I work on a horse farm training 0-3 year olds. I got hurt and made a claim and man did I get put in the doghouse at work! My manager made work hell for me. After being self employed for almost 2 decades I’ve never experienced anything like that. I’m blown away
I was fired unlawfully from the Kroeger in 2016. I was set up by the area district manager and also the HR director. I filed for unemployment and was denied.. No money for 3 mos. I filed an appeal and lo and behold the termination was unlawful according to them so I was awarded 9300.00 for my claim. I tried to find an attorney to get help however I couldn’t locate anyone during that time frame. I had a good case against them and I would most likely have won. Social media didn’t have resources as they do these days. So thank you for being here for the people. We all need the help sooner or later it seems these days‼️👍😃

I used to ‘register’ complaints for the EEOC & this guy is 100% correct. Another horrible secret is that they purposefully take around 2+ years to even ‘respond’ with any results after they receive a complaint - so if someone is getting screwed by their boss, they are better off quitting than even filing an EEOC complaint. Only people with lawyers are taken seriously - you have to have your lawyer do all the communication - but still are not guaranteed to get any restitution. And… the worst thing is that the EEOC is ‘buddy buddy’ with all the ‘employers’ so they get on the phone & just laugh at the employees behind their back - knowing that they will just fire the employee - even if there is clear proof & witnesses who saw & testified about the discrimination or abuse. The EEOC is a joke.

My wife was represented by an attorney then the same day my wife notified the EEOC investigator the attorney actually went to work directly for the EEOC and was closing his firm he replied 6 hrs later saying they was closing the charge and a right to sue letter would be issued. The position statement wasn't even submitted by the companyyet. She requested that and sent her rebuttal the EEOC then placed it in a supervisor investigation and a notice her charges was identified as appropriate for ADR . THIS WAS AFTER HER FIRST INVITATION TO MEDIATION. The company rejected the second session and a right to sue was issued. She got the ROI and nothing was even questioned by the investigators to the company. When you say they don't care I say "ANYONE WATCHING THIS BELIEVE HIM" they dont. Mind you the position statement was a complete lie and she supplied everything to prove it. Waste of time and effort.
My company failed to provide special accommodations 2 times. And 2 times Legal teams reports no case because i was never terminated. So I guess the moral of the story is the corporation can keep forgetting the special accommodations and and not fire you but hoping you will quit the job.
Often in court, standing must be established. Someone can say they are being hurt by their employer, but until the damage is measurable, the case is weak.

I filed a felony wage theft complaint with the labor commissioner in California.The labor commissioners office jumped down my throat when I asked about who handles the criminal aspect since they only do the civil side.I finally got someone to respond and said "the local police but chances are that they aren't going to do anything".Woman at the sheriff's office already had a prepared blow and said that "You cannot prove intent" and they refused to even review my evidence.While I am waiting for my civil hearing this bastard robs me again.I confronted him about it by text message.When I came to work the next morning there is a sheriff's deputy sitting in the parking lot waiting for me and telling that I am fired in retaliation for filing a felony wage theft complaint against this crook.The incompetent and insanely corrupt California labor commissioners office bowls me over in hearing despite 400 calls to lawyers and 3 of them with retainer agreements none of them appear at the hearing.The the same county courthouse loses my request for appeal 4 times in a row.The employment department denied my unemployment claim because turning your employer in for felony wage theft is against policies.I blame the lawyers for allowing things to get this fucking bad!
What's worse is if this was in a one party state, you'd likely be able to record some of what happened as evidence. Since it's California with a 2 party recording law, you can't do shit. Also, if it's felony wage theft, then you can record it because it is a crime to do that. Sadly, Commifornia ruins another life with 2 party recording laws. I learned the hard way that if your employer violates FMLA and ADA after a series of mini strokes; that something has to be filed with L & I in order to sue. Unfortunately being cognitively impaired, I didn't know this. It meant no one would take my case. Another employee got representation and won. Now it's too late. I learned that a 20 year employee with a service above self award and nearly all Exceeds Expectations mean nothing with a bullying new boss. Now drained all my retirement 401K just to stay above water. I learned that there is no Healthcare benefits when for ed into an early medical retirement. I learned that absolutely no one at the huge Healthcare Provider ( I worked in one of their hospitals) doesn't care.

