Several high-profile incidents have seen someone refused service by a business because of someone's personal beliefs. But is it legal? We breakdown the laws for you.
The Supreme Court did not rule in favor of the Cake maker. They ruled the state treated them unfairly because of past cases where the state had ruled differently for similar actions. This in no way says discrimination against gays from businesses is legal under the constitution.
The constitution is subordinate to the natural law. And private property is a fundamental natural right that includes anyone the right to deny service to anyone, for any reason. "being gay" is part of "any reason". It is an absolute term in case ye didn't understand that which means without limits or exceptions.
Free market system, certainly businesses can refuse but they do so at the risk of the popularity of their business. The market self corrects in that way. Making additional laws and regulations isn’t necessary
A law is quite necessary if it's a business like a pharmacy. I don't care about a bakery refusing to make my wedding cake but if a pharmacy refuses to deliver important medecine because of my gender or my sexual orientation, it can have dangerous consequences, especially in rural areas.
If you are a "public business" you are given a business license. By operating as "public" you are agreeing to serve the public. In society we have laws against discrimination. If you want to be a bigot then you can't be a public business. You need to open a private "bigot cake club" or something. The idea that businesses "have a right to refuse service for any reason" is not true and not legal.
they always refuse me service because I'm a indian male and other reasons , there should be a law that says you can't refuse service for any reason discrimination is discrimination, you can't refuse service because of race which is discrimination but refusing some service say cuz you don't like them is also desrimination too .
@@CaptainOnePocket ''''''If you are a "public business" you are given a business license. By operating as "public" you are agreeing to serve the public''' i think you mean they serve the public they are private stores that serve the public if they were public then they would not be able to discriminate against anyone but since they are private they have the right to refuse service to anyone
So basically woman who doesn’t like look of you can say no we not serving you is that correct. Happens too me I walked away but feel totally discriminated against. Anyone’s who knows how too deal plz reply. Is so unfair and unprofessional.
first of, I am a Trump supporter, but I think the resteraunt has the right to refuse service to someone because of their political affiliation...show me where in the Constitution/Bill of Rights it says otherwise You can't refuse service because of race/religion/gender, and similar things, but there's nothing about political affiliation. Honestly, I think you should be able to refuse service for ANY reason, even those listed above... IF people have a problem with it, they'll go elsewhere, and your business will suffer and go out of business.
It is quite simply. Anyone means "anyone" and for any reason. It can be because the owner don't like the person, it can be because he feel insulted, and it can be because he just actively discriminate against a group he dislike. But he have the right to do so, because that is what private property means.
If businesses have the right to refuse for any reason Then racism and segregation still exist in a way ! ...for any reason. Disruptive customers do not count!
We don't need more laws constraining individual right to freedom of conscience, forcing them to lend their art to lifestyle events and activities they don'tagree with. You can't force someone give up their moral principles in their own place or threaten their livelihood. How mean spirited. Sounds like some totalitarian gov. Many churches will not officiate gay marriages on their property. It's their constitutional religious right. Take your business to other places that do, but stop bullying, picking on biz people of conscience living peaceably with others and stop litigating hatefully. Practice grace, work it out. Have you tried to work it out peaceably? Buy the cake and design it yourself?
