A week after i proposed to my girlfriend she told me: "Marriage is based on trust, so you wanting a prenup means you don't trust me. Marriage partners should be equal" I replied: "Give me one good reason why should i sign an agreement that can only benefit you and can only be damaging to me in the event of a divorce. Marriage is between two people and it's in no way a given that both will feel the same way decades or just years from now." She got mad enough that i got suspicious she cared more about money than me, and even though she then said a prenup is ok, i decided not to tie the knot too soon, and it didn't take long when i started to notice a change in her behavior whenever we talked about money so i left her and not long after that i found a great girl and we have been happily married for 8 years.. With a prenup.

Excellent video. Respectfully 41% of first marriages end up in divorce and majority of those 59% are your grand-parents and parents that stayed together. The statistics are way way worst than that. Between 2007 to 2017 only 6% of those that married in 2007 (regardless of first second or third marriages) were still married 10 years later. That is 1 in 16. Uncle Sam hide these numbers since they are catastrophic with number games like 1st 2nd and 3rd marriages comparison...bla bla since the population is aging rapidly and the real numbers can be fixed that way. People dont have the slightest idea until they socialize a lot and notice that majority f the people are divorced at least once. You get married today and your chance to be divorced within the first 10 years is 94%...based on the 2007 to 2017 date...but interestingly Uncle Sam stated that divorce rate became worst with covid...so go figure. He should mention that prenups can be challenged and cancelled in many states upon the divorce by the other side lawyer.

I’m a Christian and married a young girl from my church in LA when I was 23 (& pastoring a church there). 13 years later, people change over time, she shocked me with a nasty divorce. She’s a dedicated Christian with blogs and videos talking all the typical super-Christian “anti-divorce” narratives… but funny how people act when things get stressful. They never tell you on your wedding day: “I just want you to know, when things are stressful down the road, I’m going to become the most irrational person you know, come after your money, & screw the kids”. Lol Prenup is the only logical way to go now a days. Remember, marriage is sadly a business investment to most woman - it’s a “come up quick” arrangement to many. Remember: 80% of divorce are started by woman, but 90% of the monthly payments paid out go from the man to the woman. Another great option that has gotten popular is to just not get married with the state and only in your church. Most states have “dual dwelling” laws now so you still get the tax benefits. Ask a lawyer but it’s really becoming popular.

Prenups are never upheld in Canadian courts and I suspect US courts find many ways to invalidate them as well. Correct me if I'm wrong, but prenups provide nothing more than a false sense of security and are promoted to fool the higher income earner. Courts and lawyers always want their take. It's so corrupt, I immediately lose faith in anyone that promotes marriage knowing full well the result is certain lifelong servitude. I still like PBD, but my advice is: don't marry, don't cohabitate. At the very least, talk to 20 people in your jurisdiction that have been through divorce etc. and can speak freely and honestly before you make any lifechanging decisions.

So many women go to church to find their lottery ticket. It was never about marriage. Divorce is often the goal. If you want to know the intent, look at the results.
@capitalistwire
@capitalistwire Год назад
@@csn10 Some good points for sure man. In the US, this varies by state but overall prenups are not 100% bulletproof but they do show intent, draw a lot more clarity in the relationship as it starts, and courts usually strongly consider them. Its a contractual agreement and it does carry some weight for sure in a lot of states. And believe it or not, all the ones I've ever seen (maybe 7 or 8) were originated by the higher income earner who's trying to protect themselves should the other person become a gold digger later on.

That's some bullshit right there. The whole point of a contract is that you are not friends when it comes to a business partnership. So why do you need a marriage contract. I asked my now wife of 8 years to sing a prenup before we marred. She asked why we needed it. I told her 100% of all of our previous romantic relationships for both her and I did not work out over time. So, with both of us failing 100% of the time we need to understand it's possible to fail again. She singed and we marred. In 8 years, she has never even said a bad word to me and we have not had any fights. She has her responsibilities and I have mine and we work together against the world instead of each other. I don't know if it would be the same without the prenup. Its so easy to quit on marriage in the modern world.

