The union which represents civil servants, the Public and Commercial Services Union (PCS), said it was considering taking legal action to prevent its members in the department for Business and Trade "from being forced to carry out unlawful acts".
PCS said that the government has an "obligation to do all it can to halt the onslaught".
"As it does not appear to be willing to do so, we are seriously considering taking legal action to prevent our members from being forced to carry out unlawful acts," Paul O'Connor, the union's head of bargaining said.

If it’s the killing of 32,000 + people including over 10,000 children, you literally can’t go in there and count them. So empirical proof is not possible. What we do see on our tv screens and on social media is horrifying. You have to rely on the best available information. That information is generally accepted by Israel’s greatest allies. If you’re referring to aid getting in, I’m happy to address that for you. Let me know which proof you’re going for and I’ll give you an answer.

Also, to point out the basics to you, Isreal has NOT been found guilty of committing ANY war crimes! And, as the law you so clearly want to use in your argument, states that you are innocent until proven guilty then no war crimes have been committed. Ergo we cannot be guilty of supplying arms to a nation committing war crimes if no war crimes have been committed.

Not once was it mentioned here, that the government has refused parliament the right to see its own legal advice regarding the sales of arms to Israel. There also appear to be sources suggesting the government has been acting against that advice. Civil servants have a right to be concerned if their boss, the government, may indeed be breaking international law.

When obeying an order constitutes a crime, which selling arms to a genocidal regime is, then it is not only a moral choice but a legal imperative not to obey that order. After, since Nuremberg I think it is, obeying orders by soldiers is not an excuse for committing war crimes. Same I guess holds true for civil servants.

If you suspect an action you are being asked to do is illegal then you have the right to refuse. The requestor then has the option of confirming that the action is legal and if they can do so, the worker has the option of leaving the organisation. If the employer cannot provide that proof then the individual can resign and go to tribunal for constructive dismissal.

All British soldiers are told that you can decide not to follow and unlawful order and face no consequences , these Civil servants are legally allowed to refuse to follow orders that are illegal and could result in them being tried and convicted of aiding and abetting war crimes....they are absolutely in the right to refuse to work on a criminal action being perpetrated by their bosses in Whitehall and Parliament. This in reality isn't about political decisions by the civil service members, it's a legal issue, every employee in the country has the legal right to not follow orders that involve criminal actions and I hope the government are tried and brought to justice for aiding and abetting the very clear crimes on humanity that Israel are comitting.

Ridiculous reply. By 1943, over 70% of those in the SS were conscripted young soldiers who had no choice! And most of those NEVER undertook any actions that could even remotely be considered a 'war crime'. Why would they have been charged with anything? One aspect is the possibility of complicity in war crimes. It is illegal in this country to force someone to commit a crime to the point members of the military are required to refuse unlawful orders. In that respect civil servants fully have the right to refuse if they believe the conduct they are told to engage in is illegal.

They'll just be replaced with a yes-man/woman/person. They SHOULD take industrial action and legally strike until they receive the assurance they are asking for. Its not an outlandish request they're asking for anyway: "Hey boss, can you please ask your higher-ups if we're committing a crime here? We're having some concerns based on what we're hearing from some experts on the matter. Thanks."

There is no ‘legal position’ and it’s not up to them to make that decision - a civil servants job is to carry out their duties within the law as it currently stands and as directed by the elected government. Period.

I partially agree. But these things can be both. For example, I decided many years ago not to work in sales. Because too often their job is to sell you something you might not need, want, or are unable to afford. Though not illegal, it's morally wrong.

If civil servants are issued guidance by their Union, who will have taken advice from their own lawyers, and who say that they may be complicit, then they have a right to refuse to act. I'm not a lawyer, but I feel like you can't compel someone to follow orders if they feel it is legally dodgy - and they should have at least as much protection as conscientious objectors... I am sure unions would have the ultimate field day with this.

@@georgesdelatour If it's a policy that is entirely legal - even if controversial - then the civil servant should be brought in for disciplinary or have their contract terminated. Civil servants are there to lawfully exercise the policy of the government; if that government's policy is in conflict with international law, then that policy can not be legally exercised. Saying that they don't want to cut/raise someone's benefit for instance, regardless of how morally dubious, could still be legally enforceable. Saying that they refuse to sign-off on a contract where arms are sold to an extremist regime is a whole different kettle of fish.

@@jordanwalker2804 “Extremism” isn’t the kind of word any sane person would use to frame a law intended to be predictable and justiciable. It’s too subjective a concept. During WW2 the USA provided massive amounts of weapons to Stalin’s USSR, which would certainly fit most modern people’s idea of an extremist regime; it just happened to be at war with another extremist regime which was arguably worse. Right now, as a result of the Ukraine War, there is a vigorous arms trade going on between Russia, North Korea, China and Iran. Many people think that all four of those governments are pretty extreme. Somehow I don’t imagine there are any North Korean civil servants refusing to sign off on arms exports to Russia. Anyone who mentioned “international law” to any of those four governments would get laughed at.

Morality is subjective. What may be 'moral' to you may not be moral to another individual. I would think that the majority of those who work for arms manufacturers feel that their 'moral' obligation is to their families, to earn a wage to feed them, clothe them etc.

Actually a lot of the people who served in the German army (not so much the SS but the regular army) were told that unless they served the Nazi's that their family would be thrown in the prison camps with the Jews. I wonder how many of us face prison camps if we refuse to fight the Russians in this current war? (Who knows what happens to people after they go to prison many of the wider German populace trully had no Idea what happened to the people sent to prison camps until after the war ended)
