Lucinda, I was threatened with termination if I did not return in the approved leave time from my employer HCPSS, not once, but twice for two disabilities covered under the ADA, Major Deppressive Disorder and a Knee Quad Tendon rupture repair. This was actually put in writing in both leave approval letters. I took FMLA for 1 month for the MDD and another month for the Knee surgery. I was terminated two years later for Willful Neglect and Insubordination as I was capriciously and arbitrarily placed on a PIP despite not having any unsatisfactory observations or ineffective ratings. I was forced to push a cart to 4 different classes on 2 different floors with no assistance in a mechanical brace and required to do more work despite my mental illness. Waiting to hear back from the Federal Judge on the Defenses Motion for Summary Judgment (May 7th) and my response filed on May 28th. In the meantime the defense refuses to offer a reasonable settlement. I’m presuming they are waiting on the judges response. Thanks for sharing this information.