I kept one car, she got one car. I kept my 401k, but took the debt. She walked away with the furniture, a car, debt free, and I kept the house and a car. Last year I sold my house, my ex was my realtor, I cleared over 150k, she got a nice commission. It was funny. Now, I live in another state, in a house, on landi inherited. All debts paid off, 2 cars, 2 motorcycles, and trying to meet a woman. I keep meeting women who are in debt, with kids who are " my world" and a prenuptial makes total sense...that or staying single

You would be surprised how many former partners end up winning and having the prenup thrown out or have the terms renegotiated.

Advise, prenups can be rejected in courts and thrown away, but to prevent that, before it's signed a medical professional should be present and yr spouses attorney too, then a video recording should be done, to prevent yr spouse saying they were pressured in court to sign it . Also prenups cannot protect you from losing money after divorce, child support and alimony aren't protected.

1. Keep your finances separate A prenup defines whether the assets you own like your house or car are separate property of one spouse or part of the marital estate. If you’re considerably wealthier than your partner, a prenup is a good step towards ensuring that your partner isn’t marrying you for your money. If you earn more than your partner, then a prenup can be used to limit the amount of alimony payable in the event of a divorce. If you own a business, a spouse can claim a portion of your business’ increase in value or income. Divorce is one of the biggest threats to the stability of your business, so get that squared away in your prenuptial agreement. 2. Establish property rights and distribution Your state’s laws dictate how the property obtained during your marriage is distributed upon divorce. In the nine states with community property laws, assets will typically be divided between the two parties in an equal split. Under equitable distribution state law, marital property is split in a manner that is considered fair when taking a number of factors into account, such as each partner’s financial contribution to the marriage and their subsequent needs post-divorce. Some couples might want to avoid having to leave the disposition of their assets up to the courts. With a prenup, you have an agreement already in writing, on what to do with your home and personal property, made long before this potentially contentious period when an agreement might seem impossible. Your prenup can also stipulate the distribution of your property and even life insurance benefits upon the death of one of the partners. 3. Protect one spouse from the other spouses’ debt Debt is an unfortunate reality of life, and people are bringing their debt into marriage along with furniture and family. That debt isn’t necessarily evenly allocated between the partners, and should there be a divorce, the less-burdened partner doesn’t want to have to pay off creditors, should they target shared marital assets for repayment. A prenup can help to limit one partner’s exposure to the other’s debt in the case of divorce. Any agreement should outline the separate debts of each partner going into the marriage as well as individual assets; that allows for a clear division between those debts and debts accrued by the couple during the course of the marriage. 4. Protect your family property and estate plan You may have an heirloom or property that you want to ensure stays within the family in the case of divorce. Having a prenup in place to keep any cherished items separate and apart from your communal marital assets ensures that the fate of your familial property isn’t left up to the court system or state laws. A prenup can also address any questions of inheritance and ensure that your estate plan is carried out according to your wishes, in conjunction with a will and living trust. 5. Protect your assets in the event of remarriage Should you decide to get remarried after your divorce, you’ll be faced with a new set of challenges and complications when it comes to determining how to protect your family as well as your property. A second marriage includes all the complications that already come with combining separate lives and adds the possibility of children, child support, and additional assets to be accounted for. A prenup for a second or (subsequent) marriage should address all of the concerns of an initial marriage as well as addressing concerns arising from obligations from the previous marriage. It can also spell out the distribution of assets in the case of death of one of the partners, to ensure that person’s children get any intended inheritance - again, in conjunction with a will or living trust. 6. Avoid extensive court proceedings in the event of divorce A divorce is a painful enough process as is, made even more so by a long, drawn-out and expensive legal process that can cost on average $15,000 per person. And trying to come to an agreement on divvying up your assets and property when your negative feelings towards your former partner are at their highest is challenging on the best day. A prenup signed ahead of your marriage will at least alleviate some of the headache of fighting over your assets and make the process somewhat smoother, if not easier. 7. Openly communicate and prepare yourself for the possibility of divorce No one wants to enter marriage thinking about the possibility of its failure, but given the oft-cited divorce rates, it’s a reality impossible to ignore. Having that difficult conversation with your partner before you get married about the potential for divorce and finances, allows you to be open and honest with one another, and prepares you for the difficult conversations that are required in any marriage. When you’re prepared for the possibility that your marriage could end in divorce, you’re being emotionally realistic. You’re also being open with your partner about your financial status, needs and concerns as you enter marriage.