Can I make a legal argument to my employer they cannot require me to work on the weekends without compensation of some kind? Things only turn out this way if the offender was an employer. Employment law in the US is truly fucked up. The laws are not on your side. They are on the employers' side because the lawyers for our major employers own our lawmakers and write our laws.
I worked for 21 yrs (aka 21yrs a slave) at my government job. I had strong work ethic, was reliable, and a great communicator. Over the years, the physical injuries i sustained during my work there caught up with me. When i filed a worker’s comp claim, and then a worker’s comp legal case against, I went the hell! The level of game-playing, disrespect and harassment was over the top stressful and made my physical and emotional pains worse! I filed with EEOC but it made things even worse! I was eventually given the option of staying, with NO work restrictions or resign! I opted to take a regular early retirement (they denied my disability retirement appeals) so i would at least have SOME income. After two years if pain and suffering, i settled my legal case for than my yearly salary-i was just DONE! It was with law enforcement, so they had more resources of harassment than i could continue to endure.
EEOC do not help workers people at all then they send you loads of of paper work for you to fill out , now they know you not going to fill them out especially when you stressed out can’t think or hurt so what is their job why they sit in there how come they can’t ask the question fill out over the phone?
So it seems like these employers can get away with anything they want to and nothing can be done about it. The EEOC isn't worth the effort to me I see. The lawyers want to charge you out rages frees just to look at your case and are not sure if it is worth anything.

I recently had a harassment complaint at work and I was pleased with the outcome. Problems arose when I needed to get a restraining order against the harasser. Since my employer "investigated" the complaint I thought that getting a copy of my statement would help me get a restraining order passed. When I contacted them I was told there was no paperwork to be had. ??? That nothing was in my employee file.??? How can that be? I just wanted a copy of the summary statement. Deep down I do not believe they did an investigation, I signed no papers, I was not even interviewed by a HR investigator. I plan on speaking with a legal aid consultant to get my statement or anything to get the restraining order. What should I do overall, and do you all think I will have a positive outcome? Should I just leave and get a new job and just put all of this behind me?

I requested that my job reopen a sexual harassment investigation and the company retaliated against me. They terminated me and not only terminated they ended my career in trucking. They reported that I smoked marijuana and consumed adderal. The random drug test given to me was negative and I had a prescription for the adderal. I’ve gone to EEOC previously and they didn’t help me. I need a good lawyer.

I can't say how I know, but my employer has LOTS of EEOC claims open against them. The individual claims don't seem to phase them. Would it be more effective for the people with claims to come together for class action?

I was an assistant manager at a Dollar Tree for about 2-4 years. First as a sales associate then asst manager. They gave me a 401k but can't get any information about it because they inputted the wrong birthdate for me and I tried and tried to get them to change it but they have given me the run-around so much that I've given up. I just had a eeoc case here in Los Angeles this week! I wish I would have seen this before I had my case. He’s right! I should have hired an attorney instead of trusting the eeoc would have my best interest in mind. AND I still lost my job! I work for a charter school district.
I was terminated from my agency last week with the reason being: they didn't have a client for me to work with & the school I was at didn't want me back. Odd, considering since I was told that they had many clients available since my case was unfortunately going to fall through (the client wouldn't be with the school district anymore). I don't know if there's anything that could be done about that

EEOC was pointless in my case. Fired from job because I refused to be a plumber, when I was hired to be a "Purchasing Specialist". Need better representation of wrongful termination. If the company is racist why would you want to work for the.
In Florida we spoke with multiple attorneys regarding workplace discrimination and sexual harassment cases. None of them had a "free" consultation, their fee for the first consultation was $250. If they decided to take the case there would be an additional charge (up to $500) to have them do the EEOC filing, and then they would decide if they'd handle the rest of the case on a contingency basis. Florida is an FEPA state, so the EEOC would dual file with the FEPA/FCHR office. But my understanding is that if instead you file with the local FEPA (FCHR office) it will still be dual filed with the EEOC, and the local agency might have stricter laws than the federal EEOC leading to a stronger case. Honestly the information out there is difficult to weed out, some law firms appear to be mostly interested in making an initial $250 - $500 than helping the client unless you have an easy/high profile case. Whatever you do, you can't file with both the EEOC and FEPA, but it is best to use the FEPA for the initial filing and let the FEPA pass it on to EEOC (if your state has FEPA). This "dual filing" is automatic. To anyone who reads this: The most important thing is that you have a very detailed LOG of names/times when the incident(s) occurred. Also you obviously had to have tried to make at least a few attempts to resolve it with the employer via managers and HR. Basically you have to show a pattern of the employer being negligent by not addressing your concerns, if you can't do that, they will simply brush you off as a disgruntled employee. Do NOT wait for them to fire you before filing! Do that, write it up in a document and have that document on hand PRIOR to consulting with any lawyer or filing an EEOC claim on your own. Bottom line: Be prepared, don't lie or embellish your claim.

