The Sergeant and the officer messed up overall, but the kid also had the law wrong. The kid was complaining about it being a "Terry Stop," as if it's impermissible, but Terry Stops (also known as a "stop and frisk") are allowed whenever an officer has reasonable suspicion that a crime is being committed. It's debatable whether they had that reasonable suspicion simply based on a call that the kid was filming the nursing home, but let's assume they did. In that case, the officers are allowed to detain the suspect and conduct a frisk of their person to feel for any obvious weapons or contraband. The officers may seize anything that obviously feels like a weapon or contraband, but they are not allowed to conduct a full search of the suspect's person and immediate "wingspan" unless they arrest the suspect first or have a valid warrant. However, the officer requires probable cause to conduct a lawful arrest, which they certainly didn't have here. The sergeant was right to detain the kid until he figured out what was going on, but he was wrong to place the kid in the squad car (technically an arrest), and he was wrong to search the kid's pockets. Furthermore, anything the kid said from the moment they put cuffs on him would have been inadmissible in court against him because they did not give him Miranda warnings.

Yep, that’s the unfortunate reality…the duty of the police is to know the law completly in order to provide authority and the duty of the citizens is to ALSO be educated in the law to prevent tyranny…yet both cops and citizens fail in that aspect most of the time, it’s unfortunate

Best case scenario, criminal justice degree, but that's a longshot, they're just the ones who make up the pseudosciences that get taught to cops. This is true, they themselves have to ask lawyers what is and isn’t legal and how far they can go without overstepping (at least the good ones do). But reality is that most citizens also don’t know jackshit about laws and they misinterpret them all the time. They were 100% within their right to detain him and that includes handcuffs while they figure everything out. I know most people coming here want to hate on cops and although I have my gripes with them, I also have to be logical about these situations and not just blinded by hatred.

It was probably Chris's friend that called the cops at his request. He was clearly f***ing with them trying to get them to slip up, maybe collect some easy money or a good video. 2nd cop realized pretty quickly what was going on and explained everything before letting him go. 1st cop was mad af 😂 Chris probably would have gotten what he wanted if the 2nd guy hadn't shown up.

That last cop was amazing, not only did he have the patience but he took complete control of the situation and only asked what happened whether question the suspect, he listened to him and even tried to calm to let him know "look I'm only here to listen to you and your side of the story". I totally understand Sedreick. I was a paper boy in high school. The Sunday papers for delivery arrived on late Saturday night. You had a choice: Get up immediately before sun rise and deliver over 70 or more papers, depending on what route you were assigned. Or, get out there at 1 or 2 am and deliver the papers. Sunday folks want their paper first thing in the morning. It's unbelievable a sheriff who admits to fabrication is found not guilty. But, glad Sedreick won a 500k. He doesn't have to deliver papers anymore.

we had a case in Adelaide south australia a few years ago. a couple of stupid overdressed rich girls decided to walk to a friends place in the early hours. safe in adelaide they saw a newspaper delivery guy in a van assumed he was a rapist because they were irresitable and they called a friend. He shot the newspaper guy. poor bastard lost an eye. i feel for guys just doing their job.

​@FiregodJMM - When you say "combative", what came to mind was physically combative to the point that he needed to be in cuffs. When I re-watched the video he didn't fit that at all. As a matter of fact, despite his anger and verbal outburst (understandable, considering he might have been racially profiled), one of the cops did his job very well by doing de-escalation. Notice he slowly calmed down, thanks to the cop's de-escalation. Sedreick despite his understandable verbal outbursts was fully complying with officer commands.

In reality, the sarge was just making things worse.

The sad thing about this is that there is only so much frontage to that nursing home. Therefore for someone to notice him filming, get bothered, call the police and have them arrive while he was still there means he was likely out there filming the nursing home. Which I understand is probably not illegal - even if the blinds were open. However it is odd and it would bother people. Reverse the situation and plenty of people would bemoan the fact that the police can't do anything about the creep filming their grandma in her room. All in all smells like cop baiting. Which I have mixed feelings about.

@@silhouettefadeswell that’s not quite true…it’s a cops job to know the law better than a citizen by far (or at least in a perfect world both cops and citizens should know the entire law) but cops are actually specifically trained on it…some cops don’t know the law at all but generally most cops have a higher informal education of the law compared to the average citizen

@@user-hv8vo2se1q incorrect. Cops spend at most, 2 weeks in traffic law classes and that's it in the academy. My cousin went through it. The rest of the time is spent on weapons training exercises. Most don't even remember what they was taught just 6 months after the academy and only know simple stuff like speeding and seatbelt violations. They bank on the hopes that once they run a name, it comes back with a warrant or that they'll find something in the vehicle to arrest them over. The actual percentage that knows actual laws beyond just a few traffic infractions is around 1% of all cops.

Should be reason to have their badge revoked and them no longer being able to work in any governmental facility or installation. They've shown their malicious intentions and the length they'll go to act them out. No need to concern the system or the people with them in the system any more. That should be a 1 time and you are out. No warnings.

I believe only one prong made contact meaning that the circuit required to actually give a shock wasn't completed. He would have still been in pain from the prong embedded in his arm but it's nowhere near enough pain to halt a human running for their safety. In all honesty, he probably didn't even feel the prong go in if he had enough adrenaline in his system. I had a friend who got his face sliced open by a knife and he only realized it after he was safe and the adrenaline wasn't in his system anymore. Humans are built, like every animal really, to fight to the death and the brain uses adrenaline to numb the pain or remove it entirely.

The wild how he says that as well, because I’m a criminal justice major, and only 1% of policing is college taught. And with that 1% they get the least complaints. Honestly makes since! technically need no schooling to be a cop, just the info you get while becoming a rookie. Cops should need at least an associates. So they are educated fully on their job! Far too many complains are for walk in cops that aren’t pre-educated about their job. It could help out soooo much!

A good 90% of the cops employed in the states don’t even have their own degrees in law. You can become a cop with a GED or High School diploma right after graduation. They also don’t even know the laws they’re enforcing 95% of the time, and most of those laws are concerning the protection of property, not people.

That's way more than enough to put a member of the public in jail. The subtitle has since been changed. He took retirement instead of being fired. It's the epitome of the "Good ol Boy Network" at it's finest. As long as the law enforcement and judicial systems enjoy the luxury of policing themselves (and, let's not get into the Qualified Immunity thing), they'll continue to "protect and serve" themselves first. Also, I'm not a past or current law-breaker pouting sour grapes or anything. At fifty-nine years of age, my eyes and ears work quite well enough to still come to an educated opinion. I mean no insult to you either because tone of voice and facial expression get lost in the written and/or typed word making one's true intent almost impossible to figure out. Readers and commenters are left to fill in the blanks of intent themselves...and, more often than not, commenters are wrong in what they say just for the reasons I've mentioned (including myself at times).
