's when you become an adult." Eh...not sure I agree with that, that's almost an elitist type statement. A lot of us don't "give" per Dave's terms, but I always thought donating the odd $50 to someone's walk for cancer or taking stuff to Goodwill 3-4 times a year, or donating time was just as good as giving a bunch of money. You don't have to "give" to be an adult, what a ridiculous statement.

Depends how you approach it. Some churches help with rent, mortgages, bills or food. Maybe you're good friends with the single mother but don't want to make it awkward or strain the friendship by involving money, but you want to help her too right? So involve the pastor/bishop in having the church quietly pay her rent for her, and say it was a collective 'gift by members of the congregation' to keep it anonymous. Dave was throwing an example of generosity out there without giving a good process behind it