The incidents occurred over the past two years, and it reached a turning point in July 2022 which is what triggered us to look into this. She is still employed by Walmart, but was demoted and is being harassed to the point that she should quit due to the intense environment this created. Not only did they refuse (both managers and the store HR) to address her concerns, we had to discover for ourselves that we could go up the chain to Walmart's ethics division (a 3rd party they use). It's been a couple weeks and nothing was said to us about her claim. So now we are seeking EEOC filing (my wife is 59 and has over 35 years experience with the job she does). My question is do you have a firm that you would recommend that handles cases in Florida?
@@WyMustIGo We actually do handle EEOC matters in all 50 States, but if you can find local counsel in Florida it will generally be cheaper than hiring our firm just because they don't have to fly attorneys around the country like we do.

What about if you had an employer that used a mentally ill woman to harrass to threaten or harrass you but I dont hold the woman accountable for what she did being she was mentally ill. Then the employer thought some silly things . Then had law enforcement, my apartment manager, other residents, other small businesses, etc.. continue to harrass you until you had a mental breakdowns. Almost didnt make it and continue to struggle everyday because of the abuse. Whats that worth? I live with a lot of issues with the community. The employer is probably the richest guy in the tri county area so everyone just did whatever. Hoping to get themselves into a position of power or something. I contacted WERC. They didnt have much to say. Im guessing hes got private investigators hounding and harassing me as well.
That's all I'm going to say for now. Literally... I've been dealing with this nonsense for over a year and 6 months. You're the 1st... The 1st to actually show interest on my behalf besides whatever little help to help know what was going on. My brain slid right off the plate off because of this. I understand being a man and sucking it up. But some things still haven't stopped. I always hope after someone makes a mistake. They'd stop. Learn and move on. I gave as many breaks as I could. But apparently, unless I do some sort of negative reinforcement to get things to stop. It's not... As in legally. I'm not getting myself in trouble because of emotions or acting bad as these people have. Unfortunately, because of those people's actions, it has been unmendable or that doesn't have a simple fix. Once the defamation starts. It doesn't stop. Stack the mental issues that came with it along covid and normal defamation. It's too much to where I need some sort of justice or a way to deter from things continuing or occurring again. I apologize if my language or typing isn't the best. Genuinely, it blew some sort of fuse to where I have a hard time focusing. There is too much inside. Once I get going, I can't keep track, but it's all true. Getting it in order is the problem.

I got let go When I was 19 at a fast food place and they lied on me saying that I was let go along time ago and I lost my stubs when I tried to file for unemployment. We sat in front of a judge and they lied and I got denied for EVERYTHING.

I filed with the EEOC after being threatened from a worldwide company that I would lose my job if I didn’t come back by a certain deadline. I had an emergency surgery due to an injury than had to travel out of state to get 5 more surgeries by the specialist, ended up in a wheelchair, and yes all was documented and filed with HR even by my doctors and EEOC did not do anything for me even with all the evidence I had including a call video from an HR person telling me I’d better walk away, unfortunately because I had to focus on my medical issues and two kids, as I was a single mom, I did walk away. Bottom line I would never advise anyone to file a complaint with them, just get a lawyer, you will be better off. EEOC should not even exist, the people are useless and don’t care about your case.
What if they give disciplinary action to black employees but not to white employees? I know you should do the step by step with the company HR department and so on then rappels to corporate then go through EEOC. However, the pudding is in the paperwork and they’re basically just saying you’re utility with no proof. The plant manager is telling supervisors to write up certain employees, but the people getting disciplinary action are black.

Hey Vince, I was told to ask to speak to the EEOC Director if unhappy with receiving a Right to Sue. The reason they said they didn't have jurisdiction is the reason the company never had a right to have me terminated. No employer/employee relationship. Right, because my boss was independent representative for the company. He controls decisions of an employee.

He's been with them 30 years. I was thinking EEOC took the case because I was never an employee of the company that had me terminated. It's an insurance company.
@@tallchicknvegas So the EEOC determined you were an independent contractor? Or that you did not work for the company at all? If you were correctly classified as an independent contractor the EEOC may not have jurisdiction over your matter, but State or local laws may still offer you protection in some pats of the country. (Example: NYC but there are many others) Check with local counsel about your State and Local rights.

The owners have an independent contract with the insurance company. Then I was fired a week later.

I have been told that I am, suppose to be, a 'Team Player' and that entailed doing dirty and smelly clean up jobs that the other so called 'Team Players' (co-workers) refused to do. Safety rules were always changing depending upon the Stupidvisor liked you or not. Low accountability for co-workers. High accountability for me is what I was seeing and had to deal with.😑