Diplomatically well done Patrick. However I definitely think a kay point you neglected to mention is that the lawyers of both parties should look at the prenup before its signed off. The reason being so that it can never be said that either party signed it under duress, which can get the prenup completely thrown out in many states. Another factor that should be included in all prenups is mandatory paternity testing with significant penalty clauses if they don't come out clean.

When my bf and I get married, we've agreed we'll get a prenup. I have my income, he has his income, and both of us are the sole heirs to our parents' inheritance. We're equals. That is what a prenup is for, imo: to make sure we have an equal marriage in which divorce doesn't benefit one side over the other.

We had a relationship agreement prior to marriage. That was my idea so he knew my intentions where pure....and just a bit of peace mind for him that I didn't want his things I wanted him. We also have a pre nup. It's generous to me and will change the longer we are married. I pay half of almost everything. Even though he earns 5 to five times more. But that's just me. I love to contribute financially...makes me feel good... Fingers crossed we always love each other but this is second time around for us both. Pays to be careful. I recommend EVERYONE get a pre nup so many men get screwed over and it's not fair. Especially when they had wayy more when the relationship started. Anyways that's just my feelings and thoughts.

Great video Pat - very logical and convincing argument to get a prenup! You’ve hit the nail on its head! It’s interesting to read the opinions on not getting a prenup. Yes, a prenup is a legal contract, and when done correctly with competent legal counsel, it is very clear and holds weight in court (if you live in the right state). What else is a legal contract? Marriage. Marriage is a very poorly executed and ambiguous legal contract, which allows family law attorneys to manipulate their clients into fighting until one party is zeroed out. A prenup (and postnup) serve to correct a terrible and unconscionable contract. Most anyone who has been through the family law system understands the gravity of these concepts. The solution - prenup, or just avoid marriage altogether. (This includes “common law marriage” - check your state laws, and use a cohabitation agreement if necessary, or just do not move in together.)

Thank you for this video. This shook a lot of fear out of me. My partner had never thought of a prenup, and he’s the money maker. I work but I will never make what he makes. I was scared about a prenup cause it sounded like he could leave me and take the house & my car with him because it’s in his name (the car). But I felt it was the most honest thing to do, to explain to him that he needs to protect himself. I got very sad at the thought of losing everything one day or living as though none of what we have is really mine but wow. I love this. This literally would protect both of us. Thank you thank you thank you.

The problem is MEN need to enforce the prenup before marriage (if they are silly enough to get married). Men get manipulated by the woomin by her saying "you dont trust me", or theyl cry like little kids and the men cave and not get it. If a woomin has a problem with a prenup, drop her, she cannot be trusted. because she can also say she was pressured into the prenup. You as the man need to be willing to walk away if that happens.

I wouldn’t mind signing a prenup if my SO didn’t make me sound like I was greedy and was with him for his bank account. That’s what happened in my last relationship and I was offended. I brought up how that hurt me and he got upset that I was upset. He didn’t know this, and I didn’t dare tell him, but my ex before him made ten times more. He cheated on me and I never made him owe me anything. Never laid a finger on him, never cussed at him, never destroyed any of his properties. I just walked away crying.. he said my refusal to take revenge and only showed him love really killed him. He said it was “the worse breakup.” He tried coming back months later, but I didn’t take him back. When I rejected him I rejected his 7 figures, too. I wish my last ex knew this about my past so he’d stop suspecting that I was only dating him for his money and that’s why he thinks I should sign a prenup. I’m still offended by those words to this day.

Your past behaviour is not a predictor of future behaviour. Yourself cannot guarantee how you will behave in the future. Hence his request for prenup may have upset your value system… but it still was an honest way to protect you two from future conflict. You put your high ego and value system up front and preferred to be outraged rather than valuing the relationship. Good for you, it showed you that your ego matters more to you than what you thought this relationship could bring to you.

A judge will not honor a pre nup that is completely one sided. If the rich husband says you get nothing, the judge throws it out. A prenup has to be fair for both parties. A 50 50 prenup is fair. But today, most men lose 80%.

While this happens the man is still going to work and going forward with his career. Obviously, this is not fair, so how should we make it fair? Traditionally marriage was seen as a safety net for the women, and it was kind of 'rightly so' - an aged woman has more issues finding another 'quality' husband that will give her the same situation. Most men are not terribly big earners and live paycheck to paycheck, so losing a few thousands is no big deal but I would agree that if a fortune was amassed, it should legally not be 50% that's given when divorcing.
