Honestly I’m glad that the case was dismissed. I don’t think he should’ve been charged in the first place.

The amount of people going on and on about how Baldwin was responsible for checking the gun before shooting it was ridiculous. I'll never understand how they couldn't see that the context of this situation clearly didn't call for that. They are all like "oh the last person with the gun HAS to check it. Period. Every gun owner knows this. Baldwin should be convicted", when thats obviously not how it works on a movie set where there is literally a person whose job it IS to do that sort of thing instead of the actors

Its against SAG safety rules for an actor to check the gun on their own, they can just ask the armorer/1st AD to show them the chamber at most

this absolutly. then ive also heard tons of people repeat the phrase dont point it at anything you dont want to destroy, yes that phrase is true in any other situation but when filming a movie where the shot specificly requires the camera to be looking down the barrel you are going to point it at the camera.

Absolutely correct. Those who want to impose real life rules, such as not pointing guns at people and personally checking every gun and round, also don't impose real life rules to car chases. Movies sets are different. By the way, the series Seal Team shot in excess of 2 million rounds in their 7 series. No actors personally checked every round because that would have been impossible if deadlines and budgets were to be met. They had 8 armourers on set to do that.

What's the point of this question? The judge explained why the case was dismissed--the prosecution improperly withheld evidence.

Very well covered. This whole ordeal felt off to me, from the jump. Like, of course this was a tragic incident and NOBODY should lose their life while creating art. But he wasn't at fault for even a second and i had friends who genuinely heel-turned against him as soon as the media reported on it.

2:32 I’m obviously not finished watching this clip, but I’ve always looked at it that in this case Alec was also the executive producer who hired the armor. If the government could prove that she didn’t have the experience and the ability to do the job and he hired her then he could be liable. However, this is coming from someone who doesn’t know the industry and also isn’t a lawyer so take my two cents as a penny of salt.

In my opinion two things the prosecution wanted their 15 minutes of fame. Thr second thing is that (and i don't know if it happened ) but baldwin will probably have to pay in a civil trial because he was a producer. The prosecution was trying to use baldwin as a producer and i remember that argument got thrown out before they finally decided to throw the case out.

I agree there is grounds for a civil trial carried out by the family for wrongful death. I thought the family had already carried out a civil lawsuit or am I mistaken. Idk if they settled out of court

Unless you could prove that the producers hired someone they knew to be negligent, incompetent, or bad at their job, being a producer doesn’t make you at fault.

Another thing as well: For any future civil cases anyone could bring against him, the judge ruled in the criminal case before the trial even began that the prosecution could not bring up Baldwin’s role as an executive producer as part of the case, as Baldwin’s hands-on role as a producer was heavily limited because he was also an actor on the production. There were also at least half a dozen other EP’s on the film and almost all of them had a bigger role as a producer than Baldwin did. Keeping this in mind, that ruling would be part of the record and would certainly be accessible to any attorney overseeing a civil case against him in this matter. The judge for that case would then be hard-pressed to rule in favor of introducing his role as EP into evidence, but they could still rule in favor for introducing it. However, I am also neither a defense attorney nor a prosecutor, so there could be a caveat or two I’m missing here.

John, the analogy you use with 2) doesn't quite fit this case. It's the 'beneficial to defense' condition that satisfied the Brady violation. The evidence was not required to be 'important/critical' - the fact that the evidence could potentially have influenced how defense would have argued the case on Baldwin part - is enough.

Only a completely brain fried armourer would mistake dummy bullets for live ammunition. After the shooting, a witness testified the armourer gave her a bag of coke to hide from the cops.

Baldwin can't be fired because he wasn't criminally at fault. This case never should have even been brought to court. So no, Hollywood can't use this situation to punish Baldwin in any way. Baldwin is free to resume acting whenever he chooses. What will happen with Rust? It might eventually get released someday, but that's still up in the air.

@@christopherbrown5023 I just ask because I know there are certain cases where the actor has done something wrong and all of the sudden fans and movie goers just turn against their idol and forever view them as bad now and promote cancel culture. It doesn't matter if what they did was a mistake. Case in point, the Will Smith slap. He's still doing movies but Disney no longer wants to work with him and some people's perception of him has changed after what he did. Baldwin will have some haters regardless of the outcome. People are just too sensitive and don't want to see anything bad happen to their favorite movie stars or else their reputation will forever be ruined.

Yes. And Halyna Hutchins husband was named a producer when the completed the film as part of that settlement.

​@@willmahoney2452but that isn't enough for Gloria Allred. She is suing on behalf of the parents and sister of Helena. There are also outstanding lawsuits from others that claimed to be traumatized. The medic was paid over $1.1m by Sarah Zachary for the trauma she suffered so there is big money to be made from these lawsuits.

Your statement is factually incorrect. The court ruled days in advance that his role as a producer had no relevance to the criminal charges. It MIGHT become relevant when it comes to CIVIL liability (money), but as a producer there is obviously no criminal liability.
